Abstract

Perubahan aturan mengenai pengelolaan benih bening lobster di Indonesia sangatlah berpengaruh terhadap bisnis benih bening lobster. Kementerian Kelautan dan Perikanan dengan peraturan yang diciptakannya secara tidak langsung menunjuk PT. Aero Citra Kargo sebagai satu-satunya pelaku usaha yang dapat melakukan kegiatan transportasi benih bening lobster dalam sektor bisnis benih bening lobster. Sehubungan dengan permasalahan yang telah dikemukakan maka isu utama dalam penelitian ini adalah dampak dari peraturan yang mengakibatkan terjadinya praktik monopoli sebagaimana dalam Putusan Komisi Pengawas Persaingan Usaha Nomor 04/KPPU-I/2021 mengenai dugaan pelanggaran Pasal 17 Undang-Undang Nomor 5 Tahun 1999 yang dilakukan oleh PT. AeroCitra Kargo dalam layanan pengurusan transportasi benih bening lobster. Penelitian ini menggunakan metode penelitian yuridis-normatif dengan pendekatan peraturan perundang-undangan dan konseptual. Hasil penelitian mengungkapkan bahwa PT. AeroCitra Kargo terlibat dalam praktik monopoli dengan menyalahgunakan posisi dominannya untuk menghalangi pesaing masuk ke pasar dan mengeksploitasi konsumen, yaitu para eksportir, dengan menetapkan tarif layanan yang tinggi. Oleh karena itu, Putusan Komisi Pengawas Persaingan Usaha Nomor 04/KPPU-I/2021 berdasarkan penelitian yang dilakukan dianggap tepat karena dapat membuktikan bahwa PT Aero Citra Kargo telah melanggar Pasal 17 Undang-Undang Nomor 5 Tahun 1999.

Abstract

The purpose of this study is to analyze the Special Mining Business Permit Area for Religious Community Organizations in the Perspective of the Welfare State (Walfare State). This study uses normative legal research methods using a legislative approach and a conceptual approach. This study uses the theory of legal certainty, the theory of justice, and the theory of the welfare state as analytical knives in analyzing these problems. The results of the study show that the legal transformation in policies related to Article 83A PP No. 25/2024 is formally irrelevant to the rules above, namely in Law Number 4 of 2009 and Law Number 3 of 2020. However, the rules are still valid and can be implemented responsibly and professionally based on the analysis of legislation and theoretical analysis carried out by researchers, decisions made by government officials have binding force on all members of society, and have a public function, in the sense of performing public services.

Abstract

This study examines the legal consequences of a notary’s negligence in drafting an authentic deed involving illiterate parties. In notarial practice, a notary is required not only to comply with the formal requirements for preparing an authentic deed but also to ensure that the parties understand its contents and legal consequences. Legal issues arise when an illiterate party is involved, as the inability to read and comprehend the deed increases the risk of errors, abuse, and legal harm. This study employs normative legal research using statutory, conceptual, and case approaches. The findings reveal that notarial negligence may include failing to provide adequate explanations, failing to ensure the parties’ understanding, failing to verify their free consent, and focusing solely on administrative formalities. Such negligence may cause the deed to lose its authenticity, reduce its evidentiary value, result in its annulment, and undermine legal certainty. A notary’s liability may extend to administrative, civil, ethical, and criminal responsibility. Legal protection for illiterate parties may be provided through preventive measures, such as clearly reading and explaining the deed, as well as repressive measures, including civil litigation, complaints to the Notary Supervisory Council, and annulment of the deed. The study emphasizes the need to strengthen legal protection by reinforcing the prudential principle, the notary’s duty of care, and establishing specific standard procedures for handling vulnerable parties.

Abstract

This article examines the theoretical and normative construction of the use of de facto authority in the Indonesian administrative law system, particularly in relation to the limits of its use and the forms of accountability attached to government institutions. This study uses normative legal research. The discussion concludes that the use of de facto authority generally arises due to emergency conditions, normative vacuums, or unclear regulations, which require government institutions to act to maintain the smooth running of public services and prevent government stagnation. Although it provides flexibility beyond the formal legal mandate, the use of de facto authority remains limited by the principles of legality, material, territorial, and temporal boundaries as stipulated in the Government Administration Law, as well as the obligation to comply with the Principles of Good Governance (AUPB). The study's findings show that every use of de facto authority always has legal consequences through two forms of accountability: (1) official accountability, when actions are taken in the context of carrying out legitimate government duties, and (2) personal accountability, when officials act improperly, abuse their authority, or commit maladministration. This article emphasises that de facto authority remains an important tool but can only be exercised if it complies with the AUPB.
