Abstract

Undang-Undang No. 1 tahun 2004 tentang perbendaharaan negaramembuka koridor bagi penerapananggaran berbasis kinerja dilingkungan pemerintah. Dengan pasal 68 dan pasal 69 dari undangundangtersebut, instansi pemerintah yang tugas pokok danfungsinya memberi pelayanan kepada masyarakatdapatmenerapkan pola pengelolaan keuangan yang fleksibeldengan menonjolkan produktifitas, efisiensi danefektifitas. Instansidemikian, dengan sebutan umum sebagai badan layanan umum(BLU). Tulisan ini bertujuan untuk menguraikan tingkatpemahaman para pengelola IAIN Sulthan Thaha Saifuddin Jambiatas konsep pembentukan BLU, terutama berkaitan isu peningkatankualitas pelayanan publik, transparansi dan akuntabilitaspengelolaan keuangan negara; dan juga untuk mengetahuipemahaman dan kesiapannya, serta kesulitan-kesulitan, hambatandan harapan mereka terhadap BLU. Metode penelitian yangdigunakan adalahstudi pustaka dan penelitian lapangan. Datadikumpulkan melalui kuesioner yang diberikan kepada pararesponden yang dipilih berdasarkan kelompok BLU.

Abstract

Indonesian constitution no. 1 year of 2004 about the state treasury that can open the new corridor for the performance-based budgeting application in government circumtances. The article 68 and article 69 of the constitutionsassert that the government instance have the main duty and function to serves the public society. It also able to applythe flexible budgeting managent pattern by accentuated the productivity, efficiency, and effectivity in a form of thePublic Services agency (BLU). BLU is expected as the real image of performance-based budgeting managementapplication. IAIN Sulthan Thaha Saifuddin has been a BLU since November 23rd 2009. In performance of BLU, IAINSulthan Thaha Saifuddin experiences the change of budgeting systems, Organization structure, and organizationperformance achievement. This research tried to know the evaluation of BLU in IAIN STS by using Balanced Scorecard.The Application of BSC based on 4 perspectives, encompases the monetary perspectives, consumer perspectives,internal bussiness perspectives,and learning and developing perspectives. The evaluation of BLU is proposed toknow the effort of public services quality improvement, transparancy and accountability of government budget managementin IAIN Sulthan Thaha Saifuddin. The approach of this research is qualitative describtive and the methodealso use the qualitative methode. While, the data collecting use the questionaire to the BLU group-based respondents.The result of the research shows the work of Public Service Agency in IAIN Sultan Thaha Saifuddin Jambi is alreadywork effectively but it still need to be improved, especially the implementation of Standard Operational Procedure(SOP) and the minimal standard of services / Standar Pelayanan Minimal (SPM) in order to expected to be prominentconcrete examples of the application of financial management based on the results (performance).

Abstract

This study aims to determine the rights of early childhood in the constitutional system in Indonesia. This type of research is library research with a normative legal approach using data collection methods through a search of literature related to problems, laws and regulations, interviews and other references as research support. As for the results of this research, in principle the state through the government has made good efforts starting from the establishment of state institutions in Indonesia that are specifically engaged in protecting children, then formulating rules in fulfilling and guaranteeing children's rights in Indonesia, then protecting children are also accommodated in Law number 39 of 1999 concerning Human Rights articles 52 to article 66. In Indonesian Laws and Regulations, in principle, children's rights are guaranteed in them, including the rights of early childhood, early childhood gets special attention because holistic-integrative development is an effort to realize Indonesian children who are healthy, intelligent, cheerful and have noble character, while one of the indicators causing the loss of children's rights includes the crime of child exploitation.

Abstract

There are 29 of the 57 women running for the 2020 simultaneous regional elections who are the wives of previous regional heads. Thus, in the fourth episode of the simultaneous regional elections, the same problems as the previous simultaneous regional elections, namely the pragmatism of political parties in recruitment, ultimately fostered political dynasties at the local level. The political dynasty model which makes the wife the regional head has developed in several regions with the same pattern, namely that all of them are wives where the husband is the regional head who has served for two consecutive terms. The practice of administering government is likened to the joint power of husband and wife, passed down from generation to generation as if it were a family institution or private institution. This phenomenological type qualitative research aims to find out what is the main purpose of nominating his wife in the regional head election after her husband's period of service is over? and in what route does the wife become a candidate for regional head so that a political dynasty is formed? The results of this academic research show that in the process of forming a political dynasty by design, in the third stage, the wife is promoted to the regional head candidacy, with the main aim of maintaining power and wealth. Novelty: the strength of masculinity in government means that wives are exploited to maintain power and wealth in the formation of political dynasties.

