Abstract

Abstract: This study discusses the dimensions of the conditionality of the Koran, the flexibility of the Koran, and the implementation of the National Sharia Council of the Indonesian Ulema Council Center for the dimension of conditionality and the dimension of the flexibility of the Koran regarding sharia bank products in Indonesia. With a qualitative approach and content analysis method, it is found that the conditionality of the Koran means the conditioning demanded by ‘illat al-hukm (legal motives) within the framework of tathbiq al-hukm (application of the law). The dimension of the versatility of the Koran shows that the existence of the Koran is always flexible in responding to demands the size of the place and time that surrounds it without ignoring the objectives of the shari'a. Indonesia has an Indonesian Ulama Council (MUI) which appoints its National Sharia Council (DSN) -MUI work unit as a fatwa authority institution that enters into the sharia application legislation regulation legislation practiced by the banking world in Indonesia. Islamic banks after obtaining legislation from Bank Indonesia and issued regulations by the Financial Services Authority (OJK). The presence of the DSN Fatwa institution is evidence of the dimensions of conditionality and flexibility of the verses of the Koran in the field of Islamic economics.Abstrak: Penelitian ini membahas tentang dimensi kondisionalitas Al-Qur’an, fleksibilitas Al-Qur’an, dan implementasi Dewan Syariah Nasional Majelis Ulama Indnonesia Pusat dimensi kondisionalitas dan dimensi fleksibilitas Al-Qur’an tentang produk bank syari’ah di Indonesia. Dengan pendekatan kualitatif dan metode analisis isi (content analysis) diperoleh bahwa kondisionalitas Al-Qur’an bermakna pengkondisian yang dituntut oleh ‘illat al-hukm (motif hukum) dalam kerangka tathbiq al-hukm (pengaplikasian hukum). Dimensi fleksibilitas Al-Qur’an menunjukkan bahwa eksistensi Al-Qur’an senantiasa luwes merespon tuntutan, seukuran dengan tempat dan waktu yang melingkupinya tanpa mengabaikan tujuan syari’ah. Indonesia memiliki lembaga Majelis Ulama Indonesia (MUI) yang menunjuk unit kerjanya Dewan Syariah Nasioanl (DSN) MUI sebagai lembaga otoritas fatwa yang masuk ke dalam wilayah regulasi legislasi aplikasi akad syariah yang dipraktikkan oleh dunia perbankan di Indonesia. Bank syariah setelah mendapatkan legislasi dari Bank Indonesia dan diterbitkan peraturan oleh Otoritas jasa Keuangan (OJK). Kehadiran institusi Fatwa DSN merupakan bukti implikasi dimensi kondisionalitas dan fleksibilitas ayat-ayat Al-Qur’an dalam bidang ekonomi syariah.

Abstract

This article anaylizes the philosophical and episthemological exposition of the contemporary Arab thinker, Muhammad Abed Al-Jabiri. As a leading Maroccan Muslim thinker, Abed al-Jabiri in renowned for his idea of combating‘irrationalism’ and that of promoting rasionalism in formulating Islamic thought. He comes to believe that Islamic teachings should be seen as a set of ideas com- patible with rationality and scientific notions. In his analyisis, Abed al-Jabiri pro- poses three streams of Islamic epistemological models: bayani, burhani and ‘irfani. By exploring these three epistemological concepts, the author goes further by exploring the authority of text in Muslim society and how to contextualize and read religious texts in modern time.

Abstract

This study explains Maqâshidî Interpretation and its application in interpretation Of Ahkam Verses, and aims to discussion on Maqâshid asy-Syarî’ah and the significance and urgency of Maqâshidî. Maqâshidî's inter-pretation is expected to provide an alternative interpretation in providing solutions for contemporary problematics and reinterpretation of the interpretation formulations that have been out of date. The research method used in this research is qualitative method and analytical descriptive method. This study concludes that The character of Syarî'ah is permanent and governs the whole af'âl al-Mukallaf in every place and time, then the approach or method of maqâshidî interpretation in interpreting Âyât al-ahkâm is a necessity and very imfortant. The discourse of Âyât al-AhKâm interpretation discusses on the place of law formulation against a problem (Fi'l al-Mukallaf). he necessity of interpretation of the approach or method of Maqâshidî interpretation is not only effective in responding to new issues that have never appeared before but also empowered to reinterpret the formulation of interpretations that have not been relevant anymore in the context of the present and the contemporary.Keywords: Maqâshidî Interpretation, Maqâshid asy-Syarî’ah, Âyât al-AhKâm,

