Abstract

Unregistered marriage constitutes a legal issue that potentially threatens legal certainty regarding children’s identity rights in both Indonesia and Malaysia. This study aims to analyze the role of the state in guaranteeing legal certainty for the identity rights of children born from unregistered marriages, as well as to identify the similarities and differences in the legal regulations of the two countries. This research is a normative legal study employing statutory, conceptual, and comparative approaches. The primary legal materials in Indonesia include Law Number 1 of 1974 concerning Marriage, Law Number 24 of 2013 concerning Population Administration, the Compilation of Islamic Law, and the Constitutional Court Decision Number 46/PUU-VIII/2010. Meanwhile, the primary legal materials in Malaysia include the Islamic Family Law (Federal Territories) Act 1984 and the Births and Deaths Registration Act 1957. The findings indicate that Indonesia adopts a corrective-progressive approach through the mechanism of isbat nikah (marriage validation) and Constitutional Court Decision Number 46/PUU-VIII/2010, which allows the recognition of civil relations between a child and the biological father based on scientific evidence. In contrast, Malaysia applies a stricter preventive-institutional approach through the Islamic Family Law Act 1984 under the supervision of the Syariah Court. The similarities between the two countries lie in the obligation of marriage registration, the role of religious courts, and their adherence to the Convention on the Rights of the Child (CRC). The principal differences are found in the recognition of civil relations between children and biological fathers, the marriage registration system (centralized versus decentralized), the existence of criminal sanctions, and the orientation of child protection policies. This study recommends the harmonization of regulations based on the principle of the best interests of the child as the foundation for developing responsive Islamic family law policies oriented toward the protection of children’s rights

Abstract

The rounding of tobacco trade scales is a manifestation of the daily relationship between sellers and buyers during the tobacco season. As known, Islam mandates fair trade practices without any element of ambiguity, deception, usury, and the like. Buying and selling are social practices to meet livelihood needs. The tobacco trade practices in the Tlahab Village warehouse services are conducted directly, and transactions are based on mutual trust between the consumers and the merchants. However, upon re-weighing, it's found that the weight is less than the initial weight due to discrepancies between the agreed-upon terms at the beginning. The formulation of the problems based on this issue is: how is the practice of rounding in the reduction of tobacco trade scales carried out? What is the Islamic legal perspective on the practice of rounding in the reduction of tobacco trade scales in Tlahab Village, Kledung Sub-district?This research is a normative-empirical study employing a qualitative approach. Data were collected using primary and secondary sources through observation, interviews, and documentation. The collected data were analyzed using descriptive analysis methods. The results of this study show that, firstly, the practice of rounding in the reduction of tobacco trade scales in Tlahab Village is essentially conducted using the same contract as typical trade agreements. In this trade practice, communication between the seller and buyer is direct without intermediaries. Merchants make purchases as usual, and transactions are based on mutual trust between consumers and merchants. Secondly, the Islamic legal perspective on rounding in the reduction of tobacco trade scales indicates that this practice is not allowed because it only benefits the merchants, leading to ambiguity or gharar in tobacco weighing, thereby resulting in injustice to sellers or farmers.

Abstract

This study examines the Tebus Anak Kembar Pengantin tradition practiced in Kertosari Village, Jumo District, Temanggung Regency, from the perspectives of Islamic law and local custom (‘urf). Employing a qualitative approach with a socio-legal method, the research is based on field data collected through interviews, observation, and documentation involving community leaders, religious figures, and local residents. The findings reveal that the tradition is a form of living local wisdom rooted in Javanese culture, carried out through symbolic rituals such as family deliberation, collective prayers, the symbolic transfer of redemption money, and child caregiving by an adoptive family. Sociologically, the practice aims to strengthen kinship ties, maintain social harmony, and promote collective responsibility in child upbringing. From an Islamic legal perspective, the tradition is acceptable insofar as it is understood as kafālah (child guardianship) rather than a transaction involving the sale of a child, as it does not alter lineage (nasab) and emphasizes intentions oriented toward public benefit (maṣlaḥah). Within the framework of ‘urf, the tradition may be classified as ‘urf ṣaḥīḥ, provided that it does not contradict sharīʿah principles. However, the study also identifies challenges related to Indonesian positive law, particularly the absence of formal adoption procedures, which may result in legal uncertainty regarding the child’s status. Therefore, the study underscores the need for legal awareness and guidance to harmonize the preservation of local tradition with the principles of Islamic law and child protection

Abstract

This study examines the obligation of halal certification for food and beverage products produced by non-Muslim business actors in Kaloran District. The enactment of Law Number 33 of 2014 on Halal Product Assurance, as amended by Law Number 11 of 2020 on Job Creation, has transformed halal certification from a voluntary requirement into a mandatory legal obligation for all business actors, regardless of religious background. This policy aims to provide legal certainty and consumer protection, particularly for Muslim consumers who are religiously obliged to consume halal products. This research employs a qualitative approach with a normative-empirical method. Normative analysis is conducted through the examination of statutory regulations related to halal certification, while empirical data are obtained through field observations and interviews with non-Muslim food and beverage business actors in Kaloran District. The study reveals a significant gap between legal norms (das sollen) and their practical implementation (das sein). Most non-Muslim business actors have not yet obtained halal certification, and some are unaware of the mandatory nature of this obligation. Limited socialization, lack of administrative guidance, and perceptions of lengthy certification procedures are identified as the main obstacles to compliance. The findings indicate that the primary challenge in implementing mandatory halal certification does not lie in the legal framework itself but in its execution at the local level. Therefore, this study emphasizes the need for more effective socialization, institutional assistance, and simplified administrative procedures to ensure the effective enforcement of halal certification obligations. Strengthening these aspects is essential to achieving the objectives of consumer protection, legal certainty, and the development of Indonesia’s halal industry

Abstract

This study examines the strategies employed by motorcycle enthusiasts in maintaining family harmony amid the challenges of modern lifestyles. Motorcycle-related activities such as vehicle modification, touring, and participation in enthusiast communities often require significant time and financial resources, which may potentially generate tension within the household. This research aims to analyze family practices among motorcycle enthusiasts, the strategies they employ to balance hobbies and domestic responsibilities, and the role of wives in supporting and regulating these activities. This study adopts a qualitative research design with a case study approach conducted in Temanggung. Data were collected through in-depth interviews, observation, and documentation, and were analyzed using Miles and Huberman’s interactive data analysis model.The findings indicate that motorcycle-related hobbies do not necessarily have a negative impact on family life. Motorcycle enthusiasts implement various strategies, including open and effective communication with their spouses, careful financial planning, balanced time management, and the internalization of religious values in everyday life. The role of wives is particularly significant in providing emotional support, managing household finances, and reminding their husbands to maintain equilibrium between personal hobbies and family obligations. As a result, families of motorcycle enthusiasts are able to sustain household harmony while pursuing personal interests, thereby embodying the concept of a sakinah family.
