Abstract

This study aims to analyse the synchronisation of regulations concerning the dismissal and reinstatement of Civil Servants (PNS) involved in narcotics-related criminal offences, by examining the alignment between Government Regulation (PP) Number 94 of 2021 on Civil Servant Discipline and the Regulation of the Head of the National Civil Service Agency (BKN) Number 3 of 2020 on Technical Guidelines for the Dismissal of Civil Servants. The study employs a normative legal research method with a statutory approach and the general principles of good governance (AUPB). The findings reveal a lack of harmony between these two regulations, as PP 94/2021 stipulates dismissal as a severe disciplinary sanction for civil servants involved in drug abuse, whereas BKN Regulation 3/2020 allows for reinstatement under certain conditions. This inconsistency has the potential to create legal uncertainty and opens the door for subjectivity in the implementation of civil service policies. To ensure legal certainty, this study recommends regulatory harmonisation through a revision of BKN Regulation 3/2020 to align more closely with PP 94/2021. Furthermore, there is a need for stricter standard operating procedures (SOPs), a transparent oversight mechanism, and enhanced capacity-building for personnel management officials in applying the principles of good governance. These measures are expected to ensure legal certainty while supporting a more professional and integrity-driven bureaucratic reform.

Abstract

This study analyzes the governance of mining resources in Indonesia through the lens of Maqasid al-Sharia as a normative foundation to reconstruct coal mining licensing systems toward a welfare-oriented model. The current framework, despite legislative reforms under Law No. 4 of 2009 and Law No. 3 of 2020, continues to grapple with environmental degradation, regulatory fragmentation, and unequal resource distribution. Using a normative legal research method, the research examines statutory regulations, Islamic legal doctrines, and principles of maslahah (public benefit), ‘adl (justice), and hifz al-mal (protection of wealth) within the context of Article 33 of the 1945 Constitution. The historical evolution of mining regulation, from colonial concessions to the centralized IUPK system, reveals a persistent tension between economic exploitation and public welfare. This study proposes a reconstruction of mining governance that integrates Islamic legal objectives to ensure justice, environmental protection, and inclusive development. By embedding Maqasid al-Sharia within the legal framework, mining governance can be redirected toward the public good and sustainable state stewardship.

Abstract

The Authority of the Notary Honorary Council from an Administrative Law Perspective. This study aims to determine and analyze the existence of the Notary Honorary Council within the notary profession. Furthermore, it aims to determine and analyze the authority of the Notary Honorary Council regarding Notaries involved in criminal cases. This legal research uses normative legal research or library legal research. This research is prescriptive in nature. The research approaches used are the Statutory and Conceptual Approaches. The Notary Supervisory Council's role in supervising Notaries before the enactment of Law No. 30 of 2004 was carried out by the Court, as stated in Staatsblad 1860 concerning the Regulations on the Position of Notaries. After Law No. 30 of 2004, supervision of Notaries was carried out by the Regional Supervisory Council. After Law No. 2 of 2014, the Notary Honorary Council was created as a replacement for the Regional Supervisory Council, with the same function: approving or rejecting summonses issued by law enforcement officers for Notaries. The authority of the Notary Honorary Council in criminal proceedings involving Notaries highlights the potential dilemma between the obligation to maintain professional confidentiality and to provide testimony, as well as the problems that arise, especially at the investigative stage, regarding the approval of the Notary's summons. The procedure for summoning a Notary that requires the approval of the Notary Honorary Council has the potential to conflict with the principles of simple, fast, and low-cost justice, as well as the principle of equality before the law.

