Abstract

Meningkatnya kasus judi online di Indonesia tidak hanya menimbulkan kekhawatiran sosial, tetapi juga menghadirkan tantangan hukum baru dalam menjamin prinsip due process of law, khususnya dalam perlindungan hak-hak tersangka. Lembaga Bantuan Hukum (LBH) Medan sebagai bagian dari masyarakat sipil memiliki peran strategis dalam memberikan pendampingan hukum kepada pelaku judi online, terutama mereka yang berasal dari kelompok rentan dan berpenghasilan rendah. Penelitian ini menggunakan metode yuridis empiris dengan teknik pengumpulan data melalui wawancara, studi dokumentasi, dan kajian literatur. Hasil penelitian menunjukkan bahwa LBH Medan memberikan pendampingan hukum sejak tahap penyelidikan, penuntutan, hingga persidangan, guna menjamin hak-hak tersangka seperti hak untuk membela diri, hak untuk tidak disiksa, dan hak atas perlakuan yang adil dalam proses peradilan pidana. Namun, dalam implementasinya masih ditemukan beberapa kendala, seperti keterbatasan jumlah advokat pro bono, minimnya pemahaman hukum dari pelaku, serta resistensi aparat penegak hukum terhadap keberadaan penasihat hukum. Berdasarkan temuan tersebut, penelitian ini merekomendasikan penguatan kapasitas kelembagaan LBH Medan, peningkatan litera si hukum bagi masyarakat, serta optimalisasi koordinasi antara LBH dan aparat penegak hukum guna memastikan perlindungan hak asasi setiap individu dalam perkara pidana, termasuk pelaku judi online.

Abstract

This study addresses the issue of low legal awareness among rural communities in Indonesia, particularly in Desa Sempajaya, Karo Regency, where residents have limited knowledge of their legal rights and access to free legal aid. The research aims to enhance community understanding of the role and function of Legal Aid Institutions (Lembaga Bantuan Hukum/LBH) as guaranteed by Law No. 16 of 2011 on Legal Aid. Using a Participatory Action Research (PAR) approach, the program was implemented through preparation, socialization, and evaluation stages. Activities included collaboration with local government and legal aid posts, interactive presentations, discussions, and dissemination of procedures for obtaining legal assistance. The findings reveal that prior to the intervention, most residents lacked awareness of legal aid mechanisms and perceived legal processes as costly and complex. After the socialization, participants demonstrated improved knowledge of their legal rights, the existence of LBH, and the steps required to access free legal services. The program also highlighted challenges such as limited literacy, time constraints, and skepticism toward legal institutions. Overall, the socialization effectively strengthened community legal awareness and provided a foundation for developing a legally conscious village

Abstract

This study investigates the legal protection and implementation of rights for pregnant women in detention at the Class IIA Women’s Correctional Facility in Medan, Indonesia. Although Indonesian correctional law and human rights instruments provide normative guarantees, their realization is constrained by structural and institutional challenges. Using an empirical juridical approach and qualitative case study design, data were collected through semi-structured interviews with key prison staff, direct observation, and analysis of relevant legal and policy documents, including the Directorate General of Corrections’ Basic Health Service Standards. Findings indicate that while basic healthcare, medical referrals, nutritional support, and partial psychosocial services are available, their effectiveness is limited by the absence of obstetric specialists, lack of dedicated housing for pregnant detainees, budget constraints, and insufficient continuous psychosocial support. This highlights a gap between formal legal guarantees and substantive protection, demonstrating that formal equality alone cannot address the differentiated needs of pregnant detainees. Policy recommendations include measurable operational standards, intersectoral integration with local healthcare services, gender- and human rights-based staff training, and performance-oriented evaluation. The study contributes to socio-legal scholarship by emphasizing that effective protection of vulnerable groups depends on both normative frameworks and institutional capacity oriented toward human-centered justice.
