Abstract

Penelitian ini bertujuan untuk mengetahui penerapan sharia compliance dalam pelaksanaan program pensiun dengan Akad Wakalah Bil Ujrah di Bank Muamalat cabang Magelang. Untuk mencapai tujuan pembahasan di atas, penelitian ini menggunakan penelitian deskriptif kualitatif. Untuk memperoleh data implementasi kepatuhan Syariah dalam pelaksanaan program pensiun akad Wakalah Bil Ujrah di Bank Muamalat cabang Magelang, peneliti menggunakan metode wawancara dan dokumentasi, serta observasi dari stakeholders. Hasil penelitian ini menunjukkan bahwa pelaksanaan program pensiun dengan akad Wakalah Bil Ujrah di Bank Muamalat telah sesuai dengan syariah, yaitu tunduk pada Fatwa DSNMUI No. 88/DSUI/XI/2013 tentang Penyelenggaraan Program Pensiun.Kata Kunci: Sharia Compliance; Program Pensiun; Wakalah Bil Ujrah

Abstract

The current needs system is no longer determined by real needs but has been regulated with the existence of commodity goods. Society's system of consumption changes rapidly to follow the system of needs so that the consumption of goods and services is no longer a necessity but a desire of every individual who is swept up in the consumptive world. Consumerism culture is considered a culture that must be attached to society in order to obtain an identity. Even though the Prophet Muhammad and his companions, preferred to give infaq fi sabilillah, even well waqf by Utsman Bin Affan, rather than simply consuming a commodity that was not useful and did not spend their wealth on something without benefit, especially for an impossible lifestyle, including using their wealth in moderation. This study uses the literary method to search for various literature sourced from journals and books that have to do with consumerism, consumption, and consumption behavior. The results of the study explain that consumerism which is based on the principles of utilitarianism and rationality alone, encourages consumers to maximize use value without regard to human values and even Islamic values, as a result, creates individualism and self-interest. There are at least 5 points that need to be implemented in Islamic offers in consumption behavior, including 1) Paying attention to priority scales in consuming a commodity, 2) Following Islamic norms in consumption behavior, 3) Maintaining Maqoshid Syariah with the aim of benefiting individuals and society, 4) Comply with the principles of halal and haram, 5) Consumption behavior is part of increasing worship.

Abstract

Conflict in the Islamic family is a problem that continues to occur in some Indonesian society in this modern era. Such as childfree adherents caused by psychological, philosophical and economic factors, pregnancy out of wedlock which has an impact on stress and depression due to shame, interfaith marriage which has implications for the disconnection of inheritance rights in Islamic law and religious choices for children later in life and early marriage which is vulnerable to mental health. Therefore, it is necessary to understand the concepts of sakinah and maslahah to be implemented in family life. This paper aims to provide solutions related to problems in the Islamic family in the modern era with the concept of sakinah M. QuraishShihab which the author then associated with the concept of Maslahah Imam al-Syatibi. The results of this study explain that the concept of sakinah M. QuraishShihab focuses on three aspects, including; aspects of equality, aspects of deliberation and aspects of awareness of meeting needs.  While the concept of maslahah Imam Syatibi with the hierarchy of maslahah by seeking the presence of shaleh and pious descendants (Dharuriyyah), seeking trade/business in the family (Hajiyyah) and providing halal food and drinks to the wider community (Tahsiniyyah).Konflik dalam keluarga Islam menjadi permasalahan yang terus terjadi di sebagian masyarakat Indonesia pada era modern ini. Seperti penganut childfree yang disebabkan oleh faktor psikologis, filosofis dan ekonomi, hamil diluar nikah yang berdampak pada stres dan depresi karena timbulnya rasa malu, pernikahan beda agama yang berimplikasi terputusnya hak waris dalam hukum islam dan pilihan agama bagi anak di kemudian hari serta pernikahan dini yang rentan terhadap kesehatan mental. Oleh karenanya perlu memahami konsep sakinah dan maslahah untuk diimplementasikan pada kehidupan keluarga. Tulisan ini bertujuan untuk memberikan solusi terkait problematika dalam keluarga Islam di era modern dengan konsep sakinah M. Quraish Shihab yang kemudian penulis kaitkan dengan Maslahah Imam al-Syatibi. Hasil penelitian ini menjelaskan bahwa konsep sakinah M. Quraish Shihab menitik beratkan pada tiga aspek, diantaranya; aspek kesetaraan, aspek musyawarah dan aspek kesadaran atas pemenuhan kebutuhan.  Sedangkan konsep maslahah Imam Syatibi dengan hierarki maslahahnya dengan mengupayakan hadirnya keturunan yang shaleh dan bertakwa (Dharuriyyah), mengusahakan perdagangan/perniagaan dalam keluarga (Hajiyyah) serta memberikan makanan dan minuman yang halal kepada masyarakat luas (Tahsiniyyah).

