Pengaturan Sistem Administrasi Badan Hukum (SABH) dalam Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas (UUPT) dalam rangka untuk mewujudkan kepastian hukum dan perlindungan hukum bagi para pihak pemangku kepentingan (stakeholders), belum sepenuhnya tercapai. Hal ini disebabkan praktik SABH tidak sejalan dengan pengaturan dalam UUPT dan peraturan pelaksanaan dari SABH telah beberapa kali mengalami perubahan. Fungsi pengesahan akta pendirian PT melalui SABH dalam praktik dihubungkan dengan kepastian hukum dan perlindungan hukum bagi para pihak pemangku kepentingan (stakeholders), hanya untuk memperoleh status badan hukum PT dan belum dilaksanakan sesuai prosedur hukum administrasi negara. Hal ini disebabkan Menkumham sebagai pihak yang berwenang menerbitkan keputusan badan hukum PT tidak melakukan pemeriksaan dokumen dan kelengkapan administrasi pemerintahan dari pemohon. Praktik SABH ke depan dalam pelaksanaan UUPT untuk dapat lebih mewujudkan kepastian hukum dan perlindungan hukum bagi para pihak pemangku kepentingan (stakeholders), harus ada kesesuaian antara pengaturan dan pelaksanaan sehari-hari. Legal Certainty and Protection for Stakeholders Concerning the Establishment of Limited Liability Company (PT) through the System of Administrative Of Legal Entity (SABH) Pursuant to Law Number 40 Year 2007 on Limited Company AbstractThe regulation for the System Administration of Legal Entity (SABH) in Law number 40 in 2007 on Limited Liability Company to provide legal certainty and protection for stakeholders has not yet been fully realized. This is because the practice of SABH is not accordance with the law on Limited Liability Company. Also, the regulation of the SABH has undergone multiple revisions. The ratification function for establishment of a Limited Liability Company through SABH in order to gain legal certainty and protection is often only done to gain the status of Limited Liability Company, while not heeding the administrative procedure. The Ministry of Law and Human Rights, as a body with the authority to grant the status of Limited Liability Company often does not conduct a proper document and requirement check to fulfill the administrative demand. Penelitian ini bertujuan untuk menganalisis praktik pelaksanaan akta jaminan fidusia yang dibuat dihadapan notaris menurut Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia dan untuk menganalisis kedudukan pemberi fidusia dalam pratik pelaksanaan akta jaminan fidusia. Jenis penelitian hukum normatif yang sumber datanya sekunder. Pendekatan yang digunakan Pendekatan Perundang- Undangan, Konseptual dan Kasus, hasil penelitian ini menegaskan bahwa dalam praktik pelaksanaan akta jaminan fidusia yang dibuat dihadapan notaris menurut Undang-Undang Nomor 42 Tahun 1999 tentang Jaminan Fidusia belum sepenuhnya menerapkan asas keseimbangan yang merupakan dasar dalam membuat perjanjian dan dalam menjalankan jabatannya, Notaris telah melanggar ketentuan Pasal 16 huruf m Undang- Undang Jabatan Notaris. Adapun kedudukan pemberi fidusia kedudukan pemberi fidusia dalam praktik pelaksanaan akta jaminan fidusia ada faktor yang menyebabkan ketidakseimbangan kedudukan pemberi fidusia adalah penyalahgunaan keadaan merupakan dimana akta jaminan fidusia dibuat tanpa adanya posisi tawar-menawar antara pemberi fidusia dan penerima fidusia. Sehingga menimbulkan itikad tidak baik dari penerima fidusia yang tidak memberi kesempatan kepada pemberi fidusia dan beberapa klausula dalam akta jaminan fidusia menunjukkan bahwa penerima fidusia bersikap lebih dominan dari pemberi fidusia. Pengaturan yang memberikan rasa adil bagi pemberi fidusia dalam praktik pembuatan akta jaminan fidusia oleh notaris, bahwa seharusnya notaris dalam pembuatan akta jaminan fidusia tersebut harus memperhatikan asas keseimbangan sebagaimana dalam Undang- Undang Jaminan Fidusia yang berpatokan dalam KUHPerdata yang mengacu pada asas kebebasan berkontrak yang berkaitan salah teori kontrak tawar-menawar dari yang merupakan indikator dari asas keseimbangan. Asas keseimbangan bagian dari asas kebebasan berkontrak berkaitan dengan perbuatan, isi, dan pelaksanaan akta jaminan fidusia. Untuk mencapai keadilan dalam pembuatan akta jaminan fidusia oleh notaris terutama berkaitan dengan klausula-klausula, Notaris harus haruslah membuat akta perjanjian fidusia selaras berdasarkan asas-asas umum perjanjian salah satunya asas keseimbangan menurut Herlien Budiono agar salah satu pihak tidak merasa dirugikan yang mana isi klausula-klausula perjanjian tersebut diketahui penerima dan pemberi fidusia.

Settlement of health consumer disputes is an important issue in the health system because it is directly related to consumer rights and the quality of health services. Mediation and arbitration are two alternative dispute resolution methods that can be used in cases like this. The aim of this research is to analyze the effectiveness of mediation and arbitration in resolving health consumer disputes. This study used qualitative research methods. The data collection technique in this research is literature study. The data that has been collected is then analyzed in three stages, namely data reduction, data presentation and drawing conclusions. The research results show that mediation is considered effective in resolving health consumer disputes, while the effectiveness of arbitration depends on the expertise of the arbitrators, especially in cases that require special technical knowledge. Mediation tends to be more effective and efficient in resolving disputes because it can help disputing parties to reach an agreement voluntarily with the help of a mediator. However, mediation results are not final and usually require agreement from both parties to be binding. On the other hand, arbitration offers higher legal certainty because the decision is final and binding. However, the arbitration process tends to be more formal, time consuming, and more expensive than mediation. Therefore, the choice between mediation and arbitration must consider the needs and preferences of each party to the dispute.

