Abstract

Kecamatan Liwa Kabupaten Lampung Barat merupakan salah daerah yang memiliki Sentra IKM kopi, yang memproduksi dan memasarkan berbagai jenis produk olahan kopi. Guna memberikan kepastian hukum dan perlindungan hukum, pelaku usaha pada IKM kopi Liwa mesti memiliki legalitas usaha. Namun masih terdapat IKM kopi Liwa yang belum memiliki legalitas usaha, maka dari itu kegiatan pengabdian ini penting untuk dilakukan. Kegiatan ini bertujuan untuk memberikan pendampingan pada pelaku usaha IKM kopi Liwa dalam memperoleh legalitas usaha. Untuk mencapai tujuan tersebut, kegiatan pendampingan ini dilakukan dengan metode sosialisasi mengenai pentingnya legalitas usaha, diskusi, dan praktik mengurus legalitas usaha bagi IKM kopi. Hasil kegiatan menunjukkan bahwa masyarakat pelaku usaha IKM kopi Liwa mampu mengurus legalitas usaha diantaranya adalah Sertifikasi Standar Nasional Indonesia (SNI) dan sertifkasi halal. Selain itu masyarakat pelaku usaha IKM kopi Liwa selaku mitra kegiatan, sudah memahami persyaratan dan alur pendaftaran sertifikasi PIRT, dan Sertifikasi Halal.

Abstract

Tourism development policies in the current era of decentralization have begun to be regulated in various legal instruments of regional autonomy. However, there is still substantial disharmony between the tourism development policies of the central government and regional governments. Consequently, there is an overlapping of policies and the emergence of sectoral egos that cause the development of the tourism sector to become unsustainable. This study aims to analyze the dynamics of the legal politics of tourism development in the regional autonomy regime, as well as to find a model of harmonization of the legal politics of sustainable tourism development in the regional autonomy regime. This study uses a doctrinal legal research method by examining the doctrine, legal principles, theories, and legal rules of tourism development and regional autonomy in Indonesia. Data processing is done through examination, classification, and systematization of legal materials. Furthermore, the data is analyzed descriptively-analytically. The results of the study indicate that the legal politics of tourism development in the regional autonomy regime have not fully reflected the legal politics of tourism development based on sustainability. Regions are given the authority to organize affairs in the tourism sector.

Abstract

Surety bond merupakan jaminan tiga pihak yang banyak digunakan dalam kontrak konstruksi di Indonesia untuk menjamin pelaksanaan kewajiban kontraktor. Artikel ini menganalisis dasar hukum surety bond dalam sistem hukum Indonesia, perbedaannya dengan bentuk jaminan lain (seperti bank garansi dan jaminan tunai), karakteristik hubungan hukum antara principal (kontraktor), obligee (pemberi kerja), dan surety (penjamin), serta implikasi hukum apabila terjadi wanprestasi oleh kontraktor. Kajian ini menemukan bahwa surety bond bersifat accesoir (tambahan) terhadap kontrak pokok dan lazimnya bersifat jaminan bersyarat (conditional), berbeda dengan bank garansi yang bersifat tanpa syarat (unconditional). Dalam hal kontraktor wanprestasi, obligee berhak mencairkan surety bond sesuai prosedur yang diatur, sedangkan perusahaan penjamin memiliki hak subrogasi terhadap kontraktor. Namun, terdapat tantangan hukum dalam praktik, antara lain belum sinkronnya pengaturan mengenai hak subrogasi penjamin dan kebutuhan agar pencairan klaim surety bond dapat berlangsung on demand demi kepastian hukum. Artikel ini juga menyinggung perkembangan yurisprudensi nasional terkait sengketa surety bond serta perbandingan singkat dengan praktik penjaminan di beberapa negara Asia Tenggara. Pada akhirnya, dibutuhkan kejelasan regulasi dan penegakan hukum yang konsisten agar surety bond efektif memberikan perlindungan hukum dalam sektor konstruksi.

Abstract

Technological advancements and globalization transform legal issues into increasingly complex and cross sectoral matters; however, legal education frequently remains entangled in fragmented approaches. This community outreach initiative aims to enhance student awareness regarding the significance of multidisciplinary perspectives in comprehending contemporary legal dynamics through air law case studies. Air law was selected due to its inherently intersecting nature across various regimes, encompassing civil, criminal, administrative, international, and technological law. The implementation method was conducted via interactive workshops involving initial perception measurements, material delivery based on andragogy, and air taxi case analysis simulations. Outcomes indicate a paradigm shift among participants, transitioning from sectoral thinking tendencies toward the capability to identify interconnected legal dimensions within concrete events. Final evaluations demonstrate that this problem based learning intervention effectively broadens students legal reasoning scope for future professional challenges. Integrating innovative case studies serves as a catalyst in deconstructing linear mindsets toward an integrative understanding.

Abstract

Although the issue of personal data protection in the banking sector has received attention in various studies, studies that specifically examine the integration of the normative, ideal, and factual roles of banking in preventing phishing crimes remain limited. This study aims to analyze the role of Bank Mandiri in protecting customer data security from phishing crimes and to evaluate the effectiveness of legal protection based on laws and regulations in Indonesia. This study employed a qualitative approach with a case study design through a normative juridical method. Data were collected through library research and document analysis, and were then analyzed using descriptive-analytical techniques. The results show that Bank Mandiri has implemented comprehensive protection measures, including compliance with regulations, the use of advanced security technology, and customer education. In addition, the legal framework in Indonesia has provided preventive and repressive protection through various regulations governing data protection and cybercrime. These findings contribute to the development of legal protection theory and institutional responsibility in cybersecurity governance. This study concludes that synergy among banking institutions, regulators, and customers plays an important role in minimizing phishing risks. Therefore, improvements in cybersecurity infrastructure and the strengthening of digital literacy programs are needed to reinforce the protection of customer data. The implications of this study include theoretical contributions in the field of law and practical recommendations for strengthening data protection policies, while also opening opportunities for further studies on cross-sector collaboration and technological innovation in the financial sector.
