Abstract

Penelitian ini dilakukan dengan menggunakan metode penelitian yuridis normatif dan studi literatur tentang Fenomena Arisan Online di Indonesia. Arisan Online adalah kegiatan arisan yang dilakukan secara online atau melalui media sosial yang dilakukan oleh beberapa pihak di dalamnya dengan menggunakan metode perputaran uang tunai. Kasus penipuan dengan modus Arisan Online banyak dilakukan di berbagai media sosial seperti WhatsApp, Facebook, dan Instagram. Namun selain dampak positif, ada juga dampak negatif melalui pembangunan ini. Penelitian ini menjelaskan bagaimana perlindungan hukum bagi korban yang mengalami kerugian akibat arisan berbasis online ditinjau dari pasal 1243 KUH Perdata dan bagaimana penegakan hukum terhadap pemilik arisan online yang tidak berizin. Pada April 2023 lalu kasus arisan sultan di sukabumi bermula ketika sang pemilik menyebarkan informasi tentang arisan dan investasi melalui media sosial Instagram. Pemilik arisan menjanjikan keuntungan berkisar antara 5 hingga 10 persen. Namun, setelah tanggal jatuh tempo yang disepakati, baik modal maupun keuntungan tidak pernah dikembalikan. Bentuk perlindungan hukum bagi peserta arisan online adalah membayar ganti rugi sebagaimana diatur dalam Pasal 1243 KUHPerdata selain ganti rugi. Bentuk penegakan hukum bagi pemilik arisan online dapat dijerat dengan Pasal 372 juncto Pasal 378 KUHP dan/atau Undang-Undang Republik Indonesia Nomor 8 Tahun 2010.

Abstract

Background. The Tax Court, basically, has been regulated in Law Number 14 Year 2002 on Tax Court. However, there is an issue relating to the ambiguous position of the Tax Court. Purpose. The purpose of this is to show that the position of the court is not independent, as it plays a role in both judicial and executive functions, which may result in a lack of independence in case decision making. Therefore, this study aims to determine the position of the tax court in the current judicial system in Indonesia. Method. This research uses normative juridical research method by reviewing secondary data obtained. Based on the results of the research, it was found that the latest Constitutional Court Decision Number 26/PUU-XXI/2023 has determined that the Tax Courts must transfer their organizational, administrative, and financial development responsibilities to the Supreme Court before 31 December 2026. Results. The consequence of this decision is that the organizational structure of the Tax Court will be directly under the supervision of the Supreme Court and no longer under the Ministry of Finance. Although the Tax Court will be transferred to the Supreme Court, it is important to maintain this situation as the transition requires adjustments in terms of organizational structure, employee status, and career opportunities for tax judges. All of these matters must be studied and solutions found by the Tax Court as the independence of tax judges means a lot to taxpayers seeking justice in their tax disputes. Conclusion. In addition to independence, the public also expects competent expertise and knowledge from tax judges as enforcers of justice in tax disputes.

Abstract

Sertifikat ganda hak milik atas tanah menjadi isu yang kompleks dalam praktik hukum perdata, terutama dalam konteks Pasal 19 Undang-Undang Pokok Agraria. Penelitian ini bertujuan untuk menganalisis dan mengimplementasikan penyelesaian kasus sertifikat ganda hak milik atas tanah berdasarkan ketentuan Pasal 19 UUPA dalam ranah hukum perdata. Metode penelitian yang digunakan adalah studi literatur dan analisis kasus. Hasil penelitian menunjukkan pentingnya pemahaman yang mendalam terhadap Pasal 19 UUPA dalam menyelesaikan sengketa terkait sertifikat ganda. Implementasi yang tepat dari ketentuan hukum perdata dapat menjadi solusi efektif dalam menangani masalah kompleks ini. Penelitian ini diharapkan dapat memberikan kontribusi positif dalam pemahaman dan penerapan hukum agraria di Indonesia.

Abstract

The practice of house lease-pawn agreements in rural communities is frequently employed as an alternative means of meeting economic needs, often without adherence to formal legal provisions. This study aims to analyze the legal framework governing house lease-pawn agreements under Article 1338 of the Indonesian Civil Code, which embodies the principle of freedom of contract, as well as to examine the legal implications of breach of contract in such agreements pursuant to Article 1238 of the Civil Code. Employing a normative juridical approach, this research incorporates a case study conducted in Kampung Cijambe, Sukabumi City. The findings indicate that house lease-pawn agreements constitute innominate contracts, which are legally valid provided they satisfy the requirements stipulated in Article 1320 of the Civil Code. In instances of breach of contract, the aggrieved party is entitled to seek contract annulment, compensation, and legal recourse through judicial mechanisms. The study underscores the necessity of drafting written agreements that ensure legal certainty and advocates for regulatory reinforcement regarding the practice of house lease-pawn agreements.

Abstract

His research began with the problem of non-compliance of the company (PT. Surya Foresta) in providing social security protection to workers, especially casual daily workers. Law No. 24 of 2011 stipulates that every worker, including casual daily workers, contract workers, or permanent employees, must be registered in the BPJS Employment program. Government Regulation No. 35 of 2021 regulates fixed-term work agreements, outsourcing, working hours and rest times. The method used in compiling this research is the legal approach method of examining regulations governing workers' rights to BPJS employment and the empirical approach of observing and analyzing practices in companies related to compliance with these regulations. The results of the study explain that non-compliance in providing social security can cause workers not to get the legal protection they should, cause discomfort, health and safety risks without protection, and economic uncertainty in old age for workers and their families.
