Abstract

Akad murabahah adalah akad yang paling sering digunakan dalam pembiayaan. Namun, akad murabahah memiliki keterbatasan jangkauan objek. Karena itu, penggunaan akad murabahah harus memperhatikan keterbatasan tersebut. Artikel ini bertujuan untuk mengkaji pembiayaan murabahah pada produk pembiayaan BMTT Griya Sakinah di BMT Tumang, Boyolali. Artikel ini adalah penelitian kualitatif dengan sumber data dari lapangan. Hasil kajian menunjukkan bahwa penggunaan akad murabahah pada pembiayaan pembangunan rumah BMTT Griya Sakinah menimbulkan persoalan terkait objek akad. Namun, dari perspektif maqashid syariah dapat dibenarkan, sebab mengandung maslahat bagi penerima pembiayaan. Aspek-aspek maqashid syariah pada produk BMTT Griya Sakinah adalah bahwa produk pembiayaan tersebut merupakan usaha memenuhi kebutuhan daruriyat, penjagaan aktif terhadap dana simpanan masyarakat dan usaha untuk mengedarkan harta yang dapat menciptakan kesejahteraan bersama.

Abstract

Sustainable development Goals (SDGs) are a form of development, or even a further form of the Millennium Development Goals (MDGs). The SDGs, which contain 17 Goals and 169 Targets, are a global action plan for the next 15 years (effective from 2016 to 2030), to end poverty, reduce inequality and protect the environment. This discourse on SDGs is a global discourse, Muslims, as a part of the global order, are also part of this discourse. In the SDGs discourse as a global discourse, the SDGs need to be studied through Islamic studies. This paper tries to portray how the SDGs are studied through Islamic studies, especially in relation to the scientific discipline of fiqh. This study is considered necessary because fiqh is often considered as something final and sacred, while the SDGs are something “new” and dynamic. This paper tries to find a meeting point between fiqh as an Islamic study, and the SDGs as a global discourse. The results in this paper show that fiqh, as a scientific discipline, also has future-oriented dimensions through empirical evidence in classical fiqh literature and empirical evidence in the form of developing a methodology for finding Islamic law (fiqh). In addition, SDGs can be proposed as the main theme for the benefit of mankind as a benchmark and measuring instrument to measure the level of achievement of Maqashid Ash-Shari'ah in the contemporary era.

Abstract

Abstract: Cases of hoarding of goods still often occur even though legal instruments that prohibit hoarding have existed for a long time. Thus, efforts to prevent hoarding are not enough with legal instruments alone. Joint efforts are needed to mitigate hoarding. In this case, educating Muslims, as adherents of the majority religion in Indonesia, regarding Islamic views on the practice of hoarding needs to be presented. This paper aims to examine Islamic law regarding hoarding through the perspective of the Koran. The focus of the Qur'anic verses studied is Al-Hashr verse 7. The research method used is literature research with language, ushul fiqh, and historical approaches. The results of the study show that Islam Prohibits the act of hoarding goods needed by society because this action is contrary to the principle of economic equity. The principle of economic equity is the universal value of Surah Al-Hasyr verse 7. Hoarding which is prohibited by Islam is hoarding which is done by withholding the distribution of goods that are needed by the community, so that the price rises, to then be resold when the price has increased.Abstraks: Kasus penimbunan barang masih sering terjadi padahal instrumen hukum yang melarang penimbunan telah ada sejak lama. Dengan demikian, upaya mencegah penimbunan tidak cukup hanya dengan instrumen hukum. Perlu upaya bersama untuk memitigasi terjadinya penimbunan. Dalam hal ini edukasi umat Islam, sebagai pemeluk agama mayoritas di Indonesia, mengenai pandangan Islam terhadap praktik penimbunan perlu dihadirkan. Makalah ini bertujuan meneliti hukum Islam tentang penimbunan melalui perspektif Al-Qur’an. Fokus Ayat Al-Qur’an yang diteliti adalah surat Al-Hasyr ayat 7. Metode penelitian yang digunakan adalah penelitian pustaka dengan pendekatan bahasa, ushul fikih dan sejarah. Hasil penelitian menunjukkan bahwa perbuatan menimbun barang yang dibutuhkan oleh masyarakat dilarang oleh Islam, karena tindakan tersebut bertentangan dengan prinsip pemerataan ekonomi. Prinsip pemerataan ekonomi adalah nilai universal dari surat Al-Hasyr ayat 7. Tindakan penimbunan yang dilarang oleh Islam adalah penimbunan yang dilakukan dengan menahan distribusi barang yang dibutuhkan masyarakat, supaya harganya naik, untuk kemudian dijual kembali saat harganya telah naik.

Abstract

Human rights are basic rights inherent in every human being, including women. However, the stigmatization of women, which often makes the appearance of women's human rights limited, makes it difficult for them to develop themselves. Based on data from the UNDP Gender Inequality Index, Indonesia occupies the highest score in ASEAN with a gender inequality percentage of 48%. The participation of women in development is one of the reasons for the high preference for gender. The government has made various efforts to improve the dignity of women, one of which is through gender mainstreaming. In the context of decentralization, local governments need to elaborate on gender mainstreaming policies in local regulations as an effort to protect women's human rights laws in the regions. This paper aims to portray legal protection through gender mainstreaming within the framework of regional autonomy. The results of the study show that: first, local governments have the authority and responsibility in realizing gender-responsive regional development, both based on local government legal regimes and sectoral legal regimes. Regional autonomy should be able to address gender in accordance with the locality of the region. Second, gender mainstreaming is a necessity as well as a challenge for local governments, in the optics of law as a means of development, regional regulations regarding gender mainstreaming become the juridical basis for regions to ensure and realize conditions of gender equality at the regional level; increasing the contribution and role of women in the regions; and encourage gender-responsive regional development as a form of efforts to protect and fulfill women's rights.
