Abstract

The implementation of the death penalty must be carried out with full consideration of the law and existing facts, so that in its implementation the death penalty must be measured and not imposed with careless considerations. One way to prevent errors in administering the death penalty is to provide a time lag between the execution and execution of the death sentence so that the convict is still given the opportunity to defend himself in order to explain the defense which can mitigate it. However, what is happening now is that many death sentences are being carried out with very quick executions. This certainly has an impact on potential violations of the rights of convicts. Therefore, this research will discuss further the retention of the death penalty from a human rights and restorative justice perspective. To analyze the problem, this research use normative method with regulatory, conceptual, and case approach. This research found in postponement of the execution of death row convicts has two jusctification are juridical justification and empirical justification. However, needs special regulation to arrange the posponement and it could be form in presidential regulation.

Abstract

The rapid advancement of technology has led to numerous innovations that ease human life. Among these, one of the most attention-grabbing developments is the emergence of artificial intelligence (AI). While AI brings a multitude of benefits, its presence also raises various legal issues, particularly in the context of corporate operations. In Indonesia, a company named PT Suryadhamma Investama has employed artificial intelligence to serve as a director, handling administrative tasks and participating in decision-making processes. Normatively (das sollen), this situation creates ambiguity concerning the legal accountability of a director that is an AI, as AI cannot be recognized as a legal subject due to its failure to meet the criteria of legal personhood. Consequently, AI lacks the legal standing to bear legal responsibility. Furthermore, AI cannot be sued or held legally liable because it is not classified as a legal subject under current legal frameworks. Empirically (das sein), this reality further obscures the normative provisions in place. On one hand, an AI-based director can assist companies in making various decisions; on the other hand, it challenges the certainty of legal accountability. Therefore, this study seeks to further elaborate the scope of liability associated with the use of artificial intelligence in corporate operations. The central legal issue explored in this research concerns the regulation of artificial intelligence’s legal liability in the management of a limited liability company under Law Number 40 of 2007 on Limited Liability Companies.The research method employed is normative juridical, utilizing statutory, conceptual, and case approaches.

Abstract

Sistem Administrasi Negara Indonesia berada pada titik persimpangan kritis, menghadapi krisis relevansi dan kepercayaan publik yang menuntut transformasi fundamental. Penelitian ini menganalisis bahwa reformasi parsial tidak lagi memadai untuk menjawab kompleksitas tantangan yang ada. Berbagai kekuatan dinamis—termasuk desentralisasi politik melalui otonomi daerah, imperatif ekonomi untuk menciptakan iklim investasi yang kondusif, serta disrupsi teknologi digital—secara kolektif mendorong kebutuhan akan perubahan paradigma. Analisis mendalam terhadap patologi internal birokrasi, seperti budaya kerja feodalistik dan rendahnya kualitas sumber daya manusia, menunjukkan adanya siklus negatif yang menghambat kemajuan. Di sisi lain, dinamika eksternal menciptakan sebuah tensi strategis antara dorongan sentralisasi demi efisiensi ekonomi dan mandat desentralisasi untuk responsivitas demokrasi. Sebagai respons, penelitian ini mengusulkan kerangka kerja  Rekonseptualisasi (mengubah filosofi dari 'mengatur' menjadi 'melayani'), Reposisi (menggeser peran dari penyedia monopoli menjadi fasilitator dan katalisator), dan Revitalisasi (menanamkan kapabilitas baru). Revitalisasi ini diartikulasikan melalui adopsi konsep Dynamic Governance, yang menekankan pada pengembangan kapabilitas adaptif sebagai kunci untuk membangun aparatur negara yang antisipatif, resilien, dan berpusat pada warga negara, yang pada akhirnya mampu menyelenggarakan pelayanan publik berkualitas tinggi di tengah ketidakpastian. Untuk mengawasi pelayanan publik maka peran ombudsman sangat diperlukan. Metode penelitian hukum yang digunakan adalah pendekatan normatif.
