Abstract

Kebiasaan adalah salah satu sumber hukum perdagangan internasional, dan dalam metodologi hukum Islam kebiasaan diistilahkan dengan ‘urf, adalah sebagai dalil/sumber hukumnya. Kebiasaan (‘urf) dalam pandangan metodologi hukum Islam ini dapat berlaku dalam hukum perdagangan internasional, mesti memenuhi kriteria-kriteria tertentu, dan sejalan dengan Nash (al-Quran dan Sunnah). Kebiasaan (‘urf) ini sendiri merupakan bagian dari natural-karektaristik yang hidup dalam masyarakat dunia, ia terbentuk secara sengaja maupun tidak sengaja dan alami. Sehingga kebiasaan itu tidak bisa dihilangkan atau didiskualifikasi, dan bahkan semakin mejadi trand masyarakat kontemporer, seperti perdagangan internasional secara online (e-commerce). Islam sebagai agama universal, dinamis, cocok untuk setiap waktu dan tempat, mengatur kebiasaan tersebut secara komprehensif.

Abstract

Dalam sebuah penelitian ilmiah, dibutukan adanya suatu kajian pustaka (literature review). Sebuah kajian pustaka dianggap penting karena digunakan sebagai landasan dalam penyusunan laporan penelitian dan merupakan langkah pencegahan terhadap adanya duplikasi dari sebuah penelitian. Literatur dapat diperoleh dengan menerapkan beberapa cara seperti membaca, memahami, menelaah, mengkritik atau mereview literatur yang diperoleh dari sumber-sumber tertentu. Melakukan analisa, sintesis, membuat ringkasan, membandingkan antara hasil-hasil penelitian, serta membuat kajian pustaka merupakan beberapa hal penting yang dapat dilakukan oleh seorang peneliti untuk bisa menemukan tujuan dan menguraikan proses terjadinya penelitan tersebut. Adanya penerapan kajian pustaka di dalam sebuah penelitian ilmiah adalah agar bisa tercapai hasil penelitian yang berkualitas. Tulisan ini menerapakan metode deskriptif kualitatif berjenis penelitian berupa studi kepustakaan (library research) yakni mengumpulkan informasi ataupun karya tulis ilmiah yang memiliki hubungan dengan literature review yang bersifat kepustakaan. Penelitian deskriptif dan kualitatif yang dikombinasikan kemudian disebut juga sebagai penelitian deskriptif kualitatif. Tujuan utama dari adanya penelitian ini adalah agar pembaca dapat memahami pentingnya penerapan literature review pada penelitian ilmiah secara komprehensif. Dapat disimpulkan bahwa keberadaan kajian pustaka menjadi sangat penting karena digunakan sebagai landasan serta mempertegas ide dari seorang peneliti. Umumnya, pustaka yang dikaji haruslah pustaka yang berasal dari sumber aslinya. Penelti dan kajian pustaka adalah sebuah kesinambungan yang terus berhubungan. Ini dikarenakan kajian pustaka merupakan rangkaian konsep, definisi, dan proposisi yang dipergunakan demi mengamati suatu peristiwa secara sistematik dengan cara melakukan spesifikasi hubungan antara variabel utama penelitian yang menyebabkan fenomena yang sedang menjadi objek penelitian dapat dijelaskan atau diramalkan

Abstract

Baitul Mal wat Tamwil (BMT) is a sharia microfinance institution that is conceptually held for non-profit muslims. In collecting funds and channeling based on sharia principles, the problems are resolved in the religious court. Judging from the aspect of economic justice, it is not very different from other financial institutions, only the BMT management target dives more on the potential of zakat, infaq and sedeqah that favor the helpless dhu'afa to be empowered, from consumptive to productive and having resilience with populist based financial management and amaliyah value.

Abstract

Agricultural goods transactions with toke (in Bahasa is known as a traditional market agent) always carry a weight cutting of one to 2 kilograms per bag. Risk reduction is considered a burden to be borne. Therefore, how to study the law in the aspect of risk imposition when transactions occur between plantation farmers and toke in traditional markets. The aim of this research was to examine how weighing is carried out and the recognition of the weight of agricultural products on scales is associated with possible risks that will occur in the future. This research method was qualitative, field research. Data sources were garden sellers/farmers and toke in traditional markets. Data collection through interviews and examination of artifacts. Data analysis technique was qualitative descriptive. The research finding showed that when the agricultural harvest was sold, there was a scale cut of around 2 kg per bag, such as chilies, ginger, corn and so on. The result of reducing the scale in dealing with the risks that will occur with irregular goods. The risk was borne by the farmer/seller, this was suspected and endangers the continuity of the relationship between farmer, toke, retailer towards objects that change naturally. Cutting the weight of the scales was still permitted as long as it was within appropriate limits. Recommendations for cutting the weight of the scales when changing goods and not fixed goods.

Abstract

The rapid digital transformation in entrepreneurship has significantly influenced Islamic economic practices, particularly e-commerce. However, there is a lack of research focusing on methods to enforce e-commerce legitimacy in Islamic entrepreneurship. This study employs a qualitative library research approach with descriptive-analytical, conceptual, and philosophical methodologies. Secondary data is drawn from classical and contemporary fiqh muamalah texts, academic research, and digital resources. The data is analyzed systematically and normatively to explore key principles and methods for enforcing e-commerce legitimacy. The findings reveal six core principles essential for ensuring legitimacy in e-commerce: (1) mutual benefits for all parties, (2) mutual consent in transactions, (3) transparency in product and service information, (4) justice in avoiding any form of oppression, (5) excellent customer service, and (6) ethical behavior in business activities. These principles ensure compliance with Sharia and foster trust and fairness in digital marketplaces. The study concludes that enforcing e-commerce legitimacy principles is critical for addressing challenges in digital transactions and aligning them with Islamic entrepreneurial ethics. This contributes to prosperity (falah) for both sellers and buyers in worldly and spiritual contexts. Future research should focus on developing practical frameworks for applying these principles across various e-commerce platforms to enhance sustainability and compliance in the Islamic digital economy.Keywords: Digital Transformation, Islamic Entrepreneurship, E-Commerce Legitimacy, Sharia Compliance, Marketplace Ethics

Abstract

The rapid advancement of science, information technology, computers, and the internet has brought about significant changes that have greatly benefited human life. However, along with these advancements, new legal issues have emerged, particularly in the field of muamalah, specifically electronic commerce involving computer and internet technologies. This research explored the importance of collective (jama'i) ijtihad methods in the modern era. A normative legal approach was applied to ascertain the new legal arguments regarding the formulation of contemporary fiqh through the ijtihad jama’i method. This method plays a crucial role in shaping Islamic law to effectively address these emerging problems by involving experts in Islamic law, economics, information and communication technology, and other relevant fields. The results showed that ijtihad jama’i are more robust, closer to the truth, and help avoid conflicts than individual ijtihad.
