Abstract

KUHP dan Hukum Islam melarang dan mengharamkan tindak pidana penggelapan, karena mengganggu dan mengambil hak orang lain secara tidak sah. Namun praktik tindak pidana pengelapan ini masih saja terjadi di kalangan, baik oleh oknum pejabat atau rakyat biasa. Untuk mencegah tindak pidana penggelapan ini, baik dalam KUHP dan hukum Islam mengatur dan menetapkan hukuman terhadap pelaku tindak pidana penggelapan. Tindak pidana penggelapan Dalam KUHP diatur secara rinci pada pasal 372,373, 374 dan 375. Konsep hukum Islam tentang tindak penggelapan ada empat yaitu ghulul, ghasab, sariqah, khianat. Yang pada masing-masing jarimah tersebut memiliki hukuman yaitu ghulul hukumannya dibakar hartanya serta dipukuli orangya, ghasab hukumannya mengembalikan barang yang sebanding dengannya, sariqah hukumannya dipotong tangan apabila yang diambil sudah mencapai nisab, khianat hukumannya dapat dijatuhi hukuman mati dalam beberapa kasus, seperti murtad, pemberontakan terhadap negara dan lari dalam medan perang. Di antara keempat kriteria penggelapan di atas, yang sesuai dengan tindak pidana penggelapan adalah al-ghulul. Ketentuan al-ghulul/penggelapan dan hukumannya adalah ta’zir, yaitu hukuman yang ditentukan oleh penguasa dengan memperhatikan kemaslahatan dan harus merujuk nash yang umum, karena pada dasarnya tidak ada nash secara khusus tentang tindak pidana penggelapan.

Abstract

This paper aims to examine the juridical basis for the application of Acehnese customary law, the mediation mechanism of Aceh Tamiang customary law in resolving minor disputes. The study of this paper used empirical research methods, using the theory of legal pluralism. Data were collected by means of in-depth interview and document study. Interviews were conducted with customary stakeholders, while the documents analysed were news of peace events in Aceh Tamiang. The findings reveal that the juridical basis for resolving minor disputes is based on the Law, the Qanun, and the Joint Decree between the Governor, the Aceh Regional Police Chief, and the Chair of the Aceh Customary Council (Majelis Adat Aceh). In Aceh Tamiang, the customary law mediation mechanism in gampong (village) and mukim (township) customary justice is generally carried out by reporting, requiring the presence of the parties to the dispute as well as the witnesses, and being open to the public. However, exception occurs for special disputes, in which according to custom and propriety must not be open to the public, and there is no charge whatsoever. Among the minor disputes that have been successfully resolved through gampong customary courts are domestic violence, inheritance disputes, land ownership, the construction of Telkomsel towers, and traffic accidents. The resolution of minor disputes in Aceh Tamiang from the perspective of legal pluralism has been carried out harmoniously and correlates between state law, customary law, and Islamic law. State law provides an opportunity for customary law to resolve minor disputes, and if it is not successful, then state law will take over. Further, dispute resolution in customary law is also in accordance with the values of Islamic law, which also prioritizes peace or al-sulh. This corresponds to the Acehnese proverb that states “adat ngen hukom lage zat ngen sifeut” which means the relationship between customary law and Islamic law is like a substance with its inseparable properties.

Abstract

In Acehnese communities, particularly in Bayu Village, illegal marriages conducted by unofficial qadi have been identified. These marriages are often carried out in secrecy, making it difficult to verify whether they meet the pillars and conditions of marriage according to Islamic law. The study aimed to examine the practice of illegal marriages conducted by the community of Bayu Village, Nanggroe Aceh Darussalam Province, from the perspective of Islamic family law. The research employed an empirical legal research method using a qualitative descriptive approach. The findings found out several cases of illegal marriages performed by unofficial qadi in Bayu Village. Couples intending to marry are required to fulfill specific conditions set by the qadi, including providing identity cards (KTP) of the prospective spouses, passport-sized photographs of the couple, witnesses, a dowry (mahr), and a guardian (wali) from the bride’s side. The prevalence of illegal marriages is from the community's limited understanding of the importance of marriage registration. From the perspective of Islamic family law, marriages conducted with unofficial qadi in Bayu Village constitute a deviation from religious principles, a violation of government regulations, and have negative implications for the community.

Abstract

PT. Pegadaian Syariah is an alternative financing institution that provides loans based on the law of pawn, which requires the submission of movable goods as collateral from customers to PT. Pegadaian Syariah. The focus of this study is on the form of responsibility and the explanation of how PT. Pegadaian Syariah Banda Aceh resolves compensation for the loss of the pawned objects. To answer this research question, the method used is a normative juridical approach. Normative juridical is a system for selecting legal regulations, doctrines applied to provide answers to legal cases, and using a statute-based approach. The findings of this study conclude that if a case of damage or loss of collateral occurs during the pawn process, PT. Pegadaian Syariah is responsible for the damaged or lost collateral. In providing compensation, PT. Pegadaian Syariah must adhere to the provisions set out in the Pawnshop Work Procedures Handbook, which governs how compensation should be provided if the collateral is lost

Abstract

Penelitian ini membahas mengenai prinsip hifzh al-maal (menjaga harta) dalam konteks penetapan uang jasa sebesar 25% pada program pembiayaan PNM Mekaar Syari’ah di Aceh Besar. Program ini merupakan bentuk pembiayaan usaha mikro yang ditujukan khusus bagi perempuan prasejahtera tanpa agunan, dengan tujuan untuk meningkatkan kesejahteraan keluarga melalui pemberdayaan ekonomi. Namun, adanya penetapan uang jasa sebesar 25% secara flat (tetap) setiap tahun menimbulkan persoalan tersendiri, terutama bagi pelaku UMKM yang memiliki pendapatan tidak tetap. Kondisi ini menimbulkan pertanyaan apa yang dimaksud dengan maqashid syari’ah dan prinsipnya dalam kehidupan Masyarakat, bagaimana praktik pembiayaan modal dan pandangan pelaku UMKM terhadap penetapan uang jasa 25% oleh PNM Mekaar Syari’ah Aceh Besar, serta bagaimana ketentuan tersebut ditinjau dari prinsip hifzh al-maal. Penelitian ini menggunakan metode yuridis sosiologis dengan pendekatan kualitatif, mengumpulkan data melalui wawancara langsung kepada nasabah dan pegawai PNM Mekaar Syari’ah Aceh Besar. Hasil penelitian menunjukkan bahwa meskipun program ini membantu akses modal usaha, penetapan uang jasa yang tetap tanpa mempertimbangkan fluktuasi pendapatan dinilai memberatkan sebagian nasabah dan berpotensi bertentangan dengan prinsip hifzh al-maal. Prinsip ini menekankan pentingnya menjaga dan mengelola harta secara proporsional dan menghindari beban yang merugikan. Oleh karena itu, penyesuaian sistem pembiayaan yang lebih adaptif terhadap kondisi ekonomi nasabah sangat diperlukan agar pelaksanaan program tetap sesuai dengan nilai-nilai maqashid syari’ah dan benar-benar menghadirkan kemaslahatan.
