Abstract

Penelitian ini bertujuan untuk mengetahui Bagaimana penerapan sanksi terhadap pelaku perniagaan penyu dalam perkara Nomor 27/Pid.B/LH/2023/PN lbo serta Bagaimana pertimbangan Hakim dalam menjatuhkan pidana Terhadap pelaku tindak pidana perniagaan penyu. Dalam penelitian ini, peneliti menggunakan metode penelitian empiris. Metode penelitian ini memberikan gambaran mengenai fakta-fakta yang ada (empiris) serta analisis yang akurat mengenai peraturan perundang-undangan yang berlaku di hubungkan dengan teori-teori hukum dan praktik dari pelaksanaan aturan hukum yang ada. Hasil dari penelitian ini menunjukkan bahwa Penerapan Sanksi Pidana Terhadap Pelaku Perdagangan Penyu Dalam Perkara Nomor 467/Pid.Sus/2014/PN.Pdg Pada putusan ini, USMAN NDIU sebagai terdakwa didakwa oleh Jaksa Penuntut Umum dipidana penjara selama 6 (enam) bulan dengan masa percobaan selama 1 (satu) tahun dan denda sebanyak Rp1.000,000 (satu juta rupiah) subsidair 1 (satu) bulan kurungan. Jaksa Penuntut Umum juga menuntut terdakwa untuk membayar biaya perkara sebesar Rp2.000,00 (dua ribu rupiah) serta Pertimbangan Hakim dalam Menjatuhkan Pidana Terhadap Pelaku Tindak Pidana Perdagang Penyu Pada Perkara Nomor 27/ Pid. B/LH/2023/PN.lbo dan Perkara Nomor 10/Pid.B/LH/2023/PN lbo Pertimbangan Hakim yang bersifat non yuridi Pertimbangan non yuridis adalah pertimbangan hakim yang didasarkan pada keadaan yang tidak diatur dalam aturan perundang-undangan, namun keadaan tersebut baik melekat pada diri pelaku tindak pidana maupun berkaitan dengan masalah-masalah sosial dan struktur masyarakat.

Abstract

This study aims to analyze legal protection for female workers who are laid off (PHK) and to find solutions to obstacles in providing legal protection for female workers who are laid off (PHK). The methodology used in this study is normative legal research, while the research approach used is a legislative approach where the relevant laws and decrees are sought and studied, and other decisions related to the legal issues being studied are matched by discussing thoughts and lessons or teachings in the field of law, and matching the formulation of the problem based on cases in the world of work related to the material being discussed. The results of the study indicate that various legal instruments, both national and international, have regulated protection for female workers, especially in situations of layoffs. Law No. 13 of 2003 concerning Manpower and the Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) which has been ratified by Law No. 7 of 1984 have provided a clear legal basis regarding the prohibition of layoffs against women on the grounds of pregnancy, childbirth, or marriage. In addition, compensation and industrial dispute resolution are also regulated to ensure that the rights of female workers are protected. However, there are still gaps in the implementation of this legal protection, especially related to the lack of knowledge of workers regarding their rights and the uneven implementation of policies in various industrial sectors. Implementation obstacles in regulating the legal protection of female workers, namely work agreements that are not in accordance with regulations, the lack of general sanctions, and workers' ignorance of their rights are obstacles. The state needs to integrate international conventions into national law and ensure that violators receive appropriate sanctions. Many female workers are not yet fully aware of their rights, which hinders effective protection.

Abstract

Tujuan dari Peneltian ini ialah untuk memastikan bagaimana prosedur pembuktian pidana untuk kasus pelecehan seksual beroperasi di kampus. Menentukan hambatan terhadap proses pembuktian pidana dalam situasi tindak asusila yang umum terjadi di wilayah kampus ialah tujuan lainnya. Peneltian ini memakai teknik Riset hukum empiris yang berasal dari perilaku manusia, termasuk perilaku aktual yang diamati lewat pengamatan langsung dan perilaku verbal yang diperoleh dari wawancara. Temuan studi ini menunjukkan bahwa, meskipun ada undang-undang yang menentang tindak asusila, stigma, kurangnya pengetahuan terkait hukum, dan ketidakberdayaan korban sering kali menyulitkan penegakan hukum ini di area perguruan tinggi. Lebih jauh lagi, banyak kasus tidak dilaporkan karena kekhawatiran akan dampak sosial dan akademisnya. Riset ini merekomendasikan perlunya peningkatan edukasi hukum, penyediaan saluran pelaporan yang aman, serta keterlibatan aktif pihak kampus dalam menciptakan area yang bebas dari tindak asusila

Abstract

This study analyzes the application of chemical castration as a form of punishment for perpetrators of sexual crimes against children in Indonesia's positive legal system, as well as its relation to human rights principles. Chemical castration is regulated in Government Regulation No. 70 of 2020 as an additional punishment to suppress the sexual urges of perpetrators, but it has sparked controversy regarding violations of the right to bodily integrity and the potential for cruelty that is contrary to the constitution and international conventions. This study uses a normative legal research method with a descriptive qualitative approach to examine regulations, court decisions, and the views of various parties such as Komnas HAM, IDI, and international human rights institutions. The results of the study show that chemical castration has not been proven effective in preventing repeat offenses and focuses more on the theory of revenge than rehabilitation. In addition, there are more humane alternatives, such as a therapy program in Germany that emphasizes a rehabilitative approach and the protection of the rights of both perpetrators and victims. This study recommends a review of the chemical castration policy policy to bring it in line with the values of justice, humanity, and the supremacy of human rights in Indonesia.