Abstract

Tujuan penelitian ini adalah untuk menganalisis alasan kenapa Ibnu Hazm berbeda pendapat tentang sewa dalam islam. Kemudian, bagaimana pendapat para ulama tentang sewa menyewa? Darimana sejarah pemikiran Ibnu Hazm? Metode Penelitian ini dipakai adalah metode studi literatur penelitian yang dilakukan dengan menggunakan buku sumber yang berhubungan dengan judul penelitian dan dijadikan sebagai literatur guna menemukan jawaban atas kegelisahan-kegelisahan penelitian. Para ulama berbeda pendapat mengenai sewa menyewa dalam islam ada yang berpendapat boleh asal akad yang dilakukan adalah dengan jalan muzara’ah. Jika biaya sewa yang diberikan pada awal akad maka akad yang diberikan tidak sah. Karena akan rentan merugikan satu pihak. Menurut pendapat Ibnu Hazm, sewa menyewa itulah yang mendekati pada ekonomi syariah yang berkeadilan yaitu dengan cara muzara’ah. Dengan kata lain kedua belah pihak mendapatkan bagian yang sama rata dari hasil. Menurut pendapat Ibnu Hazm tidak adil jika sebagian mendapatkan hasil yang banyak dan pihak lain mendapatkan sedikit bagian. Tetapi perbandingan bagian yang dilakukan di awal akad dengan takaran yang sama

Abstract

Water is one of the most important natural resources in human life. You can imagine what life would be like if there was no water. The rate of population growth which is inversely proportional to the availability of water has caused a water crisis. The water crisis has made people aware of the need for efforts to raise awareness about the importance of water and its maintenance. Water as one of the fulfillment of needs, as well as a means of worship requirements. To what extent Islam views water as a very urgent resource, it can be seen from the explanation of the rules for managing these resources. The research method this time is a qualitative research that emphasizes research that uses library materials as the main source (data). From this presentation, it can be seen that both Islam and the rule of law in Indonesia place water as a very important resource.

Abstract

Pembiayaan murabahah merupakan produk penting bank syariah guna mendistribusikan dana kepada para nasabah perbankan tersebut. Pembiayaan ini tentu mengacu fatwa Dewan Syariah Nasional Majelis Ulama Indonesia (DSN-MUI) dan Standar Produk Perbankan Syariah. Perspektif fiqh, marabahah sebagai transaksi jual beli dimana barang mesti ada di antara bank dengan nasabah, tetapi secara praktik adalah penyaluran dana karena bank sebagai mediator yang tidak mempunyai barang, sehingga bank bersandar pada akad wakalah untuk menyalurkan dana dan mendapatkan keuntungan dari jual beli tersebut. Berdasarkan penelitian sebelumnya bahwa pembiayaan murabahah bil wakalah masih tidak selaras dengan prinsip syariah, bahkan implementasinya tercemar oleh moral hazard, dimana penyaluran dana tanpa ada jual beli barang sebagaimana tertulis dalam akad. Penelitian ini adalah penelitian hukum dengan metode deskriptif menganalisis bahan hukum primer, sekunder, dan tersier. Dengan menggunakan pendekatan ushul fiqh, penulis melakukan content analysis terhadap norma hukum pembiayaan murabahah. Penelitian ini mengalisis legal standing subjek hukum, hubungan hukum dan menentukan perbuatan hukum sebagai sebuah akad pembiayaan murabahah. Kebaruan    dari penelitian ini adalah rukun syarat pembiayaan murabahah terdiri dari empat pihak dan sebelas perbuatan hukum. Revitalisasi dari penelitian ini yaitu DSN-MUI dan OJK perlu  membuat legal standing pelaku pembiayaan, bukan hanya bank dan nasabah, serta memasukkan sebelas perbuatan hukum sebagai rukun atau syarat baru dari akad pembiayaan murabahah,    agar sesuai dengan prinsip syariah.

