Abstract

The Iddah phenomenon is a contemporary issue in which the essence of the Iddah period for women experiences certain problems, including the prohibition of women during their Iddah period from accepting proposals or getting married, lack of understanding of the determination of the Iddah period, gender inequality issues, and conflicting understandings of law and calculation of the Iddah period. Consequently, the use of ultrasound during the Iddah period has become a topic of discussion. This article discusses the contextualization of Islamic law that seeks to place illat and wisdom at the center of cases involving the use of ultrasound during the Iddah period to determine the cleanliness of a woman's uterus, so that the existence of illat becomes the basis for legal istinbat, which then gives birth to wisdom. The research method employed is qualitative with literature review, which attempts to establish a connection between the relevant literature and the article's discussion. This study's findings identify the use of ultrasound during the Iddah period as a criterion for the existence of illat and the wisdom that underlies its legal determination. Therefore, the existence of ultrasonography (USG) during the Iddah period based on a theological approach cannot be used as a benchmark (illat) for uterine hygiene for women and does not affect the essence of the wisdom contained therein, including for matters that are clear and certain that are used to establish and determine whether or not a law exists.

Abstract

Divorce can be done by anyone who has been married including Civil Servants. The main point of this research is the Implementation of Government Regulation No. 45 of 1990 concerning Divorce Permits for Civil Servants (PNS) in Maros Class 1B Religious Court. This study aims to determine the extent of implementation/application of Government Regulation Number 45 of 1990 concerning divorce licenses for civil servants in the Maros Religious Court. The type of research used is Qualitative Field Research with descriptive methods and sociological approaches. The results showed that the Maros Religious Court class IB has implemented the mandate of Government Regulation number 45 of 1990 concerning divorce permits for civil servants in the Maros Religious Court class IB in terms of providing services. Because every civil servant who wants to carry out a divorce first gets permission from the superior.

Abstract

The high prevalence of child marriage in Indonesia has become a pressing issue, not only at the national but also at the global level. Preventive efforts require a collaborative and multi-faceted approach that goes beyond legal regulations and incorporates social, psychological, spiritual dimensions, as well as marriage guidance. This article aims to explore a collaborative psychosocial-spiritual governance model that integrates marriage guidance in the prevention of child marriage in Indonesia. This research was conducted using an exploratory qualitative approach in Jombok Village, Trenggalek, East Java, and Woro Village, Rembang, Central Java. Data was collected through in-depth interviews with various stakeholders including government officials, religious leaders, local psychologists and cultural figures, local activists, NGOs, as well as couples/families experiencing child marriage. The research results indicate that social innovation for preventing child marriage is implemented through the principles of collaborative governance based on a psychosocial-spiritual approach, with multi-level involvement from villages, sub-districts, to districts. Education, mentoring, and marriage counseling programs are carried out in stages, encompassing social assistance based on child protection, psychological support, and strengthening religious values. This approach demonstrates that effective prevention strategies are not only focused on formal regulations but also on value transformation, community capacity building, and creating an ecosystem that supports children's rights. The overall efforts aim at preventing child marriage in a more holistic, inclusive, gender-just manner, and contextualized with the local values of Indonesian society.