Abstract

The purpose of this research is to analyze the registration of Second-Ranking Electronic Mortgage (Hak Tanggungan) over collateral objects that have undergone an administrative change in their urban village (kelurahan) designation, with a case study in Selat Subdistrict, Kapuas Regency. The type of research used is normative legal research, which involves inventorying and analyzing statutory regulations. The nature of the research is prescriptive-analytical, aimed at finding legal solutions to existing issues from the perspective of the researcher.The first research finding reveals that the registration of a second-ranking electronic mortgage over a collateral object that has experienced a change in administrative location (from Selat Tengah to Selat Barat) cannot be carried out if the first-ranking mortgage has already been registered. This is because an administrative update to the collateral object’s location must first be conducted. In the Computerized Land Activities System (KKP), a collateral object already encumbered by a first-ranking mortgage is registered as an active mortgage record until that activity is concluded through a mortgage release (roya). Therefore, to update the location from Selat Tengah to Selat Barat, the existing mortgage record must be closed first. The second finding shows that, as an effort to maintain their position as the holder of the first-ranking mortgage, the creditor may based on the Mortgage Law (UUHT) ssue a Power of Attorney to Grant Mortgage (SKMHT) in accordance with Article 15 of the UUHT, followed by the release of the first-ranking mortgage based on Article 18 paragraph (1) letter b, which allows the mortgage to be released by the mortgage holder. Afterward, the administrative location update of the collateral object from Selat Tengah to Selat Barat can be processed. Once the data has been validated, the creditor can then execute a new Deed of Granting Mortgage (APHT) to re-register the first-ranking mortgage based on the SKMHT.

Abstract

Penelitian ini membahas kampanye hitam di media sosial dalam konteks regulasi hukum media social di Indonesia yang diatur oleh Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE) serta Undang-Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum (UU Pemilu). Dengan metode hukum normatif yang bersifat deskriptif serta menggunakan pendekatan perundang-undangan dan konseptual, peneliti mencari dan mengumpulkan peraturan perundang-undangan yang berkaitan dengan Pemilihan Umum dan Media Sosial dan mengikuti setelahnya penguatan teori dari buku-buku atau literatur hukum diikuti dengan alat pengumpul data studi lain berupa dokumen.Fokus utama penelitian ini adalah adanya konflik hukum antara Pasal 28 UU ITE dan Pasal 280 UU Pemilu, yang mana keduanya mengatur sanksi dan ketentuan hukum yang berbeda terhadap tindakan yang serupa, yaitu kampanye hitam di media sosial. Analisis ini dilakukan untuk mengidentifikasi dan memahami perbedaan dan potensi konflik dalam penerapan kedua undang-undang tersebut, serta implikasinya terhadap penegakan hukum di Indonesia. Hasil penelitian ini diharapkan dapat memberikan rekomendasi untuk harmonisasi regulasi guna menciptakan kepastian hukum yang lebih baik bagi masyarakat dan penyelenggara pemilu.

Abstract

The purpose of the study is to analyze and study the laws and regulations that accommodate the protection of karst ecosystems. In addition, this study also aims to analyze the government's actions that are considered negligent because they do not follow up on the mandate of Law number 32 of 2009 concerning Environmental Protection and Management to make implementing regulations through Government Regulations regarding the standard criteria for damage to karst ecosystems whether they are included in illegal acts by the government. This research is a normative legal research, which is a research using a statutory and conceptual approach. According to the results of this study, it was found that there had been a legal vacuum after the promulgation of the UUPPLH. According to the UUPPLH, the government should issue a legal product of a technical and implementing nature in the form of a Government Regulation regarding the standard criteria for damage to the karst ecosystem to determine the extent of damage that can be tolerated by the ecosystem. As long as technical rules have not been promulgated regarding the standard criteria for damage to karst ecosystems, then as long as environmental law enforcement against damage to karst ecosystems due to mining is quite difficult to enforce. The absence of implementing regulations regarding the standard criteria for damage to karst ecosystems can be categorized as unlawful acts by the government (Onrechtmatige Overheidsdaad) because there are legal norms that state that government actions are actions carried out and/or not carried out by the government in order to carry out government. So that if the government's actions can be detrimental and potentially detrimental to the constitutional rights of citizens, it can be classified as an unlawful act by the government.

Abstract

Regulations regarding the GPS technology system in measuring and mapping land as a result of factual verification can cause corrections to the physical data and legal data in the certificate. Regarding this incident, if legal protection is based, the guideline is the certificate. The certificate as a BPN product refers to Article 19 UUPA jo. Article 32 paragraph (2) of the PP on Land Registration is valid evidence, except through cancellation by the BPN or annulment of the PTUN decision. In this case, the principle of Lex Superior Derogat Legi Inferiori applies, namely that higher regulations override lower regulations. If based on legal certainty, the results of factual mapping with GPS are the most valid physical and juridical land data and can be legally accounted for. The validity of the physical data and juridical data from this factual verification can be used as a basis for determination by BPN. This means that the principle of Lex Specialis Derogat Legi Generali applies, namely specific regulations override general regulations.
