Abstract

This research discusses the rights and protection of children in the aspect of self-identity by combining the perspectives of hadith and legislation in force in Indonesia. It aims to investigate how Islamic teachings through the Prophet's hadiths can synergize or conflict with existing legal provisions in protecting children's identity rights. This research is a qualitative research with descriptive-analytic method, which includes the analysis of thematic hadiths and the study of legislation governing the rights and protection of children. The results of this study indicate that from the aspects of the hadith and the law show continuity in which both are in line with what is outlined in article 5 of Law no. 23 of 2002 reinforced by Article 27 of Law no. 23 of 2002 and detailed by the existence of the Minister of Home Affairs regulation No. 73 of 2022 article 1 paragraph 3 and article 4 paragraph 2 that this name is used as an identity and has become a child's right. This is also certainly discussed in the scope of Islam through the Prophet's hadith. which is contained in the hadith narrated by Bukhari, Daud, Imam Ahmad, ad-Darimi, An-Nasai, and al-Bazzar regarding the right of children to be named with the best name without any elements of ugliness. Both have the same principle in determining the rules for giving a good name to a child as a manifestation of the laws that oversee the right to child protection.

Abstract

Kebijakan sentralisasi telah menjadi fokus utama dalam perdebatan kebijakan publik, terutama dalam konteks pendidikan tinggi khususnya dalam konteks Perguruan Tinggi Keagamaan Islam Negeri (PTKIN). Diberlakukannya kebijakan sentralisasi disebabkan oleh adanya Peraturan Menteri Agama (PMA) No. 68 Tahun 2015. Dampak yang ditimbulkan dari sentralisasi ini cukup kompleks dan beragam yang melibatkan PTKIN mengalami perubahan yang drastis dalam pengelolaan kelembagaannya.. Penelitian ini merupakan penelitian kualitatif dengan pendekatan deskriptif-analitik. Dalam pengumpulan data penulis menggunakan studi kepustakaan dengan menelaah berbagai sumber tertulis yang membahas terkait dengan otonomi Perguruan Tinggi, kebijakan sentralisasi serta PMA No.68 Tahun 2015 dengan teknik analisis data yang digunakan ialah pendekatan analisis kebijakan. Hasil penelitian ini menunjukkan bahwa munculnya kebijakan sentralisasi melalui PMA No.68/2015 dilatarbelakangi dengan adanya orientasi politis dimana lembaga pendidikan tidak lagi mengambil keputusan secara legal-netral atau menyesuaikan dengan lingkungan pendidikan. Dari permasalahan tersebut berdampak juga pada aspek lain yakni keterbatasan otonomi lokal, kurangnya inisiasi, inovasi dan kreativitas, lambatnya merespons perubahan yang terjadi, adanya ketegangan internal, serta pesepsi publik yang negatif. Dengan banyaknya dampak negatif yang ditimbulkan maka perlu adanya rekonstuksi kebijakan dengan mempertimbangkan tingkat otonomi yang tepat, mengembangkan sisitem monitoring dan evaluasi, proses sentralisasi yang tidak menghambat pengembangan lembaga, memperkuat mekanisme kolaborasi, serta meningkatkan efisiensi birokrasi.

Abstract

The existence of the sanad in a hadith occupies a crucial position. This is because a hadith is said to be authentic if the line of transmission and the transmitter (narrator) are free from defects. The narrators here become one of the the influential ones in bringing the hadith to a high degree by looking based on intellectual andbehavioral credibility. Intellectuality is a measurable aspects, but every hadith scholar has varied criteria and methods in determining the credibility of a narrator. Imam Ahmad, as one of the leading scholars in the tradition of hadith, has a structured approach in assessing narrators who narrate traditions that are the basis of religious teachings. This article discusses and reviews in detail how Imam Ahmad ibn Hanbal assesses the intellectual credibility of hadith narrators. This research uses a qualitative method with an analytical descriptive approach and data collection techniques in the form of library research. The results of this study found that the methodology used by Imam Ahmad bin Hanbal reflects wisdom, justice and balance in assessing the credibility of narrators. The method used by Imam Ahmad covers various aspects including the testimony of scholars, the compatibility of the narration with the narration of other reliable narrators, and the assessment based on the frequency of the narrator’s mistakes as well as the emphasis on written records and strong memorization also characterize Imam Ahmad’s methodology. This article provides an in-depth insight into Imam Ahmad’s approach in assessing the intellectual credibility of hadith narrators and serves as areference in the future development of evaluation in the study of hadith narration.

