Abstract

The development of sharia banking in Indonesia has advances in information technology (IT) which have brought significant changes in the way sharia banks offer their products and services. This research discusses sharia banking in Indonesia. This research uses a qualitative study using a liberal research approach by looking for reliable information from written sources, such as books, journals and websites. In the results of this research, E-Banking not only provides comfort but also convenience because the menus on internet banking can be used without having to have special skills, and is safe because internet banking is equipped with a layered security system and is equipped with a token (a tool that issues password numbers). which always changes every time you make a financial transaction). Internet Banking services have many features and provide convenience, comfort and security so that sharia banking services can run easily and efficiently with qualified bank security services, smooth and easy e-banking services are obtained by customers who use e-banking products, in Islamic transactions contain sharia contracts that are applied in the sharia financial institution industry such as: Murabahah Mudharabah, Mudharabah Muqayyadah, Wadiah, Musyarokah, Musyarakah Mutanaqisah, Salam, Istishna, Ijarah, Ijarah Muntahiyah bit Tamlik, Wakalah, Kafalah, hawalah, Rahn, Qordh.

Abstract

This study aims to analyze contractual resilience in Islamic economics from a legal and economic perspective, focusing on sharia principles that influence contract resilience in the face of modern economic dynamics. Contractual resilience in the sharia system is influenced by the principles of justice, transparency, and risk-sharing that provide better protection for the parties to the contract. In addition, this study also highlights the role of law and regulation in ensuring that sharia contracts remain in accordance with sharia principles and are able to face global economic challenges. The methods used in this study are literature studies and interviews with experts in economics and sharia law. Literature studies were conducted by analyzing books, journals, and regulations related to Islamic economics, while interviews were conducted to obtain in-depth views from practitioners and experts in the field of Islamic economics. The results of the study indicate that sharia contracts have higher resilience compared to conventional contracts, especially in the face of economic crises, due to the principles of risk-sharing and transparency in sharia contracts. However, this study also found challenges in the implementation of sharia contracts that are inconsistent in several institutions, as well as the need for innovation in sharia financial products that are more adaptive to global economic changes. In conclusion, although the resilience of sharia contracts is better, there is still a need to strengthen education, innovation, and regulation to ensure more effective implementation.

Abstract

Keberadaan lembaga dan segala aturan yang didalamnya terdapat urusan uang dalam berjalannya keuangan negara, telah menjadi landasan dan pedoman terpenting dalam mempercepat laju pembangunan suatu negara, khususnya dalam hal perekonomian. Indonesia sebagai negara yang sebagian besar penduduknya memeluk agama Islam, tentunya menginginkan suatu mekanisme sebagai pengatur keuangan.  sekaligus  menghindari  sistem  bunga  dalam  perbankan.  Islam mewujudkan dasar perdagangan syariah. Bank syariah muncul sebagai jawaban atas kontra riba dan bunga perbankan. Maka dari itu, umat Islam Indonesia yang ingin operasional keuangannya di bank terhindar dari riba, tidak perlu khawatir lagi dengan keberadaan bank syariah atau bank syariah. Sektor perbankan penting sebagai penghubung antara modal dengan hasil riil yang berada di tangan pemilik modal. Penggunaan pertama perbankan dalam ekonomi besar harus diarahkan pada cara apa agar uang dapat digunakan dengan benar sebagai peringkat ekonomi. Keberadaan bank syariah tidak lepas dari anjloknya perekonomian yang awalnya terlihat dan disebut dengan krisis moneter. Bank syariah adalah bank yang dalam menjalankan keuangannya meninggalkan segala permasalahan riba. Dalam hal ini, bunga yang dianggap riba menjadi tantangan di masa sekarang. Keuangan Islam ada, berdasarkan dua alasan. Karena larangan mengambil riba di dalamnya. Dan karena transaksi keuangan yang ada di dalamnya, dianggap memiliki beberapa kekurangan.
