Abstract

Gender often becomes an issue in assuming roles in family resilience. Some people believe that maintaining household stability is a responsibility solely entrusted to the husband. However, one of the factors contributing to divorce is the imbalance in household stability resulting from the lack of roles among family members in maintaining family resilience and well-being. This study aims to explore how family resilience education operates in Kemantren Village, Malang Regency. Simultaneously, this article also seeks to examine the implications of gender perspectives on the community in Kemantren Village. The research method used is qualitative, with a sociological approach. This study involves 27 individuals as informants who will fill out questionnaires and also serve as interview subjects to understand the state of family resilience education in Kemantren Village. The study findings indicate that women's roles in the family not only influence overall family dynamics but can also be crucial factors in facing challenges and strengthening family resilience. The insights from family resilience education in Kemantren Village have had a positive impact on the sustainability of their households. Considering women's roles in the context of family resilience is one essential step in addressing the divorce trend in Indonesia

Abstract

Exceptio dilatoria is an exception that states that a lawsuit filed with the Religious Court cannot be granted because it is premature. Until now, exceptio dilatoria is a problem that still often arises in the civil world. As for the consequences of the application of exceptio dilatoria, it is not uncommon for it to be a burdensome decision for one of the aggrieved parties. This study aims to analyze the legal considerations made by the panel of judges in deciding a lawsuit that is considered premature. By attaching several decisions from the lawsuit divorce case that was decided as a premature lawsuit. This study also analyzes the legal consequences of the existence of exceptio dilatoria in the case of contested divorce on the theory of legal justice and the theory of legal certainty. The research method used is normative juridical with case approach method. The results show that exceptio dilatoria is a problem that cannot be avoided as long as there is no legal rule governing it. This can be seen from the inconsistency of judges in applying exceptio dilatoria in cases of contested divorce. So that the considerations made by the panel of judges in applying exceptio dilatoria still cannot meet the standards of justice and legal certainty as formulated by Gustav Radburch. Exceptio dilatoria adalah suatu eksepsi yang menyatakan bahwa gugatan yang diajukan ke Pengadilan Agama tidak dapat dikabulkan karena prematur. Hingga saat ini, exceptio dilatoria merupakan masalah yang masih sering muncul dalam dunia perdata. Konsekuensi dari penerapan exceptio dilatoria tidak jarang menjadi keputusan yang memberatkan salah satu pihak yang dirugikan. Penelitian ini bertujuan untuk menganalisis pertimbangan hukum yang dilakukan oleh majelis hakim dalam memutus gugatan yang dianggap prematur. Dengan melampirkan beberapa putusan dari kasus gugatan cerai yang diputus sebagai gugatan prematur. Penelitian ini juga menganalisis akibat hukum dari keberadaan exceptio dilatoria dalam kasus perceraian yang disengketakan berdasarkan teori keadilan hukum dan teori kepastian hukum. Metode penelitian yang digunakan adalah yuridis normatif dengan metode pendekatan kasus. Hasil penelitian menunjukkan bahwa exceptio dilatoria adalah masalah yang tidak dapat dihindari selama belum ada aturan hukum yang mengaturnya. Hal ini dapat dilihat dari inkonsistensi hakim dalam menerapkan exceptio dilatoria dalam kasus perceraian yang disengketakan. Sehingga pertimbangan yang dilakukan oleh majelis hakim dalam menerapkan exceptio dilatoria masih belum dapat memenuhi standar keadilan dan kepastian hukum sebagaimana yang diformulasikan oleh Gustav Radbruch.

Abstract

Protection for children separated from their parents, particularly due to parental incarceration, is a pressing issue in Indonesia that demands serious attention. The absence of parental support and guidance places these children in vulnerable situations, negatively impacting their physical, emotional, and social well-being. This study examines the importance of legal and social protection for these children and explores the role of the state and government in providing adequate protection and welfare guarantees. Previous research reveals gaps in integrating Islamic legal principles with child protection policies that are contextual and relevant to contemporary social challenges. This article presents a review of key Islamic legal concepts related to child protection, such as maslahah mursalah, and integrates them with international human rights standards, such as the Convention on the Rights of the Child (CRC). Employing an empirical approach, the study investigates the implementation and practical outcomes of child protection laws. Primary data were gathered through interviews and observations involving key stakeholders, complemented by secondary data from books, journal articles, and legislative documents, including the Child Protection Act. The findings reveal that children separated from incarcerated parents often face neglect, discrimination, and social vulnerability. A case study of the Women’s Prison Class II A in Malang City highlights inadequate child protection measures due to insufficient government funding, which hampers the effective delivery of developmental and protective services for these children. To address these challenges, stronger regulatory frameworks and increased budgetary support are essential. Enhancing the role of the state in implementing robust policies will not only ensure the welfare of affected children but also set a standard for societal participation in fostering healthy, discrimination-free environments. Such measures are critical for safeguarding the rights and development of these vulnerable children.

Abstract

Responsive Law and Progressive Law are two relevant approaches in legal studies developed by legal thinkers such as Philip Nonet, Philip Selznick, and Sadjipto Raharjo. These approaches offer different perspectives on understanding and applying the law in a constantly changing social context. Despite having different perspectives, both Progressive Law and Responsive Law share the same goal of creating a more just and relevant legal system in a social context. This paper aims to examine the ideas of Philip Nonet, Philip Selznick, and Sadjipto Raharjo regarding Responsive Law and Progressive Law. Through this examination, it is expected to reveal the differences, similarities, and contributions of each thinker to the development of more inclusive, adaptive, and just legal thinking in an evolving social context.