Abstract

Ethics in business, can be interpreted by learning about the difference between good and right with bad and wrong in the business environment based on moral values added to halal rules and then haram, then Islam interprets business ethics as a collection of ethical attitudes and behaviors of business that are based on religious teachings by prioritizing halal and haram first. General provisions in thinking, especially business ethics according to Islam which is a science contained in the Qur'an and Al Hadith, which needs to be used as the main reference by all Islamic business actors so that in carrying out activities not only oriented to get world prosperity but also obtain prosperity hereafter. Al Ghazali has conveyed the basic principles in an effort to obtain worldly wealth as well as the Hereafter, namely with the instructions he gave on how to behave in business, basically adapted to the guidance of Islamic teachings both the Qur'an and As Sunnah or Al Hadith.

Abstract

Repositioning the ihdad of career women is a phenomenon that involves changing the role and position of women in a professional context. A multi-perspective approach is needed for a complete grasp of this phenomenon, including philosophical, historical, juridical, and sociological studies. The research method is the normative method with a literature review (library research) with a phenomenological approach, historical approach, philosophical or philosophical approach to Islamic law (ushul fiqh), juridical approach (regulations and fatwas), and sociological approach, then combined with retrospective methods and analyzed qualitatively. According to the results, a thorough comprehension of women’s shifting roles and positions in the workplace can be seen in the repositioning of ihdad from a philosophical, historical, legal, and sociological standpoint. From a philosophical perspective, career women’s ihdad repositioning involves considerations of gender equality, justice, and human dignity. From a historical perspective, career women’s ihdad repositioning reflects significant social changes in the role and position of women in the workplace. Historically, women were often restricted to domestic roles and deemed unsuitable for careers outside the home. From a juridical perspective, career women’s ihdad repositioning involves a legal analysis related to the protection and rights of women in the workplace. From a sociological perspective, career women’s ihdad repositioning involves an analysis of social structures and social interactions that affect women’s position in the world of work.

Abstract

The Covid-19 pandemic, which began in 2020, has had various impacts on the socio-economic order, evidenced by declining public income, increasing unemployment, and a decrease in export-import activities, all of which have significantly raised the poverty level in Indonesia. Zakat, as an instrument of Islamic philanthropy aligned with its objectives, should be a solution for public welfare. Through MUI Fatwa No. 23 of 2020, zakat has undergone reinterpretation to reduce its exclusivity, demanding equitable social distribution. This research was conducted in West Java at the Persatuan Islam Amil Zakat Institution (LAZ PERSIS) to analyze: (1) The normative and historical foundations of philanthropy in Islam; (2) Social justice philanthropy activities based on zakat; (3) The contribution of social justice philanthropy based on zakat; and (4) The implications of this contribution for the socio-economic status of the community. The theory used is al-Maqāshid Syari’ah as the grand theory. The middle theory employs social justice philanthropy theory, and the applied theory uses tathbiq theory. This is qualitative research using an empirical juridical approach with a descriptive analysis method. The primary data sources for this research are the management of LAZ Persis and the community recipients of Covid-19 aid in West Java. The research findings include: First, the normative and historical foundations of Islamic philanthropy have existed in the Qur’an and Hadith and have been applied since the time of the Prophet Muhammad (SAW) until today. Second, social justice philanthropy activities based on zakat include (a) Health Assistance, (b) Basic Necessities, (c) Counseling and Advocacy, (d) Capital Assistance. Third, during the three-year pandemic period in West Java, from the WHO declaration on March 11, 2020, until the pandemic status was lifted in Indonesia on June 21, 2023, LAZ PERSIS contributed aid to 435,292 beneficiaries. Fourth, the research implications include theoretical and practical implications. The theoretical implication offers a new concept of “Holistic Integrative Philanthropy,” a form of social justice philanthropy based on zakat that is inclusive, collaborative, and professional. Practically, during the pandemic, LAZ PERSIS helped 79% of respondents maintain their economic conditions and minimize the risk of contracting the Covid-19 virus.
