Abstract

The purpose of this study is to determine the Authority Reconstruction of Judges in Detaining Children with the Justice Value. This research uses a normative approach. The resulting research states that the authority of judges including Appellate Judges or High Court Judges in detaining defendants is contrary to the principle of presumption of innocence, detention is the realm of presumption of guilt which can only be used by investigators and public prosecutors, if the judge is burdened with the authority to carry out detention, then The judge is no longer independent, because in his decision he will take into account the detention that has been carried out, even the detention carried out by the judge is within his authority, The ideal reconstruction of the judge's authority in carrying out detention based on the principle of presumption of innocence and the value of justice, is to revoke the judge's authority to detain the defendant and delegate it to the public prosecutor.

Abstract

Perkembangan teknologi informasi dan meningkatnya transaksi elektronik telah mendorong pertumbuhan tindak pidana penipuan berbasis sistem elektronik yang menimbulkan kerugian ekonomi bagi masyarakat. Penyelesaian perkara melalui mekanisme peradilan pidana konvensional sering kali belum mampu memenuhi kebutuhan utama korban, yaitu pemulihan kerugian materiil yang dialami. Sebagai respons terhadap kondisi tersebut, Kepolisian Negara Republik Indonesia menerapkan pendekatan restorative justice berdasarkan Peraturan Kepolisian Nomor 8 Tahun 2021 tentang Penanganan Tindak Pidana Berdasarkan Keadilan Restoratif. Penelitian ini bertujuan untuk menganalisis efektivitas penerapan restorative justice pada tindak pidana penipuan transaksi elektronik serta mengidentifikasi faktor-faktor yang menghambat penerapannya di wilayah hukum Polresta Cirebon. Penelitian menggunakan metode hukum empiris dengan pendekatan yuridis empiris dan bersifat deskriptif kualitatif. Data diperoleh melalui wawancara, studi dokumentasi, dan studi kepustakaan yang dianalisis menggunakan teknik analisis kualitatif. Hasil penelitian menunjukkan bahwa penerapan restorative justice di Polresta Cirebon berjalan cukup efektif, terutama dalam perkara penipuan elektronik dengan kerugian kecil hingga menengah yang memenuhi syarat formal dan material sebagaimana diatur dalam Perpol Nomor 8 Tahun 2021. Efektivitas tersebut terlihat dari keberhasilan pengembalian kerugian korban, terciptanya kesepakatan perdamaian antara para pihak, serta berkurangnya penumpukan perkara pada tingkat kejaksaan dan pengadilan. Namun demikian, penerapan restorative justice masih menghadapi sejumlah hambatan, antara lain kendala geografis antara korban dan pelaku, kesulitan identifikasi pelaku akibat anonimitas digital, serta keterbatasan integrasi basis data kriminal nasional untuk mendeteksi pelaku residivis. Oleh karena itu, diperlukan penguatan infrastruktur digital, integrasi sistem informasi kriminal, dan pengembangan mekanisme mediasi berbasis teknologi guna meningkatkan efektivitas penerapan restorative justice pada tindak pidana siber.

Abstract

The rapid acceleration of generative Artificial Intelligence (AI) has significantly disrupted the cybercrime landscape, giving rise to new forms of morality-based offenses in the form of synthetically created Child Sexual Abuse Material (CSAM), commonly referred to as AI-generated CSAM. In contrast to conventional CSAM, which depicts real physical exploitation of child victims, synthetic CSAM reproduces hyper-realistic visual content without any empirical actus reus involving actual physical abuse. This article aims to analyze the normative vacuum and juridical challenges in criminalizing AI-generated CSAM within the framework of Indonesia’s positive criminal law system. The analysis focuses on the discourse of digital forensic evidence in judicial processes and the determination of jurisdictional boundaries in criminal law in responding to the borderless nature of cybercrime. Based on normative legal research, the findings indicate the urgency of re-conceptualizing the legal definitions of “victim” and “child pornography” within the Pornography Law, the Electronic Information and Transactions Law (ITE Law), and their harmonization with the criminal law system under Law Number 1 of 2023. Comprehensive reform of penal policy is required to ensure that law enforcement mechanisms are capable of addressing and prosecuting both creators and distributors of AI-generated child sexual exploitation material. Such reform is essential to adapt criminal law to the evolving challenges posed by advanced generative technologies.
