Abstract

An effort to protect workers throughout an economic transition to a sustainable economy gave rise to the concept of a just transition. This is because the transition will have an effect on the employment in which workers are engaged. Based on this concept, this study examines Indonesia’s worker response to a just transition. Non-doctrinal research was used to conduct the study. This study shows that the question of a just transition is not now at the forefront of the workers movement in Indonesia. Neoliberalization of Indonesian labour law, nollen vollens, encourages the workers movement to continue concentrating on economic concerns, particularly those involving the fundamental rights of workers. Under these circumstances, Indonesia runs the risk of failing to accomplish a just transition, which would put workers in a ‘dark world’ while the economy moves towards a green economy.

Abstract

The discussion in this article departs from the issues about the continuity of work of outsourced workers who are trying to be protected by the principle of Transfer of Undertaking Protection of Employment. The articles were prepared non-doctrinally in order to address the issue by incorporating outsourced workers by using the interview method and the statute approach. As a result, the TUPE principle failed to provide protection to outsourced workers. Which failure results from the practice of terminating the work agreement when the contract of business cooperation ends. Furthermore, the protection of the continuity of work for outsourced workers is based only on the moral obligations of the new outsourcing company. Based on the causes of this failure, the development of labour law must impose legal obligations on new outsourcing companies by incorporating the TUPE clause into the contract of business cooperation between the outsourcing company and the user company.

Abstract

Bagi negara hukum, undang-undang memiliki perananan yang sangat penting. Maka pembentukan sebuah undang-undang kerapkali mengundang perhatian publik, yang terbaru adalah pembentukan undang-undang di bidang hukum perburuhan yakni Cipta Kerja dan Perlindungan Pekerja Rumah Tangga. Pembentukan kedua undang-undang tersebut mendorong terciptanya gerakan sosial di dalam masyarakat. Pada satu sisi, gerakan sosial cipta kerja berupaya menggagalkan Cipta Kerja, sedang di sisi lainnya, gerakan sosial pekerja rumah tangga berupaya mengusung pengesahan Rancangan Undang-Undang Perlindungan Pekerja Rumah Tangga. Kedua gerakan sosial tersebut menemui ketidakberhasilan. Dengan berkaca pada ketidakberhasilan gerakan sosial tersebut, artikel ini merumuskan permasalahan tentang bagaimana watak politik hukum pembentukan undang-undang di bidang hukum perburuhan? Penelitian ini merupakan penelitian non-doktrinal yang menggunakan peraturan perundang-undangan dan studi kasus terkait gerakan sosial. Hasil penelitian menunjukkan bahwa gerakan sosial cipta kerja dan gerakan sosial pekerja rumah tangga diabaikan di dalam pembentukan undang-undang. Implikasinya, undang-undang yang dihadirkan tidak sesuai dengan kebutuhan hukum yang ada di lapangan. Pengabaian terhadap gerakan sosial dalam pembentukan undang-undang menyebabkan terabaikannya pula hak asasi manusia bagi buruh, yang pada tataran berikutnya memperlihatkan watak pembentukan undang-undang yang illiberal.

