Abstract

Penelitian ini membahas pengenaan denda bea cukai dalam proses ekspor dan impor. Penelitian ini bertujuan untuk mengidentifikasi hambatan dan resiko yang mungkin dihadapi oleh produsen, konsumen, eksportir, dan importir ketika melakukan ekspor dan impor. Penelitian ini menggunakan metode penelitian hukum normatif  artinya penelitian ini dilakukan dengan cara melakukan studi pustaka dengan menelaah data sekunder yang berupa bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Selain itu, penelitian ini mengkaji bagaimana konsep denda dalam implementasi ekspor dan impor dan mengkaji bagaimana pengenaan denda berdasarkan Undang-Undang Nomor 17 Tahun 2006 tentang Perubahan Atas Undang-Undang Kepabeanan Nomor 10 Tahun 1995, Peraturan Pemerintah Nomor 46 Tahun 2017 tentang Jenis dan Besaran Pajak Dalam Impor dan Cukai, dan Peraturan Bea Cukai No. PER-02/BC/2017 tentang Penerbitan, Pengelolaan dan Penggunaan Jaminan untuk Menjamin Barang Ekspor.

Abstract

This study examines the bioethical dilemma regarding the practice of euthanasia, focusing on the perspectives of law and international human rights. The study aims to answer how the discipline of bioethics views the practice of euthanasia in the context of international human rights and how the dilemma between patient autonomy and the principles of non-maleficence and beneficence is addressed within euthanasia legal policies. This research uses normative and descriptive analysis to reveal the ethical and legal implications of euthanasia, and presents policy recommendations to strengthen the protection of patient rights and medical ethics.

Abstract

Among the dramatic events of the Russo-Ukrainian War was the Siege of Mariupol in 2022, with the use of human shield tactics and resulting human casualties among civilian populations. This study will therefore assess the extent of human shielding the Ukrainian and Russian forces to ascertain the effects on the civilian population, and zero in on the legal implications under international humanitarian law. A descriptive qualitative research approach was used in this research, whereby information was obtained through wide-scale literature research, specifically reports by international bodies, educational material, and journalistic information by trusted sources. Both parties have done much to bring war closer to civilians and deny humanitarian groups access to them: deploying military infrastructure near residential areas and refusing access and evacuations. Like in most conflicts, civilians have accounted for most of the casualties; destroyed structures in cities or other critical parts were not spared, which has serious humanitarian effects. The study concludes that the use of human shield tactics in Mariupol involves grave violations of IHL and, in this respect, underlines an urgent need for strict adherence to legal norms in the protection of civilians during hostilities.

Abstract

The “Do Not Resuscitate” (DNR) order represents a critical ethical and legal directive within healthcare, providing patients the autonomy to decline cardiopulmonary resuscitation (CPR) at life’s end. This research examines the comparative legal frameworks and procedural implementations of DNR orders in Indonesia and the United Kingdom, highlighting the disparities and the impact on healthcare systems. Despite its recognition in Indonesia, DNR lacks specific legislation, influenced by cultural and religious perceptions that view end-of-life decisions as taboo. Conversely, the UK has established robust legal protocols under the NHS and the Mental Capacity Act 2005, ensuring DNR decisions align with patient rights and medical ethics. This study employs a qualitative comparative approach to analyze DNR policies, assessing the alignment of Indonesia’s practices with international standards and the UK’s structured approach. Through examining legal documents and health policies, this research proposes recommendations for Indonesia to enhance DNR regulatory frameworks, aiming to reconcile cultural sensitivities with the need for ethical clarity in medical decision-making. The findings suggest a pressing need for Indonesia to establish clear, culturally adapted DNR regulations to improve healthcare quality and respect for patient autonomy.

Abstract

Blockchain technology provides exceptional potential for the elimination of the inefficiencies and vulnerabilities in the land registry system in Indonesia. This paper therefore examines the incorporation of blockchain in land registration by use of a legal analysis, while studying the current framework and pointing out key challenges such as data privacy, reliabilities of smart contract enforcement, and liability in decentralized systems. It underlines the need for legal reforms in the amendment of existing land laws and harmonization with information technology regulations such as the ITE Law and the Law on the Operation of Electronic Systems. However, effective implementation enforces regulatory frameworks that respond to the various complexities introduced by blockchain technology in an efficient manner, at the same time offering legal certainty and protection to all the parties involved. Indonesia can modernize the part of its processes related to land registration by applying blockchain, which at some point could reduce fraud and increase public trust in the land records system.

Abstract

Indonesia is a maritime country. Indonesia has a significant workforce in fishing and maritime sectors work as crew members on foreign-flagged ship. However, Indonesia has not yet ratified the Internasional Labour Organization Convention No. 188 of 2017. This convention play crucial role in filling the legal gaps of ship crew member’s legal protection. ILO Convention 188 sets minimum standards for working conditions, wages, working hours, rest periods, living conditions, health and social insurance for crew members. Moreover, it does not require member states to adapt their domestic law. Thus, Indonesia has a strong legal basis to ratify ILO Convention 188.

Abstract

Insiden serangan siber terhadap Pusat Data Nasional Sementara yang mencakup data pribadi masyarakat dan berbagai kementrian berdampak pada timbulnya pelanggaran terhadap hak privasi subjek data pribadi. Hak privasi merupakan bagian dari Hak Asasi Manusia yang telah diatur dan diakui oleh Indonesia sebagaimana termaktub pada Pasal 28G ayat (1) dan Pasal 28H ayat (4) UUD 1945, dan oleh karenanya perlu untuk dijunjung tinggi, dihormati, dan ditegakkan. Penelitian ini bertujuan untuk menelaah perlindungan hukum apakah yang diakomodir oleh hukum positif Indonesia dalam kaitannya dengan perlindungan data pribadi, terutama terhadap insiden Pusat Data Nasional Sementara. Penelitian akan dilakukan dengan metode yuridis normatif, yaitu metode penelitian yang didasarkan pada kajian terhadap regulasi dan literatur hukum terkait (buku maupun jurnal). Secara sederhana, perlindungan data pribadi yang merupakan pengejawantahan dari hak privasi terhadap informasi dapat dilihat dan dipisahkan dalam 2 (dua) bagian besar, yaitu sebelum dan sesudah berlakunya Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi. Dalam hal ini, ketika insiden Pusat Data Nasional Sementara terjadi, Undang-Undang Perlindungan Data Pribadi belum berlaku secara keseluruhan. Maka dari itu penelitian ini akan menggali regulasi pada kedua masa tersebut, mengerucutkan terkait manakah regulasi yang berlaku dan dapat diimplementasikan, serta bagaimana regulasi tersebut melindungi kepentingan hukum subjek data pribadi.

Abstract

This research analyzes a fundamental academic problem in Indonesia's bankruptcy law lies in the tension between the spirit of business rescue through Suspension of Debt Payment Obligations (PKPU) and the rigidity of the "single settlement principle" which denies debtors a second chance. This study analyzes the role of debt restructuring in safeguarding Limited Liability Companies (LLCs) from insolvency under Law No. 37 of 2004. Using a normative juridical method with a descriptive-analytical approach, this research utilizes primary data from court decisions and secondary data from legal literature. This study finds that although PKPU is designed to protect debtors, the application of the single settlement principle in the UUK-PKPU limits debtors’ ability to recover, often favoring creditors with stronger bargaining positions. This creates a legal vulnerability where good-faith debtors are immediately bankrupted upon the failure of a reconciliation plan without further legal recourse. Therefore, a renegotiation mechanism should be allowed to give debtors the opportunity to preserve their businesses.