The purpose of the study is to the legal impact of medical accidents on the rights of patients as hospital consumers and to find out how the obligations, rights and responsibilities of hospitals to consumers of health services. This research uses normative juridical research methods, namely research that emphasizes legal science but besides that it also refers to laws and regulations and examines the rules that apply in society. The approach used is a statutory approach and an analysis approach and reviewing articles, namely by reviewing and analyzing from several literature references. The data collection technique in this study is by literature study. The data analysis technique used in this study is a systematic qualitative analysis using deductive methods by drawing conclusions from general to specific with keywords legal impact, medical accidents, hospital consumer rights. As a result, the hospital's legal responsibility to patients in the effort of medical services can be in the form of responsibility for making mistakes and omissions that cause harm not only to themselves but also to others under their supervision and responsibility for losses suffered by consumers due to negligence of hospital services.

The relationship between doctor and patient is a relationship based on the law. Practically, both doctor and patient have the same potential to experience loss or disadvantages due to one of the parties violate the obligations and rights. Treatment of disease that involves two parties – the health service provider and the patient – should be protected by law. It is to embody the highest degree of health for the community in order to achieve a strong, healthy, and productive nation. The aim of this writing is to know all matters concerning the state regulation of relationship between doctor and patient, including each party’s obligations and rights as well as legal protection for both doctor and patient. Method of this writing is qualitative descriptive by collecting data and information based on health laws in Indonesia, as well as literature research. Other source of data and information are from relevant writing such as scientific journal, thesis, books and other electronic media.

Era Covid-19 kemarin semakin membuka dan membawa kita pada sistem kesehatan yang baru, reformasi system kesehatan yang ditunjang dengan kemajuan teknologi kini sudah tidak terelakan, pengenalan pelayanan Kesehatan berbasis digital jarak jauh (telemedicine) semakin menjamur dimasyarakat. Pemanfaatan teknologi informasi saat ini juga sangat luas, namun aspek keamanan data serta perlindungan pasien dalam hal ini juga sangat rentan. Perlindungan konsumen dari kejadian tidak diinginkan dalam praktik konsultasi Kesehatan ini sangat perlu diawasi oleh hukum yang jelas, bagaimana alur pelaporan serta pengaduan pasien jika mengalami kerugian dalam layanan ini. Keamanan data yang dipakai pada digitalisasi ini juga rentan dengan kejahatan cyber. Penulisan jurnal hukum perdata ini bertujuan untuk melakukan analisis terhadap hukum perdata yang berlaku mengenai perlindungan konsumen dalam pelayanan kesehatan berbasis digital jarakjauh (telemedicine) Hasil analisis pada penulisan jurnal ini menunjukkan perlindungan hukum terhadap praktik kedokteran ini perlu adanya kejelasan yang tertuju langsung pada pelaksanaan praktik telemedicine sehingga keamanan dari penggunan baik dalam hal data maupun kemungkinan kelalaian medis bisa dihindari.

In realizing Universal Health Coverage (UHC), Indonesian government has launched a national health insurance program (JKN) organized by the Health Social Security Administering Agency (BPJS) starting from January 01, 2014. The policy of determining outpatient episodes for patients in the emergency department (ED) who receive treatment for less than 6 hours raises problems related to claims for services provided by service providers. Hospitals are required to provide health services in emergency situations to save lives and prevent disabilities, while also having profit objectives. This research aims to describe the output and impact in relation to the regulations. The research uses normative legal research methods with statute approach, conceptual approach and a non-judicial case study approach, presenting several cases related to discrepancies between ER services provided and claims paid, especially for patients who die in the ER within 6 hours, which is suspected to cause hospitals to be selective in handling emergency patients. The Minister of Health Regulation No. 27 of 2014 regarding INA-CBG creates dilemmas and challenges for hospitals in providing optimal services for emergency cases in the ER.

This study aims to explore the application of consumer protection law to health access services from the perspective of society. The research method used is qualitative with a descriptive approach. Primary data were obtained through interviews and observations, while secondary data were obtained from relevant literature reviews. The results showed that healthcare users in community health centers experienced variations in satisfaction, selection factors, quality of service, problems faced, and consumer protection. The main factors influencing the selection of a health center are location, quality of service, and reputation. Although most respondents were satisfied with the friendly and efficient service, they also complained of a lack of information and slow administrative processes. Variations in assessments of service quality include medical staff competence, waiting times, and levels of coordination. Problems include excessively long waiting times, lack of clear information, and lack of communication between medical staff and administration. Consumer protection is also a concern, especially related to access to patient rights information and the fulfillment of these rights.

Legal protection for tumor surgeons in facing chemotherapy side effects in breast cancer patients is essential in contemporary medical practice. This study employed a narrative method and legal approach to explore the legal protection available to tumor surgeons in addressing risks and side effects during chemotherapy services. The narrative method was used to explore the role of the law in protecting tumor surgeons and providing a clear framework for addressing side effects in chemotherapy services. Literature analysis regarding medical practice standards, professional responsibilities, and relevant legal cases were used to formulate a comprehensive perspective of this legal protection. The research highlights the need for meticulous documentation of procedures, risks, and patient consent before undergoing chemotherapy. Additionally, legal protection also depends on adherence to applicable medical practice standards and effective communication between tumor surgeons and patients. In conclusion, the understanding of tumor surgeons is needed for the legal implications of their medical practices, including in the context of chemotherapy services. Thus, the use of narrative methods in this study provides valuable insights for tumor surgeons to protect themselves and provide safe and quality services to breast cancer patients.
