Abstract

Amendments of UUD 1945 Constitution to change the state system of Indonesia, including changes in state institutions, especially institutions MPR. After amendment of 1945 Constitution, MPR position parallel with other state institutions, and the authority of MPR also changed. MPR no longer as the highest state institutions and actors sovereignty of the people so that their authority is very limited. MPR no longer authorized to elect the President and Vice President, and is no longer authorized to establish GBHN. By not competent MPR sets GBHN, then MPR is not authorized to establish to form TAP MPR. It becomes polemic when Law No. 12/2011 2011 places TAP MPR to the kind and hierarchy of Laws and Regulations. Therefore, This research will analize the development of position of TAP MPR related to authority of MPR, then reconstructed to the position of TAP MPR on Indonesia’s constitutional system. The method used to analyze is normative. In the reconstruction of the position of TAP MPR carried by the fifth amendment of the 1945 Constitution to strengthen the MPR institutions and give the highest authority MPR, one of which is to develop a state policy that is poured into legal products MPR.

Abstract

The problem of this public service is how to realize the autonomicpeople power to do the advocate of environment in order to overcomethe environmental conflict. In the training of the advocate of environment,the victims of pollution—most of them are farmers and low educatedpeople— are very enthusiastic to join the training. They are curious toknow how to struggle for their polluted environment as the result of themisconduct of irresponsible companies. In the effort of this advocate ofenvironment, the NGO “Gita Pertiwi” also gives significant contribution.It tends to cooperate with the society in order to do the advocatingprocess. Yet, the previous activity is conducting dialogues with the societyabout the pollution problem. Besides, they attempt to facilitate the societyto figure and find out the solution of the problem.

Abstract

Kebijakan perizinana lingkungan dan kepentingan investasi disorot oleh banyak pihak, dianggap mempunyai andil besar yang menyebabkan krisis  lingkungan di negeri ini. Perusakan dan pencemaran bidang lingkungan yang dilakukan pelaku usaha/industri dapat ditelusuri dari berbagai kebijakan pemberian perizinan lingkungan, seperti pendirian pabrik semen, penebangan HPH, reklamasi pantai, tambang  batubara, emas dan lain lain. Perizinan lingkungan yang menimbulkan sengketa lingkungan apabila tidak bisa diselesaikan melalui hukum administrasi semata tetapi dapat juga dilakukan melalui hukum perdata bahkan pidana. Pembuktian hukum perdata biasa memerlukan pembuktian mengenai unsur hubungan sebab akibat,  yang didasarkan pada dalil liabality base on fault  dinilai akan memberatkan pihak yang melakukan gugatan. Karena itu dengan berkembangnya industrialisasi yang menghasilkan resiko yang bertambah besar serta makin rumitnya hubungan sebab-akibat, maka teori hukum telah meninggalkan konsep “kesalahan” dan berpaling ke konsep “resiko” yang menekankan pada tangung jawab mutlak dengan didasarkan pada asas liability base on risk. Model ke depan dalam penyelesaiaan sengketa perizinan lingkungan yang melibatkan masyarakat, pemerintah atau dunia usaha akan lebih baik apabila dilakukan melalui lembaga alternatif, dirancang melalui lembaga mediasi  berdasarkan win win solution. Model penyelesaiaan ini merupakan model penyelesaiaan yang efisien, murah, cepat dan mampu menghasilkan keputusan yang lebih baik. Kata Kunci : Perizinan lingkungan, Gugatan masyarakat dan Penyelesaian sengketa.

Abstract

Hukum merupakan refleksi atau cerminan ideologi yang dianut oleh suatu negara, dengan demikian Pancasila sebagai ideologi negara Indonesia harus bisa terakomodasi dalam setiap peraturan perundang-undangan yang ada di Indonesia. Titik rawan dari pembentukan hukum agar sejalan dengan prinsip-prinsip negara hukum Indonesia adalah pada pengaruh dan perkembangan pemahaman dari negara lain. Penelitian ini bertujuan untuk merumuskan konsep kedudukan Pancasila sebagai sumber dari segala sumber hukum dan sebagai norma dasar negara yang tercermin dalam setiap produk hukum di Indonesia. Dengan menggunakan pendekatan penelitian yuridis normatif dan pendekatan konseptual, menunjukkan bahwa pemahaman filosofis terhadap arti Pancasila sebagai sumber dari segala sumber hukum, dapat berarti sumber pengenal yang terkonsep sebagai lembaga pembentuk hukum dalam dimensi pencarian, dan berarti sebagai sumber asal yang menjadi penyebab terbentuknya aturan hukum dalam dimensi justifikasi hukum. Pancasila sebagai sumber nilai, mengandung nilai-nilai yang dijadikan sumber dalam merumuskan norma hukum. Nilai-nilai tersebut dipostulatkan sebagai norma dasar dalam tata hukum Indonesia sebagai landasan unsur konstitutif dan regulatif

