Abstract

Regulations on filling the position of village head in the event that there is a vacancy in a village head official in Article 47 of Law Number 6 of 2014 concerning Villages states that the Regent/Mayor has the authority to appoint a Civil Servant from the Regency/City regional government as Acting Village Head in lieu of the vacant Village Head in order to continue to carry out government in the village, until a new village head is elected. The legal consequences if the position of village head is not filled by a definitive official will result in the village not functioning properly in accordance with the objectives of the government and the village community in particular, which will result in negative impacts such as instability in village conditions. A Village Head who can definitively carry out his position in accordance with existing laws and regulations, will revive the functions and carry out the village mission optimally which will bring the village he leads into a better village. So the Village Head has an important influence on the dynamics of village government administration

Abstract

This research started from the construction of the new National Capital City of the Nusantara which has not yet been completed and requires a very large budget. In this regard, a financing model is needed that can be used as an alternative financing for the development of the new National Capital City. The aim of this research is to find the characteristics of sharia crowdfunding as an alternative financing in the process of building the new National Capital City. The research method used is a normative juridical research method with a statutory and a conceptual approach. The results of this research show that there are several characteristics of sharia crowdfunding as an alternative financing for the development of the New National Capital, namely: it is only intended for halal projects and products so that it complies with sharia principles and is free from interest rates; there is fairness in the distribution of profit and loss margins using a profit-sharing system; and supervised by the Sharia Supervisory Board.

Abstract

In principle, sports are carried out physically in gyms and fields, which are often done by the public. However, nowadays, with the progress and development of technology, sports can be done not physically and sweating, but simply with intelligence and technological sophistication, for example online games. In such sports, the existing regulations are not yet able to regulate it in its entirety so that if there is a violation of the online game protocol there is no clear legal payment as a reference in providing and making legal decisions. The existing Sports Law, namely Law 11/2022, does not yet accommodate this, so clear concepts and laws are needed to avoid a legal vacuum. The research results require the existence of a clear legal format to regulate and at the same time limit online games, which have been subject to many violations and restrictions. In conclusion, there is a need to revise and update regulations relating to sports in relation to technology.

Abstract

This research focuses on the situation of food needs in the new National Capital due to the increasing number of population movements. Its purpose is to analyze the role of the government in realizing proposed food self-sufficiency based on syirkah bi al-muzāra’ah scheme in the Nusantara Capital City area. It used an empirical juridical method that examines the correlation between the principles of sharia economic law and the place or environment studied, namely the Nusantara Capital City. The results of this study show that the role of the government in realizing proposed food self-sufficiency based on the syirkah bi al-muzāra’ah contract in the Nusantara Capital City is evident from 3 (three) elements in the theory of the legal system, namely: First, the legal structure in which the government plays a role as a provider of capital (ṣāḥib al-māl) and infrastructure in realizing food self-sufficiency. Second, the legal substance requires the role of the government in forming strong regulations to achieve food sufficiency in the Nusantara Capital City area. Third, the legal culture so that the concept of syirkah bi al-muzāra’ah can be carried out by complying with local customary norms that are harmonized with sharia principles.
