Abstract

A legislative regulation as the basis of legal legality within the Rechtsstaat tradition has its own limitations. Legislation never fully and in detail regulates how legal rules should be applied in every legal event; therefore, jurisprudence serves to complement it. In addition to filling legal gaps, jurisprudence is a legal instrument aimed at upholding justice and legal certainty. This research seeks to answer the question of how jurisprudence exists as a result of legal findings by judges that ensures justice and legal certainty. Based on Article 24 of the 1945 Constitution, which is further elaborated in Article 1, point 1 of Law No. 48 of 2009 on Judicial Power, judges are granted the authority to interpret or reason legally. Moreover, when laws are incomplete or unclear, judges must engage in legal findings (rechtsvinding). In relation to this, referring to Article 24 of the 1945 Constitution, and further explained in Article 1, point 1 of Law No. 48 of 2009 on Judicial Power, judges are given the authority to interpret or reason legally. In addition, when the law is incomplete or unclear, judges are required to engage in legal findings (rechtsvinding). When the content of a legislative regulation is unclear, judges are obligated to interpret it in such a way that a truly fair decision can be reached, aligning with the intent of the law, which is to achieve legal certainty.

Abstract

Exonerating clauses have been widely used in agreements due to their time and cost efficiency. However, as the use of these clauses has expanded, there have been instances of non-compliance with certain requirements, which have subsequently caused disadvantages to certain parties. Exonerating clauses are often employed in freight forwarding service agreements by companies to limit their legal liability in the event of loss or damage to a consumer's goods. From the perspective of consumer protection, the use of exonerating clauses can create an imbalance in rights and obligations between service providers and consumers. According to Law No. 8 of 1999 on Consumer Protection, consumers have the right to safety, comfort, and security in the consumption of goods and services. However, exonerating clauses can undermine or limit these rights, potentially causing harm to consumers. This paper will discuss the use of exonerating clauses in freight forwarding service agreements from the perspective of consumer protection based on the Consumer Protection Act. It will focus on how these clauses can be used unfairly by companies to avoid liability and how the law should protect consumers from such detrimental practices. This analysis is crucial to ensuring that the use of exonerating clauses does not conflict with the fundamental principles of consumer protection established by law.

Abstract

Global uncertainty driven by economic changes, inflation, and the rapid development of digital technology has affected household economic stability across various social groups. These conditions have made financial literacy and household economic resilience increasingly relevant topics in community service programs. This study aims to analyze the role of financial literacy and household economic resilience in community service programs while expanding references related to community service in the field of community economic empowerment. The study employed a literature review method using a descriptive qualitative approach. Data were obtained from Google Scholar and several credible websites covering publications from 1964–2026. The initial search identified 50 articles, which were then strictly screened, resulting in 29 main articles used as analytical sources. The findings indicate that financial literacy influences people’s ability to manage income, control expenditures, and respond to household economic risks in a more adaptive and sustainable manner.
