Abstract

Kehadiran telemedicine membawa manfaat untuk memberikan pelayanan kesehatan secara luas bagi masyarakat dengan memanfaatkan teknologi informasi. Perwujudan telemedicine merupakan upaya pemerintah dalam mensejahterakan masyarakat di bidang kesehatan pada era society 5.0. Awalnya perkembangan telemedicine masih menggunakan teknologi telepon standar. Memasuki era milenium, teknologi kesehatan di Indonesia terlihat semakin berkembang dengan munculnya rekam medis dan peresepan elektronik yang dapat dilakukan melalui suatu aplikasi tanpa harus bertemu secara tatap muka (face to face) antara pasien dan tenaga medis. Penelitian dilakukan dengan metode yuridis normatif, yakni dengan meneliti data sekunder. Hasil penelitian menggambarkan bahwa kepastian hukum pelaksanaan layanan telemedicine telah terjamin legalitasnya sebagaimana termuat dalam Peraturan Menteri Kesehatan Nomor 20 Tahun 2019 tentang Penyelenggaraan Pelayanan Telemedicine Antar Fasilitas Pelayanan Kesehatan, hal tersebut membuktikan bahwa pemerintah sadar kesehatan menjadi tujuan penting dalam mewujudkan kesejahteraan masyarakat, sehingga diharuskan bagi negara untuk meningkatkan derajat kesehatan melalui pengembangan pelayanan fasilitas kesehatan. Pengembangan tersebut dapat terlihat dari inovasi telemedicine yang pada implementasinya bertujuan untuk memperluas aksesibilitas pelayanan kesehatan masyarakat. Layanan telemedicine antara Australia dengan Indonesia terdapat perbedaan yang kontras dari pendistribusian pelayanan hingga peraturan hukum. Berbeda dengan Indonesia, pelayanan Telemedicine di Australia bergantung pada panduan telehealth bukan peraturan pemerintah atau lembaga kedokteran.

Abstract

International sales contracts are agreement that govern the cross-border sales of goods. Given the complexities inherent in such transactions, the United Nations on Contract for the International Sales of Goods (CISG) serves as a preventive measure to reduce misinterpretation and legal dispute between the contracting parties. However, the CISG’s applicability as a default rule remains limited due to not being ratified by certain states. The objective of this research is to analyze how the CISG act as a default rule to fulfill the legal certainty of contracting, and analyze the foreseeing challenges of ratifying the CISG in Indonesia. The research type is normative with statutory approach. The concept of default rules offers a convenient legal framework for the international sales contract that is in the absence of law. This theoretical framework was then adopted by the CISG, which instigates the phenomenon of the sticky default rules, reduce transaction cost with a complete set of interpretation and gap-filling mechanism, and ensure the legal certainty of the contracting parties. However, the ratification of the CISG may face several challenges such as the compability of the domestic law, potential conflicts of domestic interest, and high cost of legislating. Despite these challenges, ratifying the CISG in Indonesia remains feasible and beneficial for the development of international contract law.

Abstract

Indonesia is a maritime country. Indonesia has a significant workforce in fishing and maritime sectors work as crew members on foreign-flagged ship. However, Indonesia has not yet ratified the Internasional Labour Organization Convention No. 188 of 2017. This convention play crucial role in filling the legal gaps of ship crew member’s legal protection. ILO Convention 188 sets minimum standards for working conditions, wages, working hours, rest periods, living conditions, health and social insurance for crew members. Moreover, it does not require member states to adapt their domestic law. Thus, Indonesia has a strong legal basis to ratify ILO Convention 188.