Abstract

Artikel ini menyoroti keberlangsungan legitimasi Cipta Kerja, sebuah undang-undang yang tetap legitim meski telah mendapat beragam upaya untuk menisbikan legitimasinya. Demonstrasi juga mobilisasi hukum di pengadilan tidak mampu untuk merobohkan Cipta Kerja. Secara khusus, artikel ini merumuskan permasalahan terkait mengapa Cipta Kerja dapat legitim? Digalang secara sosio-legal dengan mendayagunakan kerangka teori yang digagas oleh Pierre Bourdieu perihal bentuk-bentuk simbolik, kuasa simbolik, juga kekerasan simbolik. Penelitian ini mengungkap bahwa Cipta Kerja mencipta bentuk-bentuk simbolik berupa bahasa “akselerasi investasi dan penciptaan lapangan kerja” serta “kegentingan yang memaksa”. Bentuk-bentuk simbolik ini memberikan kuasa simbolik kepada Cipta Kerja, olehnya kekerasan-kekerasan yang hadir melingkupi Cipta Kerja seperti pengebirian hak-hak buruh dan pembentukan undang-undang yang ugal-ugalan menjadi nampak absah, terberi, serta tidak dapat dihindari.  Abstrak Artikel ini menyoroti keberlangsungan legitimasi Cipta Kerja, sebuah undang-undang yang tetap memiliki kekuatan hukum secara sah meski telah mendapat beragam upaya untuk menisbikan legitimasinya. Terdapat serangkaian demonstrasi hingga mobilisasi hukum di pengadilan yang juga tidak kunjung mampu untuk menghilangkan legitimasi Cipta Kerja. Terhadap realita sosial ini, studi ini berangkat dengan merumuskan permasalahan berupa: mengapa Cipta Kerja dapat tetap sah dan berkekuatan hukum meski serangkaian upaya untuk menghilangkan legitimasinya telah ditempuh? Studi ini, digalang secara sosio-legal dengan mendayagunakan kerangka teori yang digagas oleh Pierre Bourdieu perihal bentuk-bentuk simbolik yang menciptakan kuasa simbolik, juga kekerasan simbolik. Penelitian ini mengungkap bahwa Cipta Kerja menciptakan bentuk-bentuk simbolik melalui penggunaan bahasa seperti “akselerasi investasi dan penciptaan lapangan kerja” serta “kegentingan yang memaksa.” Bentuk-bentuk simbolik ini berkontribusi dalam memberikan kuasa simbolik kepada Cipta Kerja, yang pada gilirannya menjadi alat untuk mempertahankan legitimasi dengan menutupi berbagai bentuk kekerasan yang melekat pada Cipta Kerja. Akibatnya, pelbagai bentuk kekerasan—seperti pelemahan hak-hak buruh dan penyusunan regulasi yang serampangan—tampak sebagai sesuatu yang absah, terberi, dan tak terhindarkan.

Abstract

This article examines how neoliberal logic influences the articulation and implementation of the right to freedom of religion in Indonesia. Through a non-doctrinal approach and critical analysis of legal frameworks and institutional practices, it demonstrates that neoliberalism not only permeates the economic sphere but also redefines human rights, including religious freedom. Under the neoliberal regime, religious freedom is reduced to an individual preference subject to market logic and commodified within the frameworks of consumption and political stability. The state tends to adopt a passive or selective stance in protecting religious groups, privileging those aligned with dominant economic-political interests while restricting those perceived as disruptive to stability or oppositional to the status quo. Religious freedom is thus politicized, used as a tool for regime legitimacy, and controlled through administrative, symbolic, and economic mechanisms. This article highlights that genuine religious freedom cannot be realized without inclusive democracy, social justice, and the protection of pluralism. Therefore, structural efforts are necessary to liberate religious freedom from neoliberal constraints so that this right can be substantively and equitably exercised within Indonesia’s pluralistic society.

Abstract

The implementation of forced money (dwangsom) in Indonesia’s administrative courts is a legal tool aimed at ensuring compliance with court decisions, particularly in cases where government bodies fail to fulfill their obligations. This research explores the effectiveness of the dwangsom policy and its implications for improving compliance with administrative court rulings. Using a normative juridical approach, the study analyzes how dwangsom is applied in practice and its impact on the level of compliance by state institutions. The findings reveal that while the dwangsom policy has the potential to encourage compliance, its practical application remains inconsistent. In many instances, government agencies either evade or delay the payment of forced money, leading to minimal impact on ensuring timely enforcement of decisions. The research highlights the need for stricter enforcement mechanisms and greater accountability for public officials who fail to comply with court orders. This study introduces a novel perspective on the role of dwangsom in the broader context of administrative justice in Indonesia. It also addresses the urgency of enhancing its effectiveness to improve the credibility of the administrative courts. The contribution of this research lies in its critical evaluation of the dwangsom policy and its potential for reform. By offering recommendations for strengthening enforcement and compliance, this research aims to contribute to the ongoing discourse on improving the efficiency and accountability of Indonesia's administrative justice system. The findings are particularly relevant to policymakers, legal practitioners, and reform advocates working towards a more responsive legal system.
