Abstract

The purpose of this research is to find out: 1). What are the efforts to protect Traditional Knowledge of the Gulai Ikan Mungkus special food carried out by the Kaur Regency Regional Government, Kaur Regency traditional restaurant entrepreneurs, and Kaur Regency Communities, and 2). What is the role of the Kaur Regency Government in Registering the Gulai Ikan Mungkus Special Food as Traditional Knowledge of Kaur Regency. This research is an empirical legal research, using a sociological juridical approach. Data collection was conducted by interviewing selected respondents/samples, observation, and document study. Data processing was started with coding and continued with data editing. After all the relevant data was complete and there were no errors, then data analysis was conducted using qualitative analysis. To further be described in order to answer the research objectives. The research results showed that: 1). the effort to protect the Traditional Knowledge of the Gulai Ikan Mungkus special food conducted by the Regional Government of Kaur Regency was by collecting data on restaurant actors who sell the Gulai Ikan Mungkus special food to be included in the festival events held by the Kaur Regency Government, appealed to all elements of society to register the Gulai Ikan Mungkus special food to the Education and Culture Office, cultivate Mungkus fish, as well as introduce this special food to foreign tourists came to visit Kaur Regency. Efforts to protect traditional restaurant business actors while maintaining the noble values and taste of Gulai Ikan Mungkus traditional food, 2). The Kaur Regency Government has not played a role in registering the special food Gulai Ikan Mungkus.

Abstract

The advanced development of science and technology also has an impact on the development of a country's economy. The rapid development of the economy, especially in the financial sector, has made the capital market a source of financing for a company. Companies that enter the capital market are public companies that have made public offerings on the stock exchange. One of the risks in selling on the stock exchange through the capital market is delisting. This study aims to analyze the legal basis for delisting and the responsibilities of delisted issuers to investors in the capital market. The research method used in this study is a normative juridical research type and uses statutory and conceptual approaches. The results of the study show that the responsibilities of issuers who are delisted to investors in the capital market are regulated in the Capital Market Law, the Limited Liability Company Law and the Financial Services Authority Regulations which regulate the mechanism for repurchasing shares and the legal protection given to investors for acts of negligence rather than issuers, in the form of sanctions given to forced delisting issuers. However, the regulation still does not explain in detail what form of responsibility the issuer should provide for the losses experienced by investors. In order to overcome these problems, clear arrangements are needed regarding the form of issuer's responsibility and legal protection for investors due to delisting, so as to provide legal certainty for investors.

Abstract

In order to accelerate the National Economic Recovery (PEN), one of them is to assist indistributing credit to micro, small, and medium enterprises (MSMEs). Based on PERMENKO No. 1 of2022, the government issued a policy: distribution of People's Business Credit (KUR) loan assistanceto Micro, Small and Medium Enterprises (MSMEs) players, providing that the loan prerequisite iswithout collateral. However, in implementing this government policy in the field, it turns out thatcreditors/banks still require that People's Business Credit (KUR) loans made by MSMEs still useadditional collateral, including a 10 million loan and at least one motorbike BPKB. For IDR 50million, the collateral is BPKB car or land/house certificate. Only after the PERMENKO No.1 of 2023issuance did the Bank completely exempt KUR recipients from the additional collateral guaranteerequirements in Bengkulu City.

Abstract

Based on PERMENKO No. 1, the year 2022, the government issued a policy, namely, the distribution of People's Business Credit (KUR) loan assistance for Micro, Small, and Medium Enterprises (MSMEs), that the loan requirements are carried out without collateral. However, in its implementation in the field, the government's policy turns out that the creditor/bank still requires that the People's Business Credit (KUR) loan carried out by MSMEs still use additional collateral, including a loan of IDR 10 million, at least one motorbike BPKB. For IDR 50 million, the collateral is one car, BPKB, or land/house certificate. Only then, after the issuance of PERMENKO No. 1 of 2023, did the Bank completely exempt KUR recipients from the additional collateral requirements in Bengkulu City. Abstract

emajuan teknologi menyebabkan  meningkatnya jumlah investor yang bergabung di pasar modal. Perusahaan efek selaku penyedia aplikasi yang digunakan oleh investor ketika bertransaksi di pasar modal. Namun dengan disediakannya aplikasi tersebut seringkali mengakibatkan kerugian bagi investor ketika ingin bertransaksi. Berdasarkan Pasal 31 UU Nomor 8 Tahun 1995 tentang Pasar Modal menjelaskan bahwa perusahaan efek bertanggung jawab atas segala kegiatan yang berkaitan dengan efek. Metode penelitian ini adalah penelitian hukum empiris, dengan menggunakan metode analisis kualitatif. Kesimpulan dari penelitian ini adalah: (1) PT Phintraco Sekuritas mempunyai tanggung jawab atas kerugian yang dialami oleh investor sebagaimana diatur UU Nomor 8 Tahun 1995 tentang Pasar Modal. Namun perbuatan tersebut diluar kemampuan pihak PT Phintraco Sekuritas atau disebut dengan overmacht. Sehingga pihak PT Phintraco Sekuritas tidak dapat diminta pertanggung jawaban atas pemenuhan suatu prestasi tersebut.(2) Pihak PT Phintraco Sekuritas melakukan upaya guna menghindari kerugian yang dialami oleh investor dengan cara pemeliharaan dalam sistem (Maintenance). Penyelesaian tanggung jawab pihak PT Phintraco Sekuritas atas kerugian yang dialami oleh investor dilakukan secara musyawarah pihak PT Phintraco Sekuritas akan melakukan tracking stock investor selama pembelian dan penjualan efek dan memberikannya kepada pihak investor.

Abstract

Perubahan PERMENKO Perekonomian Nomor 1 Tahun 2023 Tentang Pedoman Pelaksanaan Kredit Usaha Rakyat, antara lain mengatur tentang KUR tanpa jaminan. Kebijakan KUR tanpa agunan dengan segala kemudahan yang diterapkan pihak Perbankan terhadap UMKM ternyata menimbulkan permasalahan dalam kelancaran pembayaran kredit, Kemudahan persyaratan dalam pengajuan pinjaman KUR tanpa agunan yang pada prinsipnya membantu pelaku UMKM untuk pemenuhan modal usaha ternyata disalah artikan oleh sebagian debitur. Pinjaman Bank yang seharusnya dipergunakan untuk pengembangan usaha justru dipergunakan untuk hal hal lain yang bersifat konsumtif karena mereka beranggapan pinjaman KUR tanpa agunan tidak memiliki risiko. Penelitian ini menggunakan metode empiris yang berupaya melihat fakta hukum secara langsung bagaimana bekerjanya hukum di masyarakat. Hasil penelitian ini yaitu mengungkapkan faktor terjadi tunggakan yaitu usaha yang tidak berjalan, pendapatan menurun, kebutuhan yang tidak terduga serta perilaku debitur yang konsumtif sehingga terjadinya tunggakan. Untuk model penyelesaian keterlambatan angsuran, bank pertama-tama menghubungi nasabah melalui telepon untuk mengingatkan pembayaran. Jika tidak berhasil, petugas bank akan mengunjungi nasabah untuk mencari solusi, seperti memberikan keringanan waktu pembayaran, rescheduling, penurunan suku bunga, atau pembebasan bunga. Restrukturisasi utang dilakukan sebagai langkah terakhir jika nasabah masih memiliki prospek melunasi utangnya.
