Abstract

One of the legal reform agendas in Indonesia is to strengthen the presidential government system by clearly and firmly regulating the reasons for impeachment in the constitution. Article 7A of the 1945 Constitution of the Republic of Indonesia explains that the President and/or Vice President can be impeached for serious offenses such as treason, corruption, bribery, disgraceful acts, and other serious crimes. Considering the extensive powers of the President, it is important to analyze criminal acts further as reasons for impeachment. This research uses a normative juridical approach with descriptive-analytical analysis. Data collection methods are conducted through library research with primary data sources in the form of laws and secondary sources in the form of relevant literature. The research results show that the impeachment mechanism in Indonesia involves the Constitutional Court in assessing the House of Representatives 's accusations against the President, ensuring that impeachment is based on political and legal decisions. Additionally, criminal acts committed by the President can still be pursued in general courts for legal accountability. This aligns with the rule of law principle that ensures everyone is subject to the law without exception. Adjustments by state institutions involved in the impeachment procedure are expected to clarify the implementation of impeachment in Indonesia.

Abstract

Children as the next generation of our nation, play a crucial role in the development and sustainability of a country. Society aspires to have children who are healthy, intelligent, cheerful, and assured of their survival and growth. However, the social reality often tells a different story, as many children must navigate the legal system for various reasons. Law Number 11 of 2012, concerning the Juvenile Criminal Justice System, introduces the concept of diversion. This concept aims to protect Children in Legal Conflict by shifting the resolution of their cases from the judicial process to an alternative process outside the criminal justice system. In this juvenile justice framework, Traditional Institutions also play an essential role. The involvement of community leaders in the implementation of the diversion agreement demonstrates that "traditional law" is still recognized and applicable in resolving children's cases. Based on this context, the study formulates the following questions: Why do Children in Legal conflicts have the right to protection? And how Optimizing Aceh’s Traditional Institutions can Provide Legal Protection for Children in Legal Conflict? The purpose of this study is to raise awareness and understanding of the significance of providing protection to Children in Legal Conflict while enhancing the role of Traditional Institutions in this legal protection. This research is categorized as normative legal research, utilizing secondary data obtained from legal materials. Data collection techniques include library research with qualitative data analysis. The findings reveal that children in legal conflict have the right to protection because Indonesia's ratification of the Convention on the Rights of the Child mandates it. This international commitment underscores key principles such as the best interests of the child, non-discrimination, survival and development, and respect for the child's participation, which must be prioritized in ensuring their protection. In this regard, the Aceh’s Traditional Institution plays a vital role in realizing this legal protection by resolving cases with an emphasis on deliberation. Therefore, optimizing the function of the Aceh’s Traditional Institution is necessary to achieve effective legal protection for children in conflict with the law.

Abstract

Eksibisionisme melalui aplikasi Ome.TV mengacu kepada tindakan yang menampilkan perilaku atau konten secara eksplisit dan tindakan yang tidak pantas kepada orang lain menggunakan platform. Perilaku ini dianggap illegal menurut hukum positif di Indonesia dan memiliki konseksuensi hukum sebagai tindakan cabul atau tindakan menyimpang. Adapun permasalahan penelitian ini bagaimana pengaturan hukum mengenai tindakan eksibisionisme dalam aplikasi Ome.TV berdasarkan hukum positif di Indonesia? bagaimana pemidanaan yang dapat dikenakan bagi pelaku eksibisionisme dalam aplikasi Ome.TV? dan Bagaimana pertanggungjawaban yang dapat dituntut dari pihak pengelola atau pemilik aplikasi Ome. TV Penelitian ini bersifat normatif dan menggunakan data sekunder melalui studi kepustakaan didukung hasil wawancara. Hasil penelitian bahwa eksibisionisme merupakan tindakan penyimpangan seksual yang dapat dipidana dan termasuk kedalam pelanggaran menurut hukum positif di Indonesia. Mengenai pengaturan hukum tindakan eksibisionisme ini unsurnya terdapat di dalam“Pasal 281, dan Pasal 289 Kitab Undang-Undang Hukum Pidana, Pasal 10 dan 36 Undang Undang Nomor 44 Tahun 2008 tentang Pornografi, Pasal 27 ayat (1) dan Pasal 45 ayat (1) Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik yang diubah dengan Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi Dan Transaksi Elektronik, Pasal 414, Pasal 414 ayat (1) huruf c, dan Pasal 406 Undang-Undang Nomor 1 Tahun 2023 Tentang Kitab Undang-Undang Hukum Pidana, dan Pasal 5 Undang-Undang Nomor 12 Tahun 2022 Tentang Tindak Pidana Kekerasan Seksual.”Pemidanaan yang dapat dikenakan kepada pelaku tindakan eksibisionisme ini berupa pidana penjara dan denda, namun terdapat putusan hakim yang melepaskan pelaku eksibisionisme dari jeratan hukuman.
