Abstract

Abstrak Permasalahan yang diangkat dalam penelitian ini adalah, 1) bagaimana perlindungan hukum terhadap Notaris berdasarkan prinsip Based On Fault Of Liability (Tanggung Jawab Berdasarkan Kesalahan); 2) bagaimana tanggung jawab hukum terhadap Notaris yang melakukan tindak pidana dalam pemalsuan akta otentik. Metode penelitian yang digunakan yaitu yuridis normatif dengan menggunakan pendekatan undang-undang, pendekatan kasus dan pendekatan konseptual.Kesimpulan penelitian ini yaitu perlindungan hukum terhadap Notaris berdasarkan prinsip Based On Fault Liability (tanggung jawab berdasarkan kesalahan) adalah apabila suatu unsur kesalahan tersebut terjadi diantara para penghadap maka sepanjang seorang Notaris tersebut menjalankan kewenangannya sesuai dengan apa yang tercantum di dalam Undang-Undang, Notaris yang bersangkutan tidak dapat diminta pertanggungjawabannya karena Notaris hanya mencatat semua informasi yang diperolehnya dari para penghadap. Kemudian, Tanggung jawab hukum terhadap Notaris yang melakukan tindak pidana dalam pemalsuan akta otentik adalah Notaris bertanggung jawab secara pidana ketika dalam proses pembuktian bahwa Notaris tersebut terbukti melakukan suatu tindak pidana yang memenuhi unsur-unsur yaitu kemampuan untuk bertanggung jawab, adanya kesengajaan atau kealpaan, dan tidak adanya alasan pemaaf Kata Kunci : Notaris, Perlindungan Hukum, Tindak Pidana Pemalsuan Surat Abstract The problems raised in this study are, 1) how is the legal protection of Notaries based on the principle of Based On Fault Of Liability (Responsibility Based on Errors); 2) what is the legal responsibility of a Notary who commits a crime in forging an authentic deed. The research method used is normative juridical using a law approach, a case approach and a conceptual approach. The conclusion of this research is that legal protection for Notaries based on the principle of Based On Fault Liability (responsibility based on errors) is that if an element of the error occurs between the parties, then as long as a Notary carries out his authority in accordance with what is stated in the Act, the Notary who The person concerned cannot be held accountable because the Notary only records all the information he or she obtains from the appearers. Then, the legal responsibility for a Notary who commits a criminal act in falsifying an authentic deed is that the Notary is criminally responsible when in the process of proving that the Notary is proven to have committed a crime that meets the elements, namely the ability to be responsible, intentional or negligent, and no excuses.

Abstract

This study aims to analyze the teacher's role as a facilitator in implementing explanatory text learning in elementary schools. In this subject matter, teachers are not only responsible for delivering lessons but also serve as mentors and facilitators to guide students in understanding concepts and composing explanatory texts independently. The research employed a qualitative approach through observations, interviews, and document analysis. The results indicate that the teacher's role as a facilitator includes providing relevant teaching materials, utilizing interactive and engaging teaching methods, and creating an attractive and conducive learning environment to encourage active student participation. Other methods employed by teachers involve group discussion strategies, the use of learning media, and providing feedback to enhance students' understanding of the structure and content of explanatory texts. In conclusion, the teacher's role as a facilitator significantly impacts students' abilities and development in understanding and composing explanatory texts. The implications of this study emphasize the importance of professional training and development for teachers to enhance the effectiveness of explanatory text learning at the elementary school level.
