Abstract

Changes in the paradigm of punishment fromretributive justice which is punitive or retaliatory to theperpetrators of criminal acts into a paradigm of restorativejustice or restorative justice is a settlement of cases that placesmore emphasis on aspects of recovery or improvement of theconsequences arising from the criminal acts that occurred, sothat it is expected to provide justice for all parties withoutreleasing the perpetrator's responsibility. To maximize theapplication of restorative justice in the handling of criminalcases, the Indonesia National Police have issued IndonesiaNational Police Regulation Number 8 of 2021 concerningHandling of Crimes Based on Restorative Justice, as a legal basisand guideline in resolving cases based on restorative justice.However, in reality, restorative justice still cannot beimplemented optimally, one of which is due to the lack ofknowledge and understanding of Indonesia National Polrimembers regarding the substance of Indonesia NationalRegulation Number 8 of 2021. The targets of this communityservice activity in the form of legal counseling are members ofthe Indonesia National Police serving at the Pasar Rebo SectorPolice, East Jakarta City Metro Police, and Regional PoliceMetro Jaya. The method of community service activities throughdirect legal counseling, which in its implementation consists ofthe preparation stage, the activity implementation stage, theevaluation stage, and the reporting stage. The results of thiscommunity service activity are, First, the implementation ofcommunity service activities in the form of legal counselingregarding Indonesia National Police Regulation Number 8 of2021 runs in an orderly and smooth manner from the beginningto the end of the activity without any significant obstacles andobstacles; Second, this community service activity has increasedthe knowledge and understanding of members of the Pasar ReboSector Police regarding the handling of criminal acts based onrestorative justice so that they can become provisions in carryingout their duties in the field.

Abstract

The Indonesia National Police as a state tool in the field of publicsecurity and order has the duty and authority in order to maintainpublic security and order, including the holding of footballcompetitions where today there are often riots between footballsuppoter caused by excessive fanaticism that can cause securitydisturbances and casualties. To overcome fan riots, the IndonesiaNational Police has issued Indonesia National Police RegulationNumber 10 of 2022 concerning Security for the Implementationof Sports Competitions, as a guideline for members of theIndonesia National Police in carrying out security duties to runsafely, orderly and smoothly, but in fact the provisions in thePolice Regulation are not yet known and understood by membersof the National Police serving in the sector police. The targets ofthis community service activity are members of the IndonesiaNational Police who serve in Ciracas Sector Police, East JakartaMetro Police, Metro Jaya Regional Police. The implementationof community service activities consists of the preparation stage,implementation stage, evaluation stage, and reporting the resultsof the activity output. The results of this community serviceactivity, first, that the activity runs in an orderly and smoothmanner from beginning to end in accordance with the plan thathas been made by the Implementation Team, second, this activityhas increased the knowledge and understanding of members ofthe Ciracas Sector Police, East Jakarta Metro Police, Metro JayaRegional Police regarding the substance of Indonesia NationalPolice Regulation Number 10 of 2022 concerning Security for theImplementation of Sports Competitions.

Abstract

Indonesia merupakan negara hukum, yang dimana segala tindakan atau perbuatan yang dilakukan oleh tiap individu atau kelompok telah di atur dalam peraturan perundang-undangan. Konsepsi Negara Hukum atau Rechtsstaat tercantum di dalam Penjelasan Undang-Undang Dasar 1945, dirumuskan dengan tegas dalam Pasal 1 ayat (3) yang menyatakan bahwa negara Indonesia adalah Negara Hukum. Indonesia merupakan negara yang memiliki keanekaragaman suku dan budaya serta kepercayaan yang berbeda-beda namun tetap harus satu tujuan, saling menghormati dan mentoleransi disetiap perbedaan yang ada. Dalam sekelompok masyarakat Betawi di Bekasi terdapat adat istiadat yang dinamakan Uang Pelangkah. Uang pelangkah merupakan uang atau barang yang diberikan adik kepada kakaknya untuk menikah terlebih dahulu, uang pelangkah merupakan adat istiadat yang dipercaya secara turun temurun dari zaman dahulu hingga saat ini. Masyarakat percaya bahwa uang pelangkah merupakan penolak musibah dan sebagai penghormatan bagi seorang kakak yang akan dilangkahi oleh adiknya, masyarakat percaya bahwa apabila seorang adik tidak memberikan uang pelangkah saat akan melangkahi kakaknya untuk menikah maka, seorang kakaknya akan mendapatkan jodoh dalam waktu yang sangat lama dan keluarganya akan mendapatkan musibah. Maka uang pelangkah sudah menjadi kebiasaann masyarakat Adat Betawi. Tujuan dalam penulisan ini adalah untuk mengetahui adat istiadat Betawi yaitu uang pelangkah dalam prespektif Hukum Adat dan Hukum Islam dan bertujuan untuk mengetahui bagaimana penerapan Teori Receptio A Contrario dalam kaitannya dengan Uang Pelangkah. Penulisan ini dibuat guna mempermudah pengembangan ilmu hukum dan budaya khususnya uang pelangkah dalam adat istiadat Betawi dalam perspektif Hukum Adat dan Hukum Islam. Diharapkan dapat menjadi bahan masukan bagi para praktisi hukum dan masyarakat khususnya mengenai adat istiadat uang pelangkah. Metode yang penulis buat dalam penelitian ini berupa normatif-empiris yaitu menggabungkan antara hukum normatif yang kemudian didukung dengan penambahan data atau unsur empiris.

