Abstract

Indonesia encounters a multitude of obstacles in enhancing investment and fostering economic progress. Despite the significant potential of investment markets, inadequate investment regulation has emerged as a significant obstacle to achieving sustainable economic growth. The government is addressing this challenge by implementing the Omnibus Law, which seeks to streamline rules and foster an environment conducive to investment. Nevertheless, the execution of this Omnibus Law is encountering several hindrances, including discrepancies in regulations between the central and regional authorities, as well as a wide range of public responses. The study seeks to analyze the obstacles to investment policy in Indonesia and its influence on economic growth. This study employs a normative jurisprudence approach, which entails examining the provisions of the relevant legislation about capital investments and the Omnibus Law. This approach also encompasses the examination of literature and other legal materials to have a full understanding of the diverse pertinent legal facets. This normative jurisprudential approach will aid in detecting legal ambiguity, intricate bureaucracy, and diverse regulatory obstacles that impact the investment environment in Indonesia. Furthermore, the study will assess the efficacy of the Omnibus Law in streamlining rules and promoting investment. The findings of this study indicate that the primary barriers to more investment in Indonesia are the presence of legal ambiguity and a complex bureaucratic system. While the Omnibus Law holds promise for improving the investment climate, its successful implementation necessitates increased openness and public involvement. It is advisable for the Indonesian government to improve coordination between the central and regional authorities, and to engage several stakeholders in the process of policy-making. These steps are anticipated to decrease ambiguity and enhance investor assurance, hence stimulating sustainable economic expansion.

Abstract

Tujuan dari penelitian ini adalah untuk memberikan keadilan kepada anak, khususnya dalam penjatuhan sanksi bagi mereka yang terlibat dalam pelanggaran hukum. Keadilan tersebut diukur dengan mempertimbangkan kepentingan terbaik anak. Namun, dalam praktiknya, terdapat kesenjangan di mana pidana penjara lebih sering digunakan daripada alternatif lain. Profesor Acmad Ali dalam bukunya "Menguak Tabir Hukum" menjelaskan bahwa penyelesaian perkara hukum terakhir dilakukan melalui pranata pengadilan melalui putusan hakim. Putusan tersebut hanya mempertimbangkan unsur-unsur delik dari dakwaan, tanpa memperhatikan secara mendalam kepentingan terbaik anak. Sebagai contoh, dalam kasus anak, pidana penjara cenderung lebih banyak dijatuhkan daripada alternatif lainnya. Padahal, pidana penjara seharusnya merupakan opsi terakhir, terutama jika pelanggaran yang dilakukan anak tidak serius dan tidak menimbulkan dampak besar bagi masyarakat. Permasalahan yang dibahas meliputi analisis mengenai penjatuhan sanksi pelatihan kerja untuk mewujudkan asas kepentingan terbaik untuk anak, serta seperti apa rasio legislatif seharusnya mengoptimalkan sistem tersebut sesuai dengan UU Nomor 11 Tahun 2012 tentang Sistem Peradilan Pidana Anak. Metode penelitian yang digunakan adalah yuridis normatif, dengan mengacu pada berbagai sumber hukum seperti undang-undang, buku, dan data dari internet serta wawancara dengan Hakim Anak. Hasil penelitian mengatakan bahwa dalam penjatuhan sanksi untuk anak, hakim seharusnya lebih memperhatikan kepentingan masa depan anak. Tindakan tersebut tidak hanya mempertimbangkan kepastian hukum, tetapi juga keadilan bagi korban, anak, dan masyarakat secara keseluruhan. Terutama untuk tindak pidana ringan, seperti pencurian biasa atau tawuran tanpa korban jiwa, sanksi yang bersifat pembinaan dan pendidikan seperti pelatihan kerja seharusnya lebih diutamakan daripada pidana penjara untuk menghindari stigma yang merugikan bagi anak

Abstract

Government Goods and Services Provider Contract is a type of contract that is routinely carried out by the Government to meet various needs in organizing government activities. Transactions for the procurement of goods and services, namely the Ministry of Tourism and Creative Economy. The research method used is normative research using a statutory, conceptual and field approach. The results of the study are that the work contract between the commitment-making official and the goods and services provider at the Ministry of Tourism and Creative Economy still finds contract clauses that are not fully implemented and not understood by both parties. The impacts that will occur if the contract is not fully implemented and not understood by both parties include triggering contract disputes, even a greater impact is an indication of corruption because the source of funds for the procurement of goods and services is from the APBN. The purpose of this study is to provide education to both parties that the work contract is a guideline that must be understood and obeyed like the law. The ideal concept of direct procurement work contracts in the Ministry of Tourism and Creative Economy includes strengthening the role of APIP in the procurement of goods and services through direct procurement methods through audits, evaluations, reviews, monitoring and other supervision, the creation of standard contracts by including the substance of clauses that generally occur, and the use of sectoral e-catalogs provided by LKPP.

Abstract

Energy is an essential requirement for civilisation, and due to the rapid expansion of the population in Indonesia, energy consumption has also experienced a substantial rise. Hence, it is crucial to utilise and enhance the capacity of sustainable energy resources present across the archipelago, including geothermal, hydropower, wind, bioenergy (including bioethanol, biodiesel, and biomass), ocean current energy, nuclear, and solar energy. Indonesia's energy strategy is currently focused on the use of renewable energy to decrease carbon emissions. This is backed by legislation that promotes the development of renewable energy programs under the National Energy strategy. This article evaluates the regulatory factors associated with the advancement of new renewable energy and its influence on the establishment of sustainable energy infrastructure in Indonesia. This research provides a comprehensive legal analysis of the changing regulations surrounding renewable energy. It examines how these regulations affect the establishment of sustainable energy infrastructure and investigates the current legal consequences. The study aims to understand how the regulatory framework can either support or impede the progress of renewable energy development. This research offers valuable insights on the role of legislation in facilitating the shift towards sustainable energy sources in Indonesia. It also sheds light on the potential obstacles and advantages that may arise during this transition.
