Abstract

The purpose of this research is to look at the Hybrid Contract Model (HCM) from the perspective of Islamic business ethics. This study uses a library research approach because the data sources come from various kinds of literature such as articles, books, books, and journals or previous research on the Hybrid Contract Model (HCM) from the perspective of Islamic business ethics (LKS). The results of the discussion The original law of a contract and its terms is valid unless it is canceled or prohibited by religion. So, as long as the Hybrid Contract Model (HCM) that is applied meets all the pillars and conditions set by Islamic law, the Hybrid Contract Model (HCM) is by Islamic business ethics which contains the values of oneness, balance, free will, responsibility, and virtue. Conversely, if in practice the Hybrid Contract Model (HCM) does not comply with the pillars, terms, and conditions of Islam, then the Hybrid Contract Model (HCM) is not fully by Islamic business ethics.

Abstract

The purpose of this study is to look at the role of Islamic Microfinance Institutions in Building a Sustainable and Inclusive Economy. This study uses a library research approach because the data sources come from various literature such as articles, books, and journals from previous studies regarding the role of Islamic Microfinance Institutions in Building a Sustainable and Inclusive Economy. The results of the discussion show: from OJK data (2021) it can be seen that the development of LKMS both in terms of assets, the amount of financing distributed, as well as the public savings that have been collected shows an increasing trend. This means that the existence of LKMS has a significant influence on the pace of sustainable economic development, of course, the realization of inclusive finance. Thus, the role of Islamic microfinance institutions in building a sustainable and inclusive economy in Indonesia proves to be important and relevant. Through an inclusive approach, based on Sharia principles and social and environmental responsibility, Sharia microfinance institutions can become key drivers in achieving sustainable and inclusive economic development goals in Indonesia.

Abstract

In writing this aims to examine the hadith regarding the agreement in realizing peace on Multijasa Ijarah Financing at KSSU Harum Dhaha Kediri. By using a qualitative approach with thematic and interpretive data analysis to gain a comprehensive understanding. The results of the writing show that the Agreement on multiservice ijarah financing at KSSU Harum Dhaha Kediri has an important role in creating peace and justice. With clear, transparent, and fair agreements, the parties involved can carry out their business activities safely and smoothlyIn addition, the agreement refers to the hadith of the Prophet as a source of law governing peace in transactions. The agreement also functions as a risk control instrument and provides a dispute resolution mechanism. Thus, multiservice ijarah financing at KSSU Harum Dhaha Kediri can contribute positively to economic growth based on Sharia values.

Abstract

Adapun tujuan dari penelitian ini untuk melihat sistem operasional pembiyaan ijarah multijasa di KSSU Harum Dhaha Kediri ditinjau dari DSN-MUI. Penelitian ini berbasis penelitian kualitatif dengan jenis penelitian studi kasus. Metode perolehan data tipe interview open-ended yang terfokus. Sementara analisis data: reduksi data, display data, dan konklusi data. Hasil penelitian menunjukkan system operasional Pembiyaan Ijarah Multijasa yang dijalankan beberapa sudah memenuhi ketentuan syari’ah: ta’awun (tolong menolong), menghindari iktinaz (penimbunan uang) dan pembayaran ZIS. Namun prinsip tijaroh (bisnis) dan pelarangan riba dirasa belum sesuai dengan ketentuan syariah. KSSU Harum Dhaha Kediri meringkas mekanisme yang telah ditetapkan DSN-MUI karena faktor keterbatasan SDM, efisiensi waktu, urgensi anggota, dan memudahkan transaksi anggota. Akhirnya menjadi indikasi praktik yang dilakukan belum sesuai dengan ditinjau dari DSN-MUI. Seharusnya yang diterapkan adalah menggunakan akad ijarah bil wakalah. Jika akad wakalah diterapkan maka anggota sesudah membayarkan biaya pendidikan atau biaya lain. Anggota harus memberikan bukti pembayaran biaya pendidikan ke KSSU Harum Dhaha Kediri.

Abstract

This study aims to describe the Implementation of the Hybrid Contract Model in the Chilli Sale and Purchase Transaction between Farmers and Collectors in the Perspective of Islamic Economics in Tegalan Village, Kandat District, Kediri Regency. Based on qualitative research with the type of case study research. Data acquisition methods with focused open interviews. While data analysis: data reduction, data display, and data conclusions. The results of the study explain the application of the hybrid contract model in chilli buying and selling transactions carried out between farmers and collectors in Tegalan Village, Kandat District, Kediri Regency using a qard contract, wakalah contract, and sale and purchase contract. The implementation of the hybrid contract model in chili buying and selling transactions between farmers and collectors is not in accordance with the provisions of Islamic economics, namely the qard contract transaction mechanism which is not in accordance with sharia provisions because the pillars and conditions of qard have not been massively realised. The sale and purchase agreement used by farmers and collectors is Al-Bai' al-mu'ajjal. But in this case, the collectors when taking chillies to farmers do not provide a definite statement regarding tsaman (price). So that it indicates that the practice of buying and selling transactions carried out is not in accordance with sharia provisions. Meanwhile, the implementation of this wakalah contract is in accordance with sharia provisions.