Abstract

In the Balinese Customary Law, there are types of traditional offenses relating to decency, one of which is the offense of lokika sanggraha which is a customary rule that is fundamental in society, constituting a limitation on sexual life. In this customary regulation the act of promiscuity between young men and women, even though it is done with the reason of mutual love and love. In general, any violation of customary law, both civil and criminal, will be resolved by local settlers. The formulation of the problem regarding the implementation of enforcement of immoral acts of lokika sanggraha in traditional courts and general courts and the constraints of enforcement of the immoral crime of lokika sanggraha in traditional courts and general courts. This research, using the method of normative legal research (literature) is supported by interviewees to get the results of the analysis that the implementation of the enforcement of immoral acts of lokika sanggraha in traditional court has not paid attention to the victims of immoral acts and for the general court by applying Article 359 of the Adi Gama Book jo. Article 5 paragraph (3) letter (b) Emergency Law. No. 1 / Drt / 1951 to be convicted. There are several obstacles in the implementation of law enforcement for the lokika sanggraha criminal act namely there is no specific regulation regarding the conduct of the lokika sanggraha and a lack of public legal awareness and the existence of a culture that considers family disgrace if other communities know that their daughter is pregnant outside marriage. The conclusion in this thesis is that law enforcement has not yet been created against the crime of lokika sanggraha because there are obstacles in law enforcement. Suggestions in this thesis are to the Leaders and Indigenous leaders in Bali if in completing the meeting the Sanggraha can consider women as victims of immoral acts and be able to hold men to account.

Abstract

Social media, also known as social networks, is part of new media. It's clear that the interactive content in new media is very high. Social media, quoted from Wikipedia, is defined as an online media, where users can easily participate, share, and create content including blogs, social networks, wikis, forums, and virtual worlds. Blogs, social networks, and wikis are the most common forms of social media used by people around the world. Social media has a significant influence on societal changes regarding their personalities. The purpose of this research is to determine the implementation of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Electronic Information and Transactions, the application of sanctions for social media users who harm others. This research study is normative juridical in nature as the main approach, considering that the discussion is based on legislation and legal principles applicable to issues of information technology crimes. The juridical approach is intended to conduct an assessment of the legal field, especially criminal law. Most social media users who intend to harm others in their use of social media will be ensnared by Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 on Electronic Information and Transactions (ITE Law), whether intentional or unintentional. The law should provide protection to internet users by thinking positively, having good intentions, and taking decisive action against cybercrime perpetrators. However, the legal system has not yet addressed all computer crimes through the Internet. The ITE Law is expected to provide guidelines in restricting the use of social media for the public.Top of Form

Abstract

The purpose of this writing is to provide an explanation of the Baduy and Citorek customs, each of which has many unique cultural values and local wisdom in Indonesia. The Baduy people live in the interior of Banten, and the Sundanese people live in the mountains of Garut. Further study on the characteristics and benefits of each tradition. The Baduy customs are known for their principles of simple living and environmental conservation, while Citorek is famous for its terraced farming that is still practiced to this day. Although they come from various places, they share traditions and noble values that have been passed down from generation to generation. The study of Baduy and Citorek customs offers many lessons about Indonesia's cultural diversity and the importance of preserving heritage for future generations. By learning more about the characteristics of Baduy and Citorek, we can also see how the local community preserves their culture despite the advancing world. This shows that preserving original traditions and culture is very important in facing challenges in the modern era. Local wisdom, which is an important part of the identity of the Indonesian nation, can also be appreciated and absorbed by us. As a result, cultural wisdom such as the Baduy and Citorek customs must continue to be encouraged and supported so that future generations can enjoy their values and the richness of their traditions. A better understanding of local culture helps us appreciate the importance of preserving diversity as part of a rich and varied national identity. Indonesian culture has the ability to evolve and become a valuable heritage for future generations.

Abstract

The Republic of Indonesia is a state of law (rechtstaats), so anyone who commits a crime must be held accountable for their actions through the legal process. Law enforcement implies that a crime is an act that is prohibited by a rule of law, where the prohibition is accompanied by a threat (sanction) in the form of a certain criminal penalty as its responsibility. The concept of a state of law is one that truly upholds human rights and guarantees citizens with their positions in law and government without exception, while to guarantee obedience and compliance with the law is in the hands of all citizens. Authentic deed in English (authentic deed), in Dutch (authentieke akte van), the philosophical basis that an authentic deed is found in: Legal considerations of Law No. 2 of 2014 concerning amendments to Law No. 30 of 2004 concerning the Position of Notary and regulated in Article 1868 of the Civil Code (Civil Code) which states that "A deed made in the form determined by law by or before a public official authorized for that purpose at the place where the deed was made", meaning that if we examine the definition more deeply, there are elements of an authentic deed, namely: 1) Made in a certain form. 2) Before an official authorized for that purpose. 3) The place where the deed was made.