Abstract

Lombok is one of the islands of West Nusa Tenggara province with enormous tourism potential, from nature, beaches and culture. So that if this is developed properly it will bring prosperity to the Lombok people in particular and NTB in general. Tourism development policies have not been widely felt to bring effects to welfare to the community. The purpose of this study is to provide an overview of policies and implementation of tourism development policies on tourism on the island of Lombok. Data was collected by observation and interviews. From these data, then analyzed descriptively qualitatively, the data formed becomes a description that describes a situation or event described. Based on the results of the analysis of tourism development policies in Lombok island, it is inseparable from the four tourism pillars contained in regional regulations, namely tourism, marketing, industry and institutional development. The implementation of the policy has not maximally affected the welfare of the people on the island of Lombok, and has even caused new problems in the lower classes.

Abstract

Introduction: Every law is a system which means law bases on the unity of the mind. Customary law is understood as a law that lives in a “living law” society, legal values and a sense of justice that lives in society. All takes place after the values lived by the society under the filter of legal ideals and moral ideals prevailing in the society concerned. Without the law as an effective social control, humans potentially can lead to behavior that can bring destruction to humans. In Bengkulu, the law that lives in the community is known as the law of adat dapek salah. Violation of the law can be acts of a person or group of people who disturb the balance in the indigenous peoples. The violation of the law is an act of deviant behavior that is negative in which each culprit will be charged with various kinds of traditional sanctions. The research of forensic psychology analysis is needed to see the behavior of customary criminal crime in violation of customary law. The assessment is carried out to provide an overview of the mental state of the offender. This is in line with forensic psychology as the study of subjects in terms of cognitive, effective and behavior in relation to the legal process. Material and Method: This research is a qualitative research which produces descriptive data in the form of written or oral words from people and observed behavior. Qualitative research is also called naturalistic research. This study departs from naturalistic inquiry whose findings are not found from statistical calculations. Findings: Customary law of Dapek Salah in Bengkulu as a social model directs to accommodate the entire social system which includes the function of norm system. The function of norm system is to correct behavior that deviates from the relevant rules (violations). These rules are the framework of human behavior orientation (members of the social system). Norms are also often referred to as rules of conduct and blueprints for behavior in a society. This can also lead to anti-social behavior or asocial behavior which could be a factor causing criminal behavior. Criminal behavior toward the Dapek Salah law is an act that causes adverse reactions and corrections and the balance of the community. In the study of forensic psychology analysis, criminal behavior on the law depends on the perception of the respective actors. Aspects of perception consist of cognitive aspects (thoughts), affective aspects (feelings), and aspects of conation (behavior). Individual perceptions can influence and motivate subsequent behavior, if the object of perception is judged unpleasant then the behavior is negative. Conclusion: Violation of the Dapek Salah is a phenomenon, a person or group of people who violate customary law (criminal behavior) so as disturbing the balance in indigenous peoples’ value. In the forensic psychological analysis, criminal behavior of the law depends on the perception of the respective actors. Aspects of perception consist of cognitive aspects (thoughts), affective aspects (feelings), and aspects of conation (behavior). Individual perceptions can influence and motivate subsequent behavior, if the object of perception is judged unpleasant then the behavior is negative. In the basic concept of psychology, there is something wrong with the minds of the perpetrators so that they are involved in criminal behavior. Imbalance relationship between Id, Ego and Superego makes humans weak and consequently more likely to commit deviant behavior or criminal behavior.

