Abstract

This study aims to analyze the compensation mechanism in land acquisition for PLN's construction of the 500 kV SUTET tower in Cilincing District, North Jakarta. The research employs a normative legal approach with a case study method, focusing on the application of legal norms and principles in practical implementation. Findings indicate that, from a regulatory perspective, the compensation mechanism is governed by Law No. 2 of 2012 and its derivative regulations, which outline four key stages: planning, preparation, implementation, and final transfer. However, the compensation process for landowners often presents complex legal and social challenges, including land ownership disputes, disagreements over compensation valuation, and the consignment mechanism, which frequently leads to legal claims from affected communities. The study reveals that, despite the systematic regulatory framework for land acquisition, its implementation remains ineffective in fully ensuring justice, transparency, and legal certainty. Disputes over compensation values and limited public participation are key factors contributing to conflicts between PLN and landowners. Therefore, it is essential to optimize deliberation mechanisms, enhance transparency in compensation assessment, and provide legal assistance to affected communities to ensure their rights are fully protected in national strategic land acquisition projects.

Abstract

This article aims to determine the authority of the Indonesian Navy as investigators of criminal offenses at sea, in line with their role in law enforcement in Indonesian waters. It examines the constraints faced by the Navy in law enforcement efforts and explores government measures to streamline these duties. The research method is normative legal research, which includes collecting, processing, and analyzing legal materials. The descriptive nature of this study connects factors with statutory regulations, theories, and expert opinions. A normative juridical approach is utilized, focusing on literature examination. The research concludes that the Indonesian Navy's authority as investigators in securing Indonesian waters is attributive, inherent to their office. From a constitutional law perspective, this attribution reflects the power of government organs to operate based on authority established by lawmakers, grounded in the constitution or legislation. According to the Law of the Republic of Indonesia Number 34 Year 2004 on the Indonesian National Armed Forces, Article 9, the Navy's role as law enforcement and security officers in Indonesian waters is hampered by unclear regulations. The Navy lacks authority to investigate all legal violations at sea, leading to overlapping law enforcement due to conflicting regulations that grant attributive authority.

Abstract

Indonesia is an archipelago that has abundant natural resources, especially in the Indonesian sea area. The importance of marine functions often leads to various violations of the law. The research entitled “The Role of The Maritime Security Agency in Law Enforcement of Maritime Crimes” has the formulation of the problem, namely how law enforcement is carried out by the maritime security agency to minimize criminal acts in Indonesian sea areas. The purpose of this study is to determine the role of The Maritime Security Agency in law enforcement against marine criminal offenses. The method used in this study is normative legal research. Conclusions on the research is The Maritime Security Agency has a function to synergize law enforcement in the Indonesian sea area. The Law Number 32 of 2014 about maritime affairs has a weakness because The Maritime Security Agency is not mandated to have a state-flagged ship to do hot pursuit and also the Maritime Security Agency is not overwritten with investigative authority. This resulted in the law enforcement process not being in line with the principle of justice which is fast, simple, and low cost.