Abstract

Permainan judi online semakin marak di Indonesia. Hal ini merupakan salah satu kasus aduan yang sulit diberantas di Indonesia. Perjudian online ini disebabkan oleh kemajuan teknologi yang sangat canggih, tekanan sosial ekonomi, dan peran media social sebagai platform iklan. Perjudian tidak hanya dilakukan oleh pria dewasa, tetapi juga anak-anak, remaja dan perempuan pun juga terlibat. Masyarakat menganggap hal yang lumrah ataupun menjadi kebiasaan disaat mengisi kekosongan waktu mereka. Namun demikian, perjudian tetap merupakan tindakan melanggar hukum yang merugikan individu dan masyarakat secara keseluruhan, untuk itu masih diperlukan upaya akan bahayanya perjudian online. Dijelaskan bahwa konsep anak remaja merupakan era perubahan yang dilalui dari masa kanak- kanak menuju dewasa. Maka dari itu di masa pubertas anak-anak remaja mesti diberi edukasi akan kesadaran dampaknya perjudian online tersebut. Sasaran kegiatan pengabdian kepada masyarakat dalam bentuk penyuluhan ini adalah kalangan remaja yang bersekolah di SMA Negeri 81 Jakarta, Kelurahan Cipinang Melayu, Kecamatan Makasar, Kota Jakarta Timur. Pelaksanaan kegiatan pengabdian kepada masyarakat ini secara garis besar terdiri dari tahap persiapan, tahap pelaksanaan, tahap evaluasi, dan tahap pelaporan hasil Iuran kegiatan. Hasil kegiatan pengabdian kepada masyarakat ini, pertama bahwa kegiatan berjalan dengan lancar yang dihadiri oleh kalangan pelajar di Lingkungan sekolah SMA Negeri 81 Jakarta dengan antusias. Kedua bahwa kegiatan telah meningkatkan pengetahuan dan pemahaman kepada anak remaja tentang upaya penaggulangan judi online di kalangan pelajar.

Abstract

The definition of a state is a territory with a sovereign government, governed by law, and having a permanent population. Every resident living within a state is obligated to obey the laws established in that state. This is especially true in Indonesia as a state based on the rule of law, as asserted in the 1945 Constitution (UUD 1945) Article 1 paragraph (3): “The State of Indonesia is a state based on law.” However, even though Indonesia is a state of law, in reality, law enforcement in the country remains very weak. This is exacerbated by numerous public perceptions and negative assumptions resulting from failed legal implementation, such as the widespread belief that “the law is sharp downward but blunt upward.” In society and state life, the law should be the commander in every aspect of life, aiming to create justice, maintain order, and protect individual rights. But what does justice truly mean in Indonesia? Is justice as simple as 1+1 = 2 or 2+2 = 4? If justice is defined that way, then the lower class should feel the same fairness as the upper class, particularly when it comes to legal matters. The term “lower class” here refers to marginalized groups who face various forms of injustice, including limited access to the judiciary, poverty, legal illiteracy, and many others. In light of this, this paper will discuss the problems and the concept of legal aid as a right and obligation that must be guaranteed for the poor. The fact remains that currently, poor communities still struggle to access legal aid due to their difficult economic conditions, which often remain unaccommodated.

Abstract

The Unitary State of Indonesia consists of diverse ethnic groups and customary laws, governed under a sovereign legal framework to ensure the proper enforcement of regulations. As stipulated in Article 1 paragraph (3) of the 1945 Constitution of the Republic of Indonesia (UUD 1945), “The State of Indonesia is a state based on law,” emphasizing that every individual who commits a criminal act must be held accountable according to applicable laws. However, various legal challenges continue to arise, especially amid rapid modernization and technological advancement, leading to new forms of criminal acts previously unknown, such as document forgery involving authentic deeds. An authentic deed is an official document prepared by or before a competent public official, serving as strong and binding evidence in legal proceedings as stated in Article 1870 of the Indonesian Civil Code (KUHPerdata). Given its probative value, authentic deeds hold a crucial role in legal certainty and public trust. Nevertheless, the increasing occurrence of forgery cases undermines the credibility of these documents and challenges the integrity of Indonesia’s legal system. Therefore, this study aims to analyze the legal implications and accountability mechanisms for the forgery of authentic deeds, emphasizing the need for stronger preventive regulations, stricter law enforcement, and enhanced oversight to uphold justice and protect the authenticity of legal instruments in Indonesia.
