Abstract

The Constitutional Court and the Supreme Court's dual-roof judicial review authority has generated new legal complications. The decisions between the Supreme Court and the Constitutional Court often conflict, giving rise to legal uncertainty for justice seekers. Even though judicial review has an important role as an effort to protect the constitutional rights of citizens who are disadvantaged over the existence of norms of legislation established by the government. Through the judicial review mechanism, there is a mechanism to rectify the norms of laws and regulations to comply with the basic legal norms, namely the Constitution. However, the practice of judicial review so far in Indonesia seems ineffective because of the two-roof design at the Supreme Court and the Court. Therefore, reforming judicial review under one roof of the Constitutional Court is an alternative idea to find ways to solve existing problems. This article attempts to provide insight into the model of judicial review in Indonesia and the reformulation of judicial review authority under one roof of the Supreme Court of Justice to uphold the principle of constitutional supremacy. The study employed normative legal research methods. This study offers a reformulation of judicial review authority under one roof of the Constitutional Court. The results of this study reveal that the authority of judicial review under the two roofs of the Supreme Court and the Court has given rise to legal problems, such as conflicting decisions, which result in legal uncertainty. Ultimately, this article provides an alternative idea, namely the reformulation of judicial review authority under one roof of the Constitutional Court to create legal certainty and uphold the principle of constitutional supremacy.

Abstract

The revocation of 2,078 Mining Business Licenses (IUP) on January 10, 2022, some of which was based on non-compliance with the Domestic Market Obligation (DMO) policy, is alleged to have been conducted arbitrarily, without regard for the principles and procedures of licensing management. Therefore, this research aims to analyze two legal issues: (1) Whether the revocation of the IUPs belonging to coal mining business entities that failed to meet the DMO quota by the Minister of Investment/Head of the Investment Coordinating Board (Head of BKPM) is a lawful decision; (2) What are the legal consequences of revoking the coal IUPs based on failure to meet the DMO quota on the agreements between the IUP holders and third parties? This research concludes that: (1) The decision to revoke the IUPs by the Head of BKPM is an unlawful decision and may be annulled. However, the revocation decision remains in effect as long as it has not been annulled by the competent authority and/or there is no final and binding court decision declaring the validity or invalidity of the decision. (2) The existence of a (relative) force majeure releases the IUP holder, as the debtor, from liability for breach of contract. This force majeure status is only temporary. If the debtor’s IUP is reinstated, the creditor may demand the fulfillment of the performance.

Abstract

Peraturan Pemerintah Pengganti Undang-Undang merupakan produk hukum yang ditujukan guna mengatasi permasalahan dalam keadaan kegentingan yang memaksa. Namun, penetapan perppu harus tertib prosedur pembentukan peraturan perundang-undangan. Oleh karenanya, diperlukan sebuah pengaturan prosedur penetapan perppu menjadi UU yang berkepastian guna menciptakan tertib hukum. Penelitian ini mencoba meneliti terkait keabsahan penetapan perppu cipta kerja menjadi UU 6/2023; dan memberikan gagasan penataan terhadap prosedur penetapan perppu menjadi UU. Dengan menggunakan penelitian hukum doktrinal yang dielaborasi dengan metode Reform-Oriented Research, penelitian ini menemukan bahwa penetapan perppu cipta kerja menjadi UU 6/2023 tidak memiliki keabsahan. Namun, hal ini disebabkan pengaturan prosedur penetapan perppu menjadi UU yang tidak berkepastian. Ketidakjelasan dalam menakar “hal ihwal kegentingan memaksa”, interpelasi atas makna “persidangan yang berikut”, dan tidak dibatasinya materi muatan suatu perppu. Puncaknya, penulis menggagas penataan prosedur penetapan perppu menjadi UU melalui (i) mengatur “hal ihwal kegentingan memaksa” secara normatif dalam UU P3; (ii) membatasi makna “persidangan yang berikut” secara ketat; dan membatasi materi muatan suatu perppu. Penataan prosedur tersebut ditujukan guna memberikan kepastian hukum agar tercipta tertib hukum dalam penetapan perppu menjadi UU.
