Abstract

The development of aviation market in Southeast Asia after the Covid-19 pandemic is promising. More aircraft are delivered to the Asia-Pacific region, including the Association of South East Asian Nations (ASEAN) Member States. The introduction of ASEAN Open Skies (also known as ASEAN Single Aviation Market) a decade earlier together with ASEAN Economic Community Blueprint 2025 goals for an integrated and cohesive regional economy highlight the importance of a seamless air connectivity. Liberalisation of the airline industry in ASEAN Member States is crucial to restart the airline industry pre-pandemic and to grasp the so-called Asian century momentum. However, ASEAN Member States are reluctant towards liberalisation efforts, maintaining protectionism on both freedoms of the air (traffic rights) as well as foreign direct investment (ownership and control). Existing legal framework at regional level, namely ASEAN Framework Agreement on Services (AFAS) and ASEAN Trade in Services Agreement (ATISA), only received lukewarm attention from ASEAN Member States. This article discusses the urgency to recall the commitment of a gradual liberalisation based on AFAS and ATISA among the ASEAN Member States, the implementation of which will lead to the establishment of a regional community carrier which benefits ASEAN citizens.

Abstract

In 2018, the Indonesian government issued Presidential Instruction No. 8 of 2018 re. suspension and evaluation of palm oil plantation permits and boosting of its productivity (Moratorium policy).  This article is written as a critique, using a legal-dogmatic approach, directed towards this policy. It is noted that there exists uncertainty about which license, from the web of existing and relevant permits-licenses, are going to be suspended and evaluated. This legal uncertainty in the final analysis hampers the effort to make Indonesia prosperous as aspired by the 1945 Constitution (Art. 33).

Abstract

Abstract

Palm oil plantation businesses have always been the subject of heavy scrutiny and are accused of causing the most environmental and social mishaps in Indonesia. Such condemnation comes from within the country and outside as well. Even though the palm oil industry is one of Indonesia’s biggest GDP contributors, the opposition in the past decade outweighs the support, and many attempts at reasoning fall on deaf ears. This article will argue that the need for transformation of the industry in order to support the nations’ sustainability development goals is an effort that involves all constituents. The relationship that is built upon the palm oil companies and its stakeholders must be met with certain legalities and support from the government in order to foster a green growth relationship that will sustain the economy and the environment, which will ultimately support Indonesia’s sustainable development goals.

Abstract

Provisions regarding applications for clemency were previously regulated in Law No. 5 of 2010, then annulled by the Constitutional Court and returned to the norm, which does not provide a time limit for applications for clemency. As a result, for death row inmates, the implementation of court decisions or executions must wait for the convict's request for clemency. The problem that will be studied in this paper is whether the Constitutional Court's decision has implications for hampering law enforcement at the execution stage and resulting in disruption of the element of legal certainty. The research was conducted using a normative juridical research approach with secondary data, which was obtained from library research. If data analysis is described in the form of sentence descriptions and analyzed qualitatively, then a conclusion will be drawn. Based on the research results, it is known that the implication in the execution stage that arises is that there are endless attempts to delay execution, giving rise to uncertainty. The prosecutor, as the executor, experienced difficulties in carrying out the execution of the convict. This delay reduces the deterrent effect on law enforcement. Legal certainty must still be part of the objectives of the law, not just paying attention to justice and benefit alone. Thus, it is still necessary to calculate a reasonable time regarding the deadline for executing the death penalty, especially when the convict or his heirs do not submit a request for clemency.

Abstract

Freedom of opinion in Indonesia, constitutionally guaranteed as a human right, faces challenges in the digital era due to the ambiguous enforcement of the ITE Law, which initially targeted cybercrimes but expanded to regulate online speech, risking democratic expression. This study analyzes the ITE Law’s evolution (2008–2024) to assess its impact on freedom of expression in digital democracy, focusing on legal shifts and enforcement practices. Using normative juridical research, the study examines secondary legal materials through qualitative analysis, including legislation, court decisions, and scholarly works. The 2024 revisions reduce penalties and limit complaints to directly affected individuals, aiming to curb repression. However, ambiguities persist in defamation provisions, and enforcement biases threaten free speech. The study underscores the need for clearer legal standards, digital literacy programs, and alternative dispute mechanisms to align the ITE Law with democratic principles. Future research should explore comparative models and the law’s societal impact post-revision.

Abstract
