Abstract

The study reviewed the development of the digital era in the legal field, especially The Electronic General Meeting of Shareholders (GMS), which is ruled by law. The problem formulation was how the electronic GMS, according to positive law in Indonesia, and how the impact on the notarial deed related to its implementation. The method used by the researcher was normative and library study based on the primary material (legislation), secondary material (scientific works, journals, books, documents, and other literature), and tertiary legal materials (legal dictionaries). The study results were that E-GMS is effective today, then regulated in Art 77 UUPT and PJOK Number 16/Pojk.04/2020, so that the Limited Liability Company members can carry out the GMS as usual without being physically present to break the chain of the Covid-19 pandemic. Although the e-GMS arrangements have been regulated in the legislation, the lex specialist derogat lex generalist principle cannot be ignored; article 16 paragraph (1) letter (m) and Article 18 UUJN are still prioritized so that the electronic deed of the GMS cannot be carried out or will resulting in the legal force of the proof being a private deed.

Abstract

Peneliti tertarik mengkaji suatu penelitian hukum yang berjudul Kekuatan Objek Jaminan Instansi dalam Ajuan Kredit Platform E-commerce Shopee Pinjam, dengan objek penelitian berupa peraturan perundang-undangan dan peraturan kredit pada aplikasi Shopee. Jaminan merupakan salah satu prinsip penting yang perlu dipenuhi dalam ajuan kredit, baik konvensional maupun online. Jaminan mempunyai berbagai bentuk diatur dalam KUHPerdata dan peraturan perundang-undangan lainnya. Salah satunya yaitu jaminan penanggungan. Adapun penelitian ini ditujukan untuk membahas tentang bagaimana kekuatan objek jaminan instansi yang diajukan dalam kredit online. Penelitian ini menggunakan metode normatif yaitu mengkaji isu hukum didasarkan pada peraturan perundang-undangan, menggunakan bahan hukum primer, sekunder dan tersier. Hasil penelitian ini yaitu dalam ajuan kredit online, pada aplikasi Shopee Pinjam, debitur yang menginput data pribadi termasuk tempat bekerja dan pendapatannya setiap bulan, secara tidak langsung instansi tersebut terikat menjadi jaminan penanggungan untuk diharapkan dapat membantu proses somasi atau penagihan terhadap debitur apabila suatu hari ia wanprestasi.

Abstract

Technological developments have an impact on aspects of human life. One of them is in the economic sector. Initially, people applied for conventional loans through financial institutions or financial institutions, but now it is made easier with the presence of financial technology platforms. The convenience offered in online loan applications is a double-edged sword; if people lack understanding, it could result in them being caught in a case. This service aims to provide information and insight regarding the characteristics of legal fintech so that people avoid things that are detrimental to them. The method used in this community service consists of three stages: preparation, implementation of legal counseling, and evaluation, which are done by holding a post-test. As for the results of this community service, initially, the audience needed help understanding the difference between legal and illegal fintech; now, they can differentiate between the two and are more careful when applying for loans or receiving online loan offers.

Abstract

The development of information technology has driven fundamental transformations in legal practice and the working patterns of the legal profession. The digitalization of the judiciary through e-Court, the use of social media, and online legal communication have reshaped the way advocates deliver legal services. These developments enhance efficiency and access to justice; however, they also generate new ethical challenges that may undermine the integrity and professionalism of advocates. The Indonesian Advocates’ Code of Ethics, as a normative instrument, is required to remain relevant to the evolving dynamics of digital legal practice. This study examines the relevance of ethical regulations in responding to digital legal practices and the need for their reinterpretation to preserve the dignity of the legal profession. The research employs a normative legal method with statutory and conceptual approaches. The findings indicate that conventionally oriented ethical regulations have not fully addressed ethical issues arising in digital spaces, particularly concerning social media, online publications, and the use of artificial intelligence. Therefore, a reinterpretation of the code of ethics that is adaptive to technological developments is necessary, without abandoning the values of officium nobile, in order to strengthen public trust in the legal profession.

Abstract

The transformation of legal services through the implementation of the E-Court system is part of judicial modernization aimed at realizing effective and inclusive access to justice. This study seeks to analyze the regulation of cross-regional jurisdiction under Supreme Court Regulation (PERMA) Number 1 of 2019 and to examine the challenges of digital infrastructure in providing access to justice for civil litigants in remote areas. The research employs a normative juridical method with statutory and conceptual approaches. The findings indicate that PERMA Number 1 of 2019 enables the implementation of e-summons and electronic hearings without eliminating the court’s authority based on territorial jurisdiction. However, its effectiveness still depends on the consent of the parties and technical readiness. On the other hand, limitations in internet connectivity, technological devices, and digital literacy in underdeveloped, frontier, and outermost (3T) regions create disparities in access to justice. This study concludes that the transformation of legal services through E-Court requires regulatory strengthening, the development of digital infrastructure, and the implementation of a hybrid service model to ensure that the principles of justice, legal certainty, and utility are equitably realized for all people across Indonesia.
