Abstract

Pembedaan antara rezim Pemilu dan Pilkada bermula dari Putusan Mahkamah Konstitusi No. 97/PUU-XI/2013, yang mana menyebabkan MK tidak berwenang untuk memeriksa dan mengadili perkara perselisihan tentang hasil tentang Pilkada. Akan tetapi selama belum terbentuknya Badan Peradilan Khusus maka MK tetap berwenang untuk memeriksa dan mengadili perkara tersebut. Dengan demikian persoalannya adalah apakah Mahkamah Konstitusi pasca Putusan MK No. 85/PUU-XX/2022 Mahkamah Konstitusi berwenang untuk memeriksa dan mengadili perkara perselisihan hasil tentang Pilkada, serta apakah perlu diatur secara terpisah mengenai kewenangan tersebut dalam UUD 1945, dan bagaimana makna Pemilu pasca Putusan MK No. 85/PUU-XX.2022. Metode yang digunakan dalam penulisan ini adalah metode normative, serta bahan hukum yang digunakan adalah bahan hukum primer dan sekunder. Hasil penelitian ini menyimpulkan bahwa pasca Putusan Mahkamah Konstitusi Nomor 85/PUU-XX/2022 pembedaan kedua rezim itu tidak lagi ada, sehingga Mahkamah Konstitusi berwenang untuk memeriksa dan mengadili perkara tersebut secara permanent.

Abstract

Abstract The Constitutional Court as an institution that has received an expansion of authority through court interpretation to review the Perppu against the 1945 Constitution of the Republic of Indonesia was apparently not accompanied by adjustments to the procedural law. Because the object of review of the Perppu and the object of review of laws by the Constitutional Court are two formally different objects. The purpose of this study is to find out and explain what is the urgency of setting the time for reviewing the Perppu by the Constitutional Court. The research method used in this study is a legal research method with a statutory approach. While the legal materials used in this research are primary and secondary legal materials. The results of the study show that, with no time limit for reviewing the Perppu by the Constitutional Court, several petitions for review have lost objects, because the object being tested has turned into law. So the urgency to limit the testing time is to prevent the application from losing the object. Keywords: Restrictions, Perppu, Constitutional Court.   Abstrak Mahkamah Konstitusi sebagai lembaga yang mendapat perluasan kewenangan melalui penafsiran pengadilan untuk menguji Perppu terhadap UUD NRI Tahun 1945 ternyata tidak dibarengi dengan penyesuaian hukum acaranya. Sebab objek pengujian Perppu dengan objek pengujian undang-undang oleh Mahkamah Konstitusi merupakan dua objek yang berbeda secara formil, sehingga hal itu tidak boleh disamakan ketika diajukan pengujian di Mahkamah Konstitusi. Tujuan dari penelitian ini adalah untuk mengetahui dan menjelaskan apa urgensi diaturnya pembatasan waktu pengujian Perppu oleh Mahkamah Konstitusi. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian hukum dengan pendekatan perundang-undangan. Sementara bahan hukum yang digunakan dalam penelitian kali ini adalah bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa, dengan tidak dibatasinya waktu pengujian Perppu oleh Mahkamah Konstitusi membuat beberapa permohonan pengujian telah kehilangan objek, sebab objek yang tengah diuji telah berubah menjadi undang-undang. Sehingga urgensi untuk dibatasinya waktu pengujian ini adalah untuk mencegah permohonan kehilangan objek. Kata Kunci: Pembatasan, Perppu, Mahkamah Konstitusi

Abstract

The purpose of this study is to examine and analyze the authority of the Regency/City Regional Government in collecting and/or not collecting PBJT tax on entertainment services in the form of steam baths/spas and the reconstruction of the amount of PBJT rates for entertainment services in the form of steam baths/spas after the Constitutional Court Decision. The mention of steam baths/spas in this article must be interpreted as traditional health services as per the Constitutional Court Decision No. 19/PUU-XXII/2024. Therefore, this study is a legal study using three approaches, namely the statutory, conceptual, and case approaches. The results of this study indicate that the Regency/City Regional Government must collect PBJT on arts and entertainment services in the form of steam baths/spas as long as it is stated in the Regional Regulation. However, the Regency/City Government may not collect PBJT on arts and entertainment services in the form of steam baths/spas if there are or are met the requirements as stipulated in Article 6 paragraph (2) of Law No. 1 of 2022. Because the mention of steam baths/spas is stated to provide no guarantee of legal certainty and creates a negative stigma in society by the Constitutional Court, the logical consequence of this is to remove steam baths/spas from the category of discotheques, karaoke, nightclubs and bars and put them in the category of massage parlors and reflexology. So, the PBJT tariff for arts and entertainment services in the form of steam baths/spas is adjusted to Article 58 paragraph (1) of Law no. 1 of 2022 which levies the highest PBJT of 10%.

Abstract

The phenomenon of single-candidate elections in regional head elections (Pilkada) poses challenges to the democratic principles of directness, generality, freedom, confidentiality, honesty, and fairness. To address such electoral impasses, the "empty ballot box" mechanism was introduced through Constitutional Court Decision No. 100/PUU-XIII/2015 and supported by General Election Commission Regulations (PKPU), offering voters an alternative. However, this mechanism raises critical legal and democratic concerns—whether it truly reflects popular sovereignty or merely serves as an administrative formality. This study examines the legal legitimacy, democratic substance, and systemic consequences of the empty ballot box in Pilkada. Using a doctrinal legal methodology with statutory and conceptual approaches, the analysis reveals that the empty box mechanism predominantly acts as an administrative safeguard rather than a vehicle of the people's will. While it ensures procedural continuity, it fails to address the deeper issues of political representation and structural deficiencies in candidate nomination. The dominance of legal positivism in regulating this mechanism neglects principles of substantive justice and meaningful participation. This study argues for a comprehensive legal reform that moves beyond formal compliance and embraces progressive legal principles. Such reform should strengthen political party accountability, support independent candidacies, and expand public participation in candidate nomination. By reframing the empty box through the lens of democratic renewal and human rights, this article contributes a novel critique of electoral design in Indonesia.
