Abstract

Adjustment of statutory regulations in the field of tourism business law in Indonesia is one of the consequences of the WTO agreement, thus the GATS-WTO agreement does not only concern Law Number 10 of 2009 concerning Tourism, but also all other related regulations. with tourism, such as labor regulations, Intellectual Property regulated in TRIP's, investment regulations (TRIM's), etc. These regulations will be affected by the provisions of the GATS-WTO, which must immediately be adjusted and harmonized with the GATS agreement commitment that has been agreed by Indonesia. It is by putting the principles of liberalization that it can have an impact on tourism arrangements in Indonesia which are not liberal but adhere to the principles of the Pancasila democracy state. The impact of the WTO on Indonesia's tourism business law arrangements related to TRIMS and GATS is the creation of tourism regulations that can protect local communities and cultures, limiting the liberalization of foreign investors from modern countries. The tourism arrangement must be in accordance with the nature of the purpose of its existence, namely to: increase economic growth; improve people's welfare; eradicating poverty; overcoming unemployment; preserving nature, environment and resources; promote culture; lifting the image of the nation; cultivate a love of the country; strengthen national identity and unity; and strengthen friendship between nations.

Abstract

Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Transaksi Elektronik pada Pasal 1 angka 21 bahwa yang dimaksud Orang adalah orang perseorangan, baik warga negara Indonesia, warga negara asing, maupun badan hukum, sehingga aturan tersebut dapat menjerat pelaku yang merupakan warga negara asing. Berdasarkan latar belakang masalah sebagaimana dikemukakan di atas, maka dapat dirumuskan beberapa masalah antara lain Bagaimanakah Pengaturan peretasan situs website menurut Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik? Dan Bagaimanakah akibat hukum bagi seorang peretas situs website yang merupakan warga negara asing? Metode penelitian yang digunakan adalah metode penelitian normatif yang bertumpu pada pendekatan konsep dan norma serta perundang undangan dengan teknik pengumpulan data melalui studi pustaka. Pengaturan peretasan situs website menurut Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan atas Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik telah diatur dalam Pasal 30 ayat 1, 2 , dan 3 Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik sementara Akibat hukum bagi seorang peretas situs website yang merupakan warga negara asing dapat dikenakan sanksi berdasarkan Pasal 46 Undang-Undang Nomor 19 Tahun 2016 Tentang Perubahan Atas Undang-Undang Nomor 11 Tahun 2008 Tentang Informasi dan Transaksi Elektronik Law Number 19 of 2016 concerning Information and Electronic Transactions in Article 1 number 21 that what is meant by Persons are individuals, both Indonesian citizens, foreign citizens, and legal entities, so that these rules can ensnare perpetrators who are foreign citizens. Based on the background of the problem as stated above, several problems can be formulated, including how are the arrangements for hacking websites according to Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions? And what are the legal consequences for a website hacker who is a foreign citizen? The research method used is a normative research method that relies on the approach of concepts and norms and laws with data collection techniques through literature study. Arrangements for hacking websites according to Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions are regulated in Article 30 paragraphs 1, 2 and 3 of Law Number 19 of 2016 concerning Amendments to Laws -Law Number 11 of 2008 Concerning Information and Electronic Transactions Temporary Legal consequences for a website hacker who is a foreign citizen may be subject to sanctions based on Article 46 of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions

Abstract

This article discusses the regulation of immunity rights granted to members of the People's Representative Council (DPR) who are involved in legal cases. The main objective of this research is to analyze the regulation and impact of immunity rights on DPR members involved in legal cases. This research utilizes a document analysis method to examine the regulations and laws related to DPR immunity rights, as well as case studies involving DPR members implicated in legal cases. The data used in this research are sourced from legal documents, court rulings, and media reports. The research findings indicate that the immunity rights granted to DPR members provide special legal protection that restricts their detention, arrest, and prosecution during their term in office. However, the use of these immunity rights also raises various controversies, especially when DPR members are involved in legal cases involving corruption or other serious violations.

Abstract

Article 88C paragraph (2) of the Employment Creation Law which states that the governor can set a district/city minimum wage under certain conditions. So if further observed the use of the word "can" in Article 88 C Paragraph (2) causes multiple interpretations. Based on the description of the background above, the author can formulate two problems, namely How is the Wage System Arrangement in the Law of the Republic of Indonesia Number 13 of 2003 concerning Manpower which has been changed to Law Number 11 of 2020 concerning Job Creation? And how is the determination of workers' wages based on Law Number 11 of 2020 concerning Job Creation? the type of legal research used is normative. To analyze the legal materials that have been collected, several analytical techniques are used, namely description techniques, interpretation techniques, evaluation techniques, and argumentation techniques. The conclusion of this research is that the regulation of the wage system in Law No. 11 of 2020 concerning job creation is that the type of wages is reduced, then the component of decent living is not included where the Job Creation Act is, and the length of service is not considered. Then the determination of the amount of wages for workers based on article 88 c of Law No. 11 of 2020 concerning job creation is that the Job Creation Law only provides for the obligation to set minimum wages at the provincial level, while at the district/city level it is optional or optional.

Abstract

.Justice for the entire community is the main key to successful development in state administration. Regional development is a form of government responsibility to the community in order to realize prosperity and prosperity fairly. Indonesia is a country with abundant natural resources. Almost all regions in Indonesia have both biological and non-biological resources. Minerals and coal are one of the non-biological natural resources found in Indonesia, which have an important role in implementing community development in the region. Researchers want to review what are the arrangements for implementing regional development from the perspective of the authority to manage Mineral and Coal Resources? How is regional development implemented in a fair manner regarding the management of mineral and coal resources? The type of research used is normative research using a statutory approach, the technique for collecting legal materials is literature and the analysis technique used is qualitative descriptive.
