Abstract

Food Estate is part of the National Economic Recovery (PEN) program aimed at anticipating a food crisis in Indonesia due to the Covid-19 pandemic. The program is supported by the Omnibus Law on Job Creation, which mandates ministers/head of agencies, governors, and regents/mayors to provide the necessary permits and non-permits for the implementation of National Strategic Projects. The research methods used are literature studies, spatial analysis, and the collection of primary data from books, scientific articles, and the internet. The research results indicate that the conversion of tropical forests into Food Estate land has led to the loss of natural habitats, forest fragmentation, and carbon emissions. The excessive use of chemical fertilizers has polluted groundwater and rivers, causing eutrophication and disrupting the balance of ecosystems. The cumulative impact of tropical forest conversion and the use of chemical fertilizers has led to a significant decrease in biodiversity in the Gunung Mas Food Estate area. This research uses the Normative Juridical method, aimed at analyzing and dissecting the components of a problem for further examination and then linking them to the laws, legal principles, and legal norms applicable as a solution to the food estate issue in Gunung Mas Regency. This research recommends the implementation of sustainable farming practices, such as reducing forest conversion, using organic fertilizers, and applying environmentally friendly farming techniques, to minimize the negative impacts on biodiversity and achieve sustainable food security in the Gunung Mas Food Estate.

Abstract

Lembaga Penjamin Simpanan (LPS) memiliki peran penting dalam menjaga stabilitas sistem keuangan di Indonesia dengan menjamin simpanan nasabah serta menangani bank gagal. Berdasarkan Undang-Undang Nomor 24 Tahun 2004 tentang Lembaga Penjamin Simpanan, LPS memiliki kewenangan untuk melakukan pembayaran klaim penjaminan dan resolusi bank bermasalah guna mencegah dampak sistemik terhadap perekonomian nasional. Dalam menjalankan tugasnya, LPS berkolaborasi dengan Otoritas Jasa Keuangan (OJK) yang bertanggung jawab atas pengawasan perbankan. Sinergi antara LPS dan OJK meliputi pemantauan kesehatan perbankan, intervensi dini terhadap bank yang mengalami kesulitan likuiditas, serta implementasi kebijakan dalam rangka mitigasi risiko keuangan. Kolaborasi ini bertujuan untuk memperkuat sistem keuangan nasional, meningkatkan kepercayaan publik terhadap perbankan, serta mencegah potensi krisis keuangan yang dapat berdampak luas. Dengan sistem pengawasan dan penanganan krisis yang terintegrasi, LPS dan OJK berperan sebagai pilar utama dalam menjaga ketahanan sektor perbankan dan mendorong pertumbuhan ekonomi yang berkelanjutan.

Abstract

This study means to link violations committed by bureaucratic officials in the Indonesian region with the principles of Indonesian constitutional law, namely the principles of democracy and the principle of people's sovereignty, which are in accordance with the legal basis, by the Amendment to Article 1 paragraph (2) of the 1945 Constitution by the MPR. Regarding Indonesian sovereignty which is in the hands of the people and carried out in accordance with the Constitution. This study uses the Normative Juridical method, which means that research is carried out by examining legal regulations and other supporting materials that are still related to violations committed by government bureaucrats against the principles of constitutional law, namely the principles of democracy and people's sovereignty. This research is based on descriptive characteristics, namely research that has the plan to describe events related to the topic of this research. From this study, it is clear that the appointment of regional head officials without elections by the people is against the principle of popular sovereignty and the principle of democracy. In this case, the participation and responsibility of all Indonesian citizens are needed to create a democratic system that is fair, equitable, and beneficial for the entire Indonesian government.
