Abstract

Penulisan skripsi ini membahas implementasi diversi pada kasus tindak pidana anak dalam tahap penyidikan di Polres Palu. Kemudian membahas mengenai hambatan-hambatan dalam proses diversi pada tahap penyidikan di Polres Palu. Rumusan masalah dalam skripsi ini yaitu bagaimana implementasi diversi pada tahap penyidikan di Polres Palu dan faktor apa yang menghambat proses diversi di Polres Palu. Dengan metode penelitian yuridis empiris. Hasil penelitian adalah bahwa penyidik Polres Palu dalam mengimplementasikan proses diversi pada perkara anak sudah sesuai dengan apa yang diamanatkan undang-undang Sistem Peradilan pidana Anak dimana diversi yang dilaksanakan merupakan tindak pidana yang ancaman hukumannya dibawah 7 tahun, adapun banyaknya tindak pidana yang dilakukan oleh anak namun tidak diselesaikan melalui jalur diversi merupakan tindak pidana yang ancaman hukumannya diatas 7 tahun, penyidik Polres Palu dalam menangani kasus tindak pidana anak yang berkonflik dengan hukum penyelesaiannya telah dilaksanakan melalui jalur diversi dengan pendekatan restoratif justice system. Hambatan yang dihadapi adalah  ketidakpahaman pihak korban mengenai penyelesaian perkara tindak pidana anak melalui diversi.

Abstract

God created humans in pairs of their own kind to continue their offspring through legal marriage. In practice, marriages are not carried out in accordance with applicable regulations and are recognized by the state. There are still many people who carry out unregistered marriages which have both legal, social and psychological consequences. The purpose of this paper is to determine the understanding and knowledge of the legitimacy and legal consequences of unregistered marriages in the Uswatum Khasanah study group about unregistered marriages. The results showed that before the counseling was carried out they had the same perception about unregistered marriage and registered marriage because the point was to avoid adultery, after counseling they knew and understood the weaknesses of unregistered marriage, especially regarding the position of women and their offspring. This means that people do not understand the status of unregistered marriages, so intensive counseling is needed regarding unregistered marriages to community groups, especially those who are vulnerable to conducting unregistered marriages

Abstract

Deforestation is a phenomenon that needs to be addressed seriously to preserve the environment. One of the causes of deforestation is illegal logging activities in forest areas. The purpose of this research is to examine the impact of illegal logging, analyze the law enforcement process against illegal logging perpetrators and analyse obstacles in the implementation of law enforcement against illegal logging in Tojo Una-Una Regency. The research method uses empirical juridical research by using a conceptual approach and a case approach. This research concludes that the investigation of the crime of illegal logging in the Tojo Una-Una Regency area is carried out by Investigators at the Tojo Una-Una Police Station and Civil Servant Investigators of the Sulawesi Regional Environmental and Forestry Law Enforcement and Security Centre and obstacles in the implementation of law enforcement come from technical obstacles such as the difficulty of the terrain that must be traversed to reach the forest area,  lack of facilities and infrastructure and lack of personnel at Tojo Una-Una Police Station and investigators of the Sulawesi Regional Environmental and Forestry Law Enforcement and Security Centre to carry out law enforcement duties against illegal logging crimes, as well as obstacles originating from the rule of law or legal substance, especially after the enactment of the Job Creation law.

Abstract

This study aims to analyze the implementation of legal protection for child victims of violence and the juridical implications of resolving such cases through customary law mechanisms in Parigi Moutong Regency. Employing an empirical juridical method, the research incorporates a conceptual approach, a case approach, and a statute approach. Data were obtained through surveys, observations, and interviews with relevant stakeholders, and analyzed qualitatively. The findings reveal that legal protection for child victims has been implemented by relevant authorities, including law enforcement and child protection agencies. These efforts involve both formal legal proceedings and non-judicial support such as victim assistance and rehabilitation provided by the Department of Women’s Empowerment, Child Protection, Population Control, and Family Planning. However, the research also highlights the ongoing practice of resolving cases particularly those involving sexual violence through customary law. Such resolutions often contradict national legal standards and principles of children's human rights. The preference for customary mechanisms among local communities and traditional leaders reflects sociocultural norms and the perceived accessibility of informal justice systems. The study underscores the need for policy harmonization between state law and customary practices to ensure the protection and fulfillment of children's rights.
