Abstract

This article aims to examine what the pre-trial judges consider in determining whether a suspect's determination is legal. The basis of the reason "not based on the provisions and legal procedures in force" is a pre-trial petition. Including examining whether the Notification Letter for the Commencement of Investigation has not been submitted to the Reported Party and the Reporting Party, it can be used as a basis for the judge's consideration to judge the legality of the determination of the suspect. This article uses a legal research method through a statutory, conceptual, and case approach. This article finds that after the issuance of the Constitutional Court Decision Number 21 / PUU-XII / 2014 and the Supreme Court Regulation Number 4 of 2016, the fulfillment of preliminary evidence, namely that two valid tools of evidence constitute the absolute standard of determining the suspect. Besides, in terms of proof, pre-trial only assesses the validity of formal aspects, which incidentally do not touch the case's subject matter. An application for the cancellation of a suspect's status, for whatever reason, cannot be granted if the initial evidence is not fulfilled, namely the two tools of evidence listed in Article 184 paragraph (1) of the Law of Criminal Procedure (KUHAP). Ultimately, this study recommends the need for affirmation in terms of determining suspects through changing the parameters for deciding suspects in Article 1 point 11 of the Draft of the Law of Criminal Procedure from what was originally only based on "...sufficient preliminary evidence" to "...the fulfillment of two tools of evidence contained in Article 175 paragraph (1) of the Law of Criminal Procedure" to achieve legal certainty and fulfill the suspect's human rights.

Abstract

The revocation of 2,078 Mining Business Licenses (IUP) on January 10, 2022, some of which was based on non-compliance with the Domestic Market Obligation (DMO) policy, is alleged to have been conducted arbitrarily, without regard for the principles and procedures of licensing management. Therefore, this research aims to analyze two legal issues: (1) Whether the revocation of the IUPs belonging to coal mining business entities that failed to meet the DMO quota by the Minister of Investment/Head of the Investment Coordinating Board (Head of BKPM) is a lawful decision; (2) What are the legal consequences of revoking the coal IUPs based on failure to meet the DMO quota on the agreements between the IUP holders and third parties? This research concludes that: (1) The decision to revoke the IUPs by the Head of BKPM is an unlawful decision and may be annulled. However, the revocation decision remains in effect as long as it has not been annulled by the competent authority and/or there is no final and binding court decision declaring the validity or invalidity of the decision. (2) The existence of a (relative) force majeure releases the IUP holder, as the debtor, from liability for breach of contract. This force majeure status is only temporary. If the debtor’s IUP is reinstated, the creditor may demand the fulfillment of the performance.

Abstract

Polemik kebebasan berbicara telah menjadi masalah serius di Indonesia. Kurangnya saluran partisipasi membuat pengaturan untuk kebebasan berbicara dan pendapat perlu untuk dikaji ulang. Meskipun dalam demokrasi, masyarakat menempati posisi tertinggi dalam sistem ketatanegaraan, namun sejauh ini, bentuk partisipasi masyarakat hanya dianggap terbatas dalam pemilihan umum. Oleh karena itu, masyarakat membutuhkan cara yang efektif dan efisien untuk menyuarakan aspirasi mereka. Artikel ini mencoba memberikan wawasan tentang bagaimana pengaturan petisi memengaruhi peningkatan partisipasi publik. Dengan menggabungkan metode penelitian doktrinal, sosial-hukum, dan mempertimbangkan Inggris dan Estonia sebagai perbandingan, artikel ini ingin menawarkan strategi pengaturan petisi ke dalam peraturan perundang-undangan nasional untuk memperkuat posisi masyarakat dalam mewujudkan hak kebebasan berpendapat. Hasil penelitian ini menunjukkan bahwa aplikasi petisi daring di beberapa negara mampu menjadi media yang menghubungkan masyarakat dan negara. Efektivitas petisi daring terletak pada kemampuannya dalam mempertahankan partisipasi masyarakat dan memengaruhi pengambilan keputusan untuk mengatasi ketidakadilan. Puncaknya, artikel ini mempertimbangkan beberapa opsi yang tersedia dalam membangun payung hukum kebebasan berbicara dan berpendapat yang optimal sebagai upaya untuk melindungi dan mempromosikan hak asasi manusia.Kata Kunci: Petisi, Penguatan Posisi Masyarakat, Kebebasan Berpendapat, Partisipasi Masyarakat, Hak Asasi Manusia

Abstract

This research seeks to examine a Patent regulation in the form of a Non-Fungible Token (NFT-Patent) in Indonesia. The implementation of NFT-Patent is intended to overcome the problems of patent management in Indonesia, such as the long and expensive bureaucratic process of patent, the absence of an integrated patent commercialization ecosystem, and the existence of a legal vacuum regarding the valuation mechanism of a patent. This research aims to answer a formulation of the problem related to how the model of NFT-Patent regulation through the online marketplace in Indonesia. The analysis of the problem formulation will start by comparing Non-Fungible Token (NFT) regulations in Indonesia with other countries, followed by conceptualizing the transfer of ownership rights from NFT-Patent carried out through an online marketplace, then end by formulating the regulation of the NFT-Patent online marketplace in the statutory regulations in Indonesia. By combining doctrinal research methods and reform-oriented research, this study found that based on Indonesia’s positive law, NFT is categorized as a crypto commodity which is an object of tax and BKP. On the contrary, the United States sees NFT as conventional IPR in digital form for tax purposes. NFT-Patent is categorized as an intangible movable object whose transaction is considered valid as long as it meets the provisions of Article 1320 of the Civil Code and Article 46 paragraph (2) of the Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems. In its implementation, a transition process is carried out with several stages. The transition stages are regulated in the Regulation of the Minister of Law and Human Rights with the Directorate General of Intellectual Property as the manager. If most of the transition process has been running, the government needs to update the 2016 Patent Law by implementing the Separation Principle by separating the purpose of using inventions into 3, namely consumption, production, and innovation. Ultimately, this research recommends the government to regulate NFT specifically, synergize with blockchain-based Patent ecosystem development companies and encourage collaboration between universities and industrial companies in developing Patents.

Abstract

The increasing number of ‘terrorist prisoners’ in Indonesia has resulted in the establishment of a separate penal institution. This development is novel to Indonesian secure settings, and the perceptions of prison officers’ who work in these specialist prisons offer distinct practical insights into the efficacy of these correctional facilities. The present study provides innovative findings by exploring, for the first time, the perspectives of Indonesian prison officers working in specialist prisons for terrorist prisoners in Indonesia. This study conducted focus groups with Indonesian prison officers in Cipinang, Pasir Putih Nusakambangan, and Surabaya prisons. A qualitative content analysis was deployed that identified several themes for future policy decisions. These included, the establishment and ongoing administration of a special prison;, the need to improve data collection of terrorist inmates; the importance of partnerships with key stakeholders, and the centrality of review mechanisms to ensure that processes for prisoner selection, management, and release are optimised and enhanced to ensure future community safety and security.