Abstract

This study aims to explore the position of As-Sunnah as proof in Islam and its relevance to the Quran in forming a solid religious foundation for Muslims. This research is a qualitative study with a descriptive-analytic approach to collecting and analyzing data. To support this research, researchers used data from various written sources, including books, articles, journals, and other reliable sources. The research findings show that As-Sunnah has an equal position with the Quran as proof in Islam. Both complement each other and enrich the understanding of Islam. The Quran is the main foundation of law while the As-Sunnah is a practical and concrete interpreter of the teachings of the Quran. The relevance of the functions of the Quran and As-Sunnah in the lives of Muslims is very important and has a broad impact in various aspects of life. First, Al-Quran and As-Sunnah provide moral and ethical guidelines for Muslims. Second, in Islam, the Quran and As-Sunnah occupy a central position as a legal foundation. Third, the relevance of the function of the Quran and As-Sunnah is also seen in the construction of Muslim religious identity. Fourth, authority in Muslim society is rooted in the Quran and As-Sunnah. Fifth, the relevance of the function of both is also seen in the character building of Muslim society and politics. Sixth, forming morality and social norms in Muslim society. This research also discusses the position of As-Sunnah in contemporary issues such as conceptual and functional challenges. Conceptual challenges include the development of thoughts that contradict the validity of As-Sunnah. Functional challenges include the application of As-Sunnah in contemporary social, cultural and political contexts.

Abstract

Ulumul Hadis is a fundamental discipline within Islamic studies and serves as a core course at State Islamic Higer Education Institutions (PTKIN), including UIN Sunan Kalijaga Yogyakarta. Despite its importance, the course is often perceived as difficult and less appealing to students. This study aims to examine the perception level of students in the Early Childhood Islamic Education (PIAUD) program toward the Ulumul Hadis course and to identify the internal dan external factors influencing it. The study employed a quantitative approach with an explanatory design, involving 73 second-semester students ffrom a total population of 89. Data were collected through questionnaires and analyzed using descriptive statistics and multiple linear regression. The findings indicate that students generally hold a positive perception of the Ulumul Hadis course, with an average score of 19,589 out of a maximum of 25,00. Regression analysis revealed that internal factors such as motivation and prior understanding were more dominant (B=2,236) than external ones (B=1,673). These findings suggest that students’ internal readiness plays a crucial role in shaping positive perceptions. This study contributes to curriculum development and instructional strategies, particularly in aligning Islamic studies content with the context of early childhood education.

Abstract

K.H. Aceng Zakaria became one of the prominent Indonesian ulama as well as Persis who continued to revive the writing tradition, including those related to the study of hadith. In this study, it will be discussed related to the method of understanding the hadith of K.H. Aceng Zakaria through his work, al-Hidāyah fī Masāil Fiqhiyyah Muta'āriḍah. The results of this study indicate that in the method of understanding hadith, K.H. Aceng Zakaria is very concerned about linguistic aspects and the use of uṣul rules in every understanding. Several things can be seen when K.H. Aceng Zakaria explains a hadith. First, understand the hadith according to the instructions of the Qur'anic verse. Second, understand the hadith based on other hadiths. Third, understand the hadith based on its terminology. The terminology can be seen from several expressions, namely expressions that are clear and do not contain other meanings, common lafaz expressions, expressions that contain several meanings (musytarak), and expressions that are concluded in general, deductive and analogical. Fourth, in the resolution of the conflicting hadith in this case K.H. Aceng Zakaria uses one of several methods, namely Jam’u, tarjih, Nasikh, and tawaqquf. Fifth, understanding the hadith based on historical facts, namely understanding the hadith by looking at the cause of the hadith (asbab al-wurūd).
