Abstract

AbstractOne of the problems that arise in the law enforcement process in the field of eradicating criminal acts of corruption is the problem related to determining the status of a suspect or defendant as a witness to a cooperating perpetrator. These problems stem from unequal understanding or lack of policy unification in determining the status of perpetrators as perpetrator witnesses who cooperate with law enforcers. The formulation of the problem in this paper is how the problems arise in the regulation of the policy for determining cooperating witnesses in cases of criminal acts of corruption and how to reconstruct the policy for determining cooperating witnesses in cases of criminal acts of corruption which is based on the principles of mutual coordination, aspects of legal certainty and aspects of usefulness in an integrated criminal justice system. The type of research used is normative, using an approach to laws and other regulations. In practice, there are various kinds of regulations that regulate policies for determining perpetrator witnesses who cooperate in corruption cases. Therefore, with the emergence of the problem of the diversity of regulations regarding the determination of cooperating witnesses, an integrated policy reconstruction is needed in the form of the formation of new legal norms in the form of a law which becomes an integrative guideline.  Keywords : Justice Collaborator, Corruption Case, Integrated Criminal Justice System. AbstrakSalah satu dari problematika yang muncul dalam proses penegakan hukum di bidang pemberantasan tindak pidana korupsi adalah problematika yang terkait dengan penetapan status tersangka atau terdakwa sebagai saksi pelaku yang bekerjasama. Problematika tersebut bersumber dari adanya ketidaksamaan pemahaman atau tidak adaya unifikasi kebijakan dalam menetapkan status pelaku sebagai saksi pelaku yang bekerjasama oleh para penegak hukum. Rumusan permasalahan dalam tulisan ini adalah bagaimana problematika yang muncul dalam pengaturan tentang kebijakan penetapan saksi pelaku yang bekerjasama dalam perkara tindak pidana korupsi dan bagaimana rekonstruksi terhadap kebijakan penetapan Saksi Pelaku Yang Bekerjasama dalam perkara tindak pidana korupsi yang didasarkan pada asas saling koordinasi, aspek kepastian hukum dan aspek kemanfaatan dalam sebuah sistem peradilan pidana terpadu. Tipe penelitian yang digunakan adalah normatif, dengan menggunakan pendekatan Undang-Undang dan regulasi lainnya. Pada prakteknya terdapat berbagai macam regulasi yang mengatur tentang tentang kebijakan penetapan saksi pelaku yang bekerjasama dalam perkara tindak pidana korupsi. Oleh karena itu, dengan munculnya problematika keanekaragaman pengaturan tentang penetapan saksi pelaku yang bekerjasama tersebut maka diperlukan sebuah rekonstruksi kebijakan yang terintegrasi berupa pembentukan norma hukum baru dalam bentuk Undang-Undang yang menjadi pedoman yang bersifat integratif   Kata kunci: Saksi Pelaku Yang Bekerjasama, Tindak Pidana Korupsi, Sistem Peradilan Pidana Terpadu.

Abstract

Mixed marriages between spouses of different nationalities present a number of legal issues. As mixed marriages involve two different legal systems, it is important to understand which system applies. This understanding is important for the diaspora of Indonesians in Japan, given that the number of Indonesian citizens in Japan continues to increase, according to data from the Japanese Ministry of Home Affairs and Communications. This situation increases the potential for mixed marriages between Indonesian and Japanese citizens. This community service activity aims to provide legal insight on how to determine the applicable law and the conditions for mixed marriages. The method employed in this legal counselling is descriptive. Answers to questions asked are based on legislation and principles of private international law. Legal counselling on the legal aspects of mixed marriages for the Indonesian diaspora community in Japan can be said to be effective and appropriate. The participants indicated that there had been no previous legal counselling on the subject of mixed marriages, particularly in the context of comparing Indonesian and Japanese laws. They expressed hope that further legal counselling activities could be conducted via Zoom facilities on other legal issues.

Abstract

Abstract Indonesia is an archipelagic country that can determine its Archipelagic Sea Route according to UNCLOS 1982. Therefore, Indonesia already has 3 (three) Indonesian Archipelagic Sea Routes (ALKI) from North to South. However, many sea user countries argue that Indonesia should establish ALKI IV from West to East. The problem is whether it is urgent, according to UNCLOS 1982, for Indonesia to establish ALKI IV and what efforts and strategies have been made by Indonesia to establish ALKI IV. By using various research methods, the results of this study bring the conclusion that the sea between the islands of Indonesia becomes open the same as before the 1957 Djuanda Declaration and before the formation of the conception of the archipelago state listed in UNCLOS 1982 if the establishment of ALKI IV. Indonesia feels free to open ALKI IV if the existence of 3 ALKIs can still accommodate the right to cross the archipelagic sea flow. Then, the draft strategy for guarding ALKI in 2022 is known to have been made by the Directorate of Strategy of Bakamla. Furthermore, Indonesia's efforts in determining ALKI IV so far are surveys that connect ALKI I with ALKI II. If Indonesia wants to make ALKI IV, all aspects must be considered. However, if Indonesia does not want to make ALKI IV, it must determine steps supporting this argument..
