Abstract

Era Covid-19 kemarin semakin membuka dan membawa kita pada sistem kesehatan yang baru, reformasi system kesehatan yang ditunjang dengan kemajuan teknologi kini sudah tidak terelakan, pengenalan pelayanan Kesehatan berbasis digital jarak jauh (telemedicine) semakin menjamur dimasyarakat. Pemanfaatan teknologi informasi saat ini juga sangat luas, namun aspek keamanan data serta perlindungan pasien dalam hal ini juga sangat rentan. Perlindungan konsumen dari kejadian tidak diinginkan dalam praktik konsultasi Kesehatan ini sangat perlu diawasi oleh hukum yang jelas, bagaimana alur pelaporan serta pengaduan pasien jika mengalami kerugian dalam layanan ini. Keamanan data yang dipakai pada digitalisasi ini juga rentan dengan kejahatan cyber. Penulisan jurnal hukum perdata ini bertujuan untuk melakukan analisis terhadap hukum perdata yang berlaku mengenai perlindungan konsumen dalam pelayanan kesehatan berbasis digital jarakjauh (telemedicine) Hasil analisis pada penulisan jurnal ini menunjukkan perlindungan hukum terhadap praktik kedokteran ini perlu adanya kejelasan yang tertuju langsung pada pelaksanaan praktik telemedicine sehingga keamanan dari penggunan baik dalam hal data maupun kemungkinan kelalaian medis bisa dihindari.

Abstract

This study aims to determine the practicality and effectiveness of learning outcomes in PowerPoint-iSpring learning media that integrates multiple representation and prompting questions based on guided discovery learning. This research is a follow-up Research and Deevelopment (R&D) using the 4-D as the instructional model. The practicality and effectivity were obtained through research instruments is practicality questionnaire and formative test. Practicality was carried out by 10 students of class XII MIPA and two chemistry teachers at SMAN 5 Tebo, while effectivity was carried out by 28 students of class XI MIPA 3 SMAN 5 Tebo. The results of analysis on practicality data showed value of 90% (for teacher practicality) and 87% (for students practicality) both showing very practical category. The result of analysis on effectivity data showed the N-Gain value of 0,78 which was categorized as high, and the hypothesis test using the paired sample t-test showed that the learning outcomes of students after being given treatment were significantly higher than before being given treatment. Therefore, PowerPoint-iSpring learning media that integrates multiple representation and prompting questions based on guided discovery learning is practical and effective for the learning outcomes of students in class XI MIPA SMAN 5 Tebo.

Abstract

In the medical field, doctors are required to have a permit before performing medical procedures. However, doctors often encounter patients in emergency situations who cannot give consent and are not accompanied by family. This study aims to examine the implementation of informed consent in Indonesia to identify challenges and possible solutions. Through a literature review, this study uses a normative legal approach. Therefore, Law Number 17 of 2023, Article 293(9) exempts doctors from the obligation to obtain medical consent in emergencies. The result shows According to Article 275 paragraphs (1) and (2), doctors are also legally protected from payment demands after providing first aid to save lives or prevent disability. Because they offer an agreement on efforts and are exempt from legal responsibility if the patient’s goal is to be helped, doctors should not hesitate to act quickly in emergencies. This study found that Law Number 17 of 2023 provides doctors with legal protection to act without consent in emergencies, thereby reducing the risk of legal liability. The conclusion is that clear guidelines and ongoing legal education for medical personnel are essential to ensure safe and legal emergency care.
