Abstract

As a soil-living organism, soil mite presence is important for ensuring the sustainable land. Intensive management practices in forest land drive a change in its community structure. A field study was conducted in Wanagama Education and Research Forest I, Gunungkidul District, Yogyakarta Special Region Province, Indonesia, to assess the role and impact of the different forest management practices on the soil mite community. Soil samples from 15 representative soil sites were taken from the agroforestry, mixed-forest, and pioneer community forest. Collected individuals from August to October 2021 were taken by Berlese-Tullgenn Funnel and identified to morphospecies level. A total of 758 individuals of soil mites were recorded during the study period. Out of these, 21 individuals from agroforestry, 288 individuals from mixed-forest, and 449 individuals from pioneer community forest. Results of the study revealed the occurrence of 3 taxa from 36 morphospecies of oribatid mites occurred in the areas. The Shannon diversity indices of oribatid mites were 1.831, 1.424, and 0.867 in mixed-forest, agroforestry, and pioneer community, respectively. The similarity indices showed there was a similar diversity in agroforestry and mixed-forest, either in pioneer community. Through one-way ANOVA analysis, we stated that differences between of three management practices significantly affected soil mites, especially oribatida rather than prostigmata and mesostigmata.

Abstract

Pernikahan adalah pertemuan dua insan yang terikat oleh tanggung jawab yang besar, masing masing memiliki hak dan kewajiban. Wali nikah adalah salah satu rukun pernikahan, wali nikah adalah orang yang mempunyai kuasa atau hak untuk melaksanakan akad pernikahan bagi mempelai wanita serta menikahkannya dengan seorang pria. Seorang wali dalam pernikahan akan melangsungkan akad nikah yaitu mengucapkan Ijab dan mempelai pria akan akan mengucapkan Qobul. Sedangkan wali hakim adalah wali yang menggantikan kedudukan wali nikah dari nasab yang ditunjuk langsung oleh Kantor Urusan Agama. untuk mengajukan permohonan wali hakim ada beberapa pertimbangan dan tahap yang harus dilalui. Untuk lokasi penelitian adalah Kantor Urusan Agama Kecamatan Sumbersari Kabupaten Jember. Tujuan dari penelitian ini adalah memberi wawasan bagi masyarakat terkait apa pertimbangan yang harus diperhatikan untuk persetujuan pernikahan dengan wali hakim. Penelitian ini dengan pendekatan kualitatif dengan model studi kasus. Hasil dari penelitian ini adalah(1) rukun dan syarat wali dalam pernikahan sebagai berikut; beragama Islam, baligh, berakal sehat atau tidak gila, laki-laki, adil, tidak sedang ihram haji dan umrah. (2) gambaran pernikahan dengan wali hakim dengan mengajukan permohonan dengan membawa seluruh persyaratan pernikahan dan berkas-berkas lainnya dari Kelurahan dan Pengadilan Agama. (3) pertimbangan pada pernikahan dengan wali hakim yang bisa diterima atau disetujui oleh Kantor Urusan Agama ada tiga, yaitu; tidak adanya wali atau semua yang berhak menjadi wali sudah meninggal, wali enggan menikahkan, wali tidak ada yang beragama Islam. Marriage is a meeting of two people who are bound by great responsibilities, each has rights and obligations. A marriage guardian is one of the pillars of marriage, a marriage guardian is a person who has the power or right to carry out a marriage contract for the bride and marry her to a man. A guardian in marriage will carry out the marriage contract, namely thinking about Ijab and the groom will think about Qobul. While the judge's guardian is a guardian who replaces the position of marriage guardian from the lineage who is appointed directly by the Office of Religious Affairs. To apply for a guardian judge there are several considerations and stages that must be passed. The research location is the Office of Religious Affairs, Sumbersari District, Jember Regency. The purpose of this study is to provide insight for the community regarding what considerations must be considered for consent to marriage with a judge's guardian. This research uses a qualitative approach with a case study model. The results of this study are (1) the pillars and conditions for guardianship in marriage are as follows; Muslim, mature, sane or not crazy, male, fair, not currently in ihram for Hajj and Umrah. (2) description of marriage with a judge's guardian by submitting an application by bringing all marriage requirements and other documents from the Kelurahan and Religious Courts. (3) There are three considerations for marriage with a judge's guardian that can be accepted or approved by the Office of Religious Affairs, namely; there is no guardian or all those entitled to become guardians have died, guardians are reluctant to marry off, none of the guardians are Muslims

Abstract

Fenomena penyimpangan seksual semakin marak terjadi di masyarakat dengan bentuk yang semakin beragam seperti LGBT, Pedophilia, Frotteurisme, Incest Ekshibionisme, Masturbasi, Voyeurisme, bahkan tidak sedikit diantaranya berujung pada perzinaan, dan pemerkosaan. Banyak masyarakat dan pejabat pemerintahan yang menganggap sepele dan acuh terhadap fenomena ini. Padahal pejabat pemerintahan memiliki peran yang sangat penting ditengah masyarakat dalam mencegah dan menjaga masyarakat dari fenomena ini. Diatara pemerintahan yang memiliki peran penting adalah penyuluh agama di setiap KUA. Penelitian ini membahas tentang peran penyuluh agama dalam mencegah dan menjaga keluarga muslim dari penyimpangan seksual. Jenis penelitian ini menggunakan metode penilitian lapangan. Dalam penelitian ini terdapat dua sumber data, yaitu data primer dan sekunder. Tujuan Penelitian ini adalah memberikan penjelasan tentang pentingnya peran penyuluh agama dalam mencegah dan menjaga keluarga muslim dari penyimpangan seksual yang tersebar di masyarakat. The phenomenon of sexual deviance is increasingly prevalent in society with increasingly diverse forms such as LGBT,Pedophilia, Frotteurisme, Incest, Ekshibionisme, Masturbasi, Voyeurisme, not a few of which even lead to adultery and rape. Many people and government officials consider this phenomenon trivial and indifferent. Precisely government officials have an important role in the midst of society in preventing and protecting society from this phenomenon. Among the government officials who have an important role are religious counselors at each KUA. this researchdiscusses the role of religious instructors in preventing and protecting Muslim families from sexual deviation.

Abstract

The enforcement of zina law in Islamic law and positive law in Indonesia shows significant differences in the definition, application of sanctions, and legal process. This difference creates a misalignment between society's expectation of a strict application of sharia norms and the more lenient rules of positive law. In Islamic law, adultery is a serious offense with strict sanctions such as stoning or flogging, while Indonesian positive law only provides minor criminal penalties for perpetrators who are bound by marriage, and often does not provide the deterrent effect expected by society. This research aims to criticize the judges' decisions in handling adultery cases and propose solutions through harmonization of Islamic law and positive law, based on the principle of Maqasid al-Syariah. This research approach uses qualitative research, reviewing literature with literature studies. Normative and comparative analysis is conducted to understand the discrepancies and their implications for the protection of the rights of children out of wedlock, which in Islamic law is often not recognized as the status of the biological father, but is recognized in positive law. The results show that harmonization between the two legal systems is necessary to bridge this discrepancy and provide substantive justice for children of adultery. The implementation of Maqasid al-Syariah is expected to protect children's rights while strengthening sanctions against perpetrators, thus meeting the expectations of social justice without ignoring the basic values in Islamic law.