Abstract

Introduction: Sexual violence is one of the morbidities and mortality factors in women. Sexual violence of women causes physical and physiological sequences that make them vulnerable to health problems. Material and method: It was normative legal research with a literature study and document study as a method to collect the research data. Findings: Marital sexual abuse or the highest personal relation was incest with 1,071 cases followed by raping with 818 cases, and molestation with 321 cases. Meanwhile, marital rape reached 195 cases. The forms of sexual violence consist of sexual harassment, sexual exploitation, coercion of contraceptive use, compulsion in abortion, rape, marital compulsion, prostitution, sexual bondage, and sexual torture. The protection against victims of sexual violence was considered to be not optimal due to a lack of public understanding of the causes and effects of sexual violence. Conclusion: So far, the legal protection against women in sexual violence cases have not been optimally implemented. The minimum legal protection triggered impunity, reoccurrence, and even the victims’ frustration to accept justice and recovery.

Abstract

Purpose of the study: This article aims to discuss the paramedic doctoroid practices in primary health care in Community Health Center conducted by paramedic doctors.Methodology: This research is socio-legal research; research on law application, viewing law acting as law in action, which involves the interrelation between law and social institutions.Main Findings: Delegation of duty policies under the roof of paramedic doctoroid practices in health services in Community Health Center. This research is a socio-legal aimed at uncovering the phenomenon of paramedic doctoroid practices.Applications of the study: The current study provides criticism for the government in creating inconsistent policies, poor supervision, and law enforcement behind doctoroid practice persistence.Novelty/Originality of the study: the concept of law enforcement is based on the philosophy of the first principle of Pancasila as the Indonesian ideology, transcendental-based law enforcement.

Abstract

Purpose of the study: This article aims to formulate (1) epistemology jurisprudence has the positivistic level, (2) jurisprudence epistemology has transcendental paradigm, and (3) epistemology of the development of prophetic jurisprudence. Methodology: This research uses library research by conducting research and data analysis and then they use it using knowledge, especially jurisprudence with transcendental values. Main Findings: The base of epistemological positivistic jurisprudence that is objective, empirical and rational which are supported by systematic, procedural and formal models result in its development has lost essential elements, namely spiritual values, so that modern society has a crisis in defining the meaning of life in the world. Applications of this study: The base of transcendental legal science understands people and their life in an intact form (holistic), not merely material nature but also their souls. The development of the prophetic law is intended as a guidance for human life to achieve happiness in the world and in the hereafter, because the prophetic law can not be fragmented between the physical body (formal) and transcendental values. Novelty/Originality of this study: The paradigm of the transcendental epistemology of legal science emphasizes in the integration approaches between sciences and values in various views

Abstract

Objective: This article aims to discuss the enforcement of customary law in North Maluku, the deliberation value in the BMA Sultanate of Ternate, and the implementation of customary criminal sanctions by the Badan Musyawarah Adat.Methodology: The methodology used in this study was legal research conducted in a non-doctrinal qualitative approach. In this study, the law is not only conceptualized as all the principles and rules that regulate human life in society but also includes institutions and processes that actualize the validity of these rules in society.Findings: Law enforcement of fisheries crimes is based on the provisions of Indonesian Law No. 45 of 2009 concerning Fisheries. Criminal provisions are regulated by Articles 84 to 104. One of them is about sinking the ship used to commit fishing crimes. Sanctions given to the fish theft (illegal fishing) perpetrators in territorial waters that have been determined by the local customary head are 1) warning; (2) monetary charges according to the agreement of the local customary community; and (3) boat (pajeko in Ternate) or motorboat seized by the sultanate to be used by the community through profit sharing.Utility: Customary Institute of Ternate Sultanate in 2018 has decided on three cases in the Kao bay area concerning fish catching. Besides the traditional law enforcement that is implemented by the Sultanate, North Maluku recognizes Sasi Customs (Adat Sasi), which is regulation of tradition that limits people for catching fish or taking other sources in a certain type and particular period. Thus, the ecological balance is still maintained.Novelty/Originality: The concept of transcendental law enforcement is substantially in line with the values in the Segulaha tradition that has been applied for a long time in North Maluku. In Segulaha customary law, there is a traditional element in a person who has the same soul with transcendental values by positioning revelation as the source of the law. Keywords: Law Enforcement, Fisheries Crimes, Transcendental Approach
