Abstract

Dalam mendirikan negara tentulah disertai visi misi bagaimana mensejahterakan rakyat. Dimulai dengan dipenuhinya syarat untk membentuk suatu negara yaitu penduduk yang tetap wilayah yang jelas, pemerintahan yang berdaulat dan kemampuan untuk menjalin hubungan internasional. Sesudah itu tentu diperlukan perangkat negara lainnya, termasuk di dalamnya pemerintahan. Pemerintahan yang baik harus memperhatikan dan menjalankan asas-asas umum pemerintahan yang baik. Untuk mencapai hasil maksimal dalam pembangunan maka perlu partisipasi masyarakat. Jika pemerintah membuat kebijakan yang apabila dirasakan  merugikan rakyat kecil tentu menjadi persoalan tersendiri. Dewasa kini terkait dengan Tabungan perumahan rakyat (TAPERA), uang kuliah tunggal bagi mahasiswa di perguruan tinggi negeri. Terlebih lagi kenaikan bahan bakar minyak dan listrik yang cukup besar dan kebijakan lain yang dirasakan memberatkan.  Penelitian ini menyorot hubungan pemerintah dan rakyat Indonesia karena rakyat juga harus bisa ikut berperan serta dalam pembuatan kebijakan, tidak hanya terbatas pada pemerintah.  Metode penelitian yang digunakan dalam hal ini adalah yuridis-normatif dengan analisa kualitatif.

Abstract

Kuwaron village, Gubug District, Grobogan Regency, Central Java, is one of the villages that wants to improve the ranking of maju mandiri villages, such as efficient village asset management to get Village income through village-owned enterprises (BUMDes). Demographically, the population's livelihood is that of farmers. The natural conditions of the village are very potential for the development of village-owned enterprises. The village government's main problem is managing village-owned enterprises with the potential to be owned by the village. This research used normative research. The primary substance for Village-owned enterprises is how to organize and manage the creative economy based on the potential and assets of the village. However, this cannot be done optimally because the Kuwaron village government and the management of village-owned enterprises still face some obstacles. This activity aims to strengthen, enlighten, and open up insight into the rules of law related and closely related to the management of village-owned enterprises so that they can institutionally synchronize the formulation and determination of asset management policies following the village's potential. Moving on from these objectives, the methods used in this activity are legal counseling on village asset management for developing village-owned enterprises.

Abstract

Campaign problems occur throughout the election from year to year, resulting in unrest in public opinion. Manipulation to sabotage is carried out to bring down legislative opponents of other candidate pairs that cause elections to occur haphazardly and override the correct campaigning provisions under the law. The emergence of sabotage carried out to seek the popular vote during the campaign casts doubt on the existence of clean and safe elections. Parties that should be considered neutral during the campaign until the election show their support for one of the competing legislative candidate pairs, which makes the neutrality of certain parties doubtful during the election. The occurrence of a haphazard campaign can damage the image of the election in the eyes of the public by realizing the view that campaigns and elections are meaningless as long as the ruling party uses its power to create a good image for one candidate as a competitor. Efforts to prevent dirty campaigns can be started by stopping sabotage carried out by supporters or candidates themselves to weaken opponents' voices armed with campaign Education and minimize the spread of false news during the campaign. Law enforcement should be maximized. The rules must be perfected.

Abstract

One of the authorities of the Constitutional Court (MK) is to resolve disputes over general election results. In the 2024 presidential election, the presidential candidate pair Anies Baswedan-Muhaimin and the Ganjar-Mahfud pair filed a lawsuit with the Constitutional Court. This study uses normative research. The results show that many figures have emerged as Amicus Curae, such as Megawati Soekarnoputri, Dien Syamsudin and others. In addition, this Amicus Curae is very important in order to achieve openness and justice in general election disputes in the Indonesian legal system.

Abstract

The purpose of this study is to analyze Sharia-compliant fintech regulations in both countries and provide recommendations to strengthen their regulatory frameworks. Financial technology (fintech) has transformed the global financial industry landscape by introducing innovations that accelerate access to financial services. Sharia-compliant fintech, as part of this development, plays a critical role in providing financial services that comply with Sharia principles, such as the prohibition of riba, gharar, and maysir. The study found that Sharia-compliant fintech regulations in several countries, such as Indonesia and Bangladesh, are still in their infancy. Existing regulations are often not fully aligned with the needs of Sharia-compliant fintech, highlighting the need for a more comprehensive and inclusive regulatory approach. In Indonesia, the Financial Services Authority and Bank Indonesia have issued several policies to support fintech development, but there is still no specific regulation for Sharia-compliant fintech. In Bangladesh, the development of Sharia-compliant fintech is supported by Islamic banking initiatives, although a more mature regulatory framework is still needed. By adopting best practices from countries such as Malaysia, which have developed more advanced regulations for Sharia-compliant fintech, both countries can increase financial inclusion and create a more sustainable fintech ecosystem.

Abstract

Sistem Administrasi Negara Indonesia berada pada titik persimpangan kritis, menghadapi krisis relevansi dan kepercayaan publik yang menuntut transformasi fundamental. Penelitian ini menganalisis bahwa reformasi parsial tidak lagi memadai untuk menjawab kompleksitas tantangan yang ada. Berbagai kekuatan dinamis—termasuk desentralisasi politik melalui otonomi daerah, imperatif ekonomi untuk menciptakan iklim investasi yang kondusif, serta disrupsi teknologi digital—secara kolektif mendorong kebutuhan akan perubahan paradigma. Analisis mendalam terhadap patologi internal birokrasi, seperti budaya kerja feodalistik dan rendahnya kualitas sumber daya manusia, menunjukkan adanya siklus negatif yang menghambat kemajuan. Di sisi lain, dinamika eksternal menciptakan sebuah tensi strategis antara dorongan sentralisasi demi efisiensi ekonomi dan mandat desentralisasi untuk responsivitas demokrasi. Sebagai respons, penelitian ini mengusulkan kerangka kerja  Rekonseptualisasi (mengubah filosofi dari 'mengatur' menjadi 'melayani'), Reposisi (menggeser peran dari penyedia monopoli menjadi fasilitator dan katalisator), dan Revitalisasi (menanamkan kapabilitas baru). Revitalisasi ini diartikulasikan melalui adopsi konsep Dynamic Governance, yang menekankan pada pengembangan kapabilitas adaptif sebagai kunci untuk membangun aparatur negara yang antisipatif, resilien, dan berpusat pada warga negara, yang pada akhirnya mampu menyelenggarakan pelayanan publik berkualitas tinggi di tengah ketidakpastian. Untuk mengawasi pelayanan publik maka peran ombudsman sangat diperlukan. Metode penelitian hukum yang digunakan adalah pendekatan normatif.

Abstract

Indonesia is a country of law (rechtsstaat). In terms of regulating its state, Indonesia uses various kinds of laws and regulations. This includes equality between men and women. This gives rise to the term equal protection principle or equality before the law, namely equality and equality of individuals and communities in the eyes of the law. The law relating to marriage and the rights and position of both a wife and a husband in the Civil Code was replaced by Law No. 1 of 1974 on marriage, which has now been revised by the law of the Republic of Indonesia No. 16 of 2019 on amendments to Law No. 1 of 1974 on Marriage (Marriage Law). However, this law has no sanctions if anyone does not comply with it. In this case, we need to amend the Marriage Act. This research is descriptive normative legal research. The theory used theory is the theory of the rule of law, the theory of the purpose of law, and the theory of law enforcement. Data collection techniques are Library Studies (library research).