Abstract

The efforts of the Ministry of Administrative and Bureaucratic Reform to simplify the bureaucracy by changing structural positions into functional positions aim to create an agile, professional and dynamic bureaucratic environment that will increase the effectiveness and efficiency of government performance in providing public services. ASN and the organization need to make a number of modifications when implemented. The purpose of this paper is to document how the adoption of bureaucratic streamlining has affected the career development of ASN who have switched professions. Civil servants who transfer administrators from Echelon III and supervisors from Echelon IV to functional positions become the subject of writing. Descriptive analysis is used in the qualitative research methodology throughout the orientation and exploration phases, with an emphasis on a literature review approach adopted from official news websites, academic journals, and other sources deemed relevant used to compile information findings from a compilation of literature related to Resource Management. Human Resources (MSDM). In the structure of the PANRB Ministry over the past year, the implementation of the transition from structural positions to functional positions has not directly affected ASN career growth. The reason is that the ASN and the PANRB Ministry organizations still need to overcome a number of difficulties related to change. However, not all career growth patterns for functional jobs are available, although general ASN career development patterns are intended to be created. Organizational structure is another factor that counts for career advancement in functional roles. This factor is expected to have an impact on improving ASN careers at the Ministry of Administrative and Bureaucratic Reform in the future.

Abstract

Under Law Number 24 of 2003, the Constitutional Court of Indonesia issues three types of decisions: inadmissibility, acceptance, and rejection. Over time, the Court introduced additional categories, including conditional constitutional and conditional unconstitutional decisions. As legal disputes have become increasingly complex, the Court has also issued ultra petita rulings, granting decisions beyond the scope of the petitioner's request. This research examines the evolution of justice theories and their relevance to the ultra petita decisions in judicial review cases. Using a normative legal research approach with conceptual and case-based methodologies, this research analyzes legislative texts, books, journals, and research reports through qualitative descriptive techniques. The findings reveal varying philosophical perspectives on justice: Plato views justice as intrinsic harmony, Aristotle differentiates between general and specific (proportional) justice, and John Rawls emphasizes fairness through the "original position" and "veil of ignorance." The ultra petita ruling in Case 90/PUU-XXI/2023 altered the presidential and vice-presidential age requirement by adding the qualification of previously holding an elected regional position. Meanwhile, Case 60/PUU-XXII/2024 redefined the regional head nomination threshold, setting aside the 20% DPRD seat or 25% vote requirement. Both decisions reflect procedural and substantive justice, ensuring fair outcomes. However, to prevent judicial overreach and uphold legal certainty, clear regulations on the Constitutional Court’s authority in issuing ultra petita decisions are essential..

Abstract

Open elections, which allow voters to directly choose presidential candidates, have become increasingly effective with the presence of political volunteers who utilize social media and online platforms to facilitate interaction between the presidential candidates and voters. This study aims to analyze how digital technology can serve as a powerful tool for political volunteers to enhance electability in open elections. The object of this research is the 2024 presidential contest, using secondary data sources from various relevant references. This study employs a qualitative descriptive approach, emphasizing the collection and analysis of secondary data obtained from academic literature, government reports, credible news outlets, and official websites related to the 2024 presidential election. The method focuses on interpreting patterns, narratives, and digital strategies used by political volunteers to improve candidate visibility and voter engagement. Content analysis was also used to examine how digital platforms were utilized as campaign tools during the electoral process. Academic findings indicate that during the 2024 presidential election, digital technology used by political volunteers significantly strengthened the relationship between candidates and voters through online campaigns. The presence of digital technology facilitated various aspects of open elections, such as improving communication during campaigns and increasing public participation—all aimed at boosting electability. Electability has become a crucial requirement for candidacy and eventual victory.