Abstract

This article examines the position of grandchildren as substitute heirs in the Islamic inheritance law system, with a focus on the provisions in the Compilation of Islamic Law (KHI) and the perspective of Imam Nawawi. This research aims to identify how the position of grandchildren as successor heirs is regulated in the two legal sources and compare their suitability. The method used is a literature study with qualitative analysis of Islamic legal texts and the works of Imam Nawawi. The research results show that although the KHI regulates the position of grandchildren as substitute heirs under certain conditions, there are differences in the interpretation put forward by Imam Nawawi regarding this matter.

Abstract

This study examines the beras kafarat tradition in Tebing Tinggi, Kerinci Regency, Jambi, Indonesia, highlighting its religious and social significance in death-related rituals using the al-‘urf approach within the scope of the contextualization of Shari'a, considering the limited Muslim population. This tradition serves as an atonement for the deceased who may have neglected religious obligations, fostering solidarity in the community and a sense of unity amidst the pressures of modernization. Using a qualitative approach, data were collected through interviews and observations, involving local residents and ninik mamak (community elders) for a deeper understanding. The findings reveal that the beras kafarat tradition is not only a religious act but also provides emotional comfort to grieving families, alleviating the social pressures they face after the death of a loved one. Furthermore, this study emphasizes the role of the younger generation in preserving this tradition, as their involvement is crucial for its continuity. Adapting traditional practices to suit the modern context without losing cultural and religious values is also important. Overall, the sustainability of the beras kafarat tradition relies on educational and communal efforts to preserve this cultural heritage. This study aims to enhance understanding of the interaction between tradition, religion, and social dynamics in Indonesian Muslim society and to encourage dialogue on the importance of preserving traditions amidst societal change.

Abstract

Purpose - Charismatic leadership is often regarded as a central leadership model in Islamic boarding schools (pesantren), especially due to the strong influence of the kyai as both religious and institutional leaders. However, the sustainability of teachers' organizational commitment in such institutions remains a challenge. This study aims to examine the direct influence of charismatic leadership on organizational commitment, as well as the mediating role of job satisfaction in this relationship. Methods - This research employed a quantitative survey method involving 566 educators from Pesantren Darunnajah Indonesia. Data were collected using validated instruments measuring charismatic leadership, job satisfaction, and organizational commitment. The data were analyzed using multiple regression analysis and the Baron and Kenny mediation test, supported by SPSS software. Findings - indicate that charismatic leadership significantly influences both job satisfaction and organizational commitment. Additionally, job satisfaction is found to mediate the relationship between charismatic leadership and organizational commitment. The level of charismatic leadership, job satisfaction, and organizational commitment among respondents was generally high. Implications/limitations: The findings provide empirical support for leadership development programs in pesantren that emphasize charismatic attributes such as vision, empathy, and personal influence. Originality/value: This study contributes to highlights the strategic role of the kyai not only as a religious figure but also as a professional leader within organizational frameworks.
