Abstract

This study aims to determine the rights of early childhood in the constitutional system in Indonesia. This type of research is library research with a normative legal approach using data collection methods through a search of literature related to problems, laws and regulations, interviews and other references as research support. As for the results of this research, in principle the state through the government has made good efforts starting from the establishment of state institutions in Indonesia that are specifically engaged in protecting children, then formulating rules in fulfilling and guaranteeing children's rights in Indonesia, then protecting children are also accommodated in Law number 39 of 1999 concerning Human Rights articles 52 to article 66. In Indonesian Laws and Regulations, in principle, children's rights are guaranteed in them, including the rights of early childhood, early childhood gets special attention because holistic-integrative development is an effort to realize Indonesian children who are healthy, intelligent, cheerful and have noble character, while one of the indicators causing the loss of children's rights includes the crime of child exploitation.

Abstract

The decision of the Central Jakarta District Court Number 757/Pdt.G/2022/PN/Jkt.Pst in the case between the Prima Party and the General Election Commission (KPU) is a civil dispute that should only bind the parties involved. However, this ruling has significant implications as it orders the KPU to halt the 2024 election stages, which contradicts constitutional principles and democracy. In civil law, courts do not have the authority to issue decisions with broad legal consequences, especially those affecting election processes. This study employs normative legal research with a case and statutory approach. The findings indicate that this decision not only contradicts existing legal provisions but also violates the absolute competence of the District Court within Indonesia’s judicial system.[Putusan Pengadilan Negeri Jakarta Pusat Nomor 757/Pdt.G/2022/PN/Jkt.Pst dalam perkara antara Partai Prima dan Komisi Pemilihan Umum (KPU) merupakan sengketa perdata yang seharusnya hanya mengikat para pihak yang terlibat. Namun, putusan ini menimbulkan implikasi yang luas karena memerintahkan KPU untuk menghentikan tahapan Pemilu 2024, yang bertentangan dengan konstitusi dan prinsip demokrasi. Dalam sistem hukum perdata, pengadilan tidak memiliki kewenangan untuk mengeluarkan putusan yang berdampak luas, terutama terhadap penyelenggaraan pemilu. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan kasus dan perundang-undangan. Hasil penelitian menunjukkan bahwa putusan ini tidak hanya bertentangan dengan ketentuan hukum yang berlaku, tetapi juga melanggar kompetensi absolut Pengadilan Negeri dalam sistem peradilan di Indonesia.]
