Abstract

Tujuan penulisan ini untuk mengetahui tugas dan wewenang DPRD Provinsi Bali dalam fungsi pengawasan implementasi produk hukum daerah pada pandemi Covid-19 dan untuk mengetahui faktor yang mempengaruhi dan upaya mengatasi efektivitas tugas dan wewenang DPRD Provinsi Bali dalam fungsi pengawasan implementasi produk hukum daerah pada Pandemi Covid-19. Metode penelitian yang digunakan adalah metode penelitian hukum empiris. Berdasarkan hasil penelitian yang dirumuskan yaitu efektivitas tugas dan wewenang DPRD Provinsi Bali dalam fungsi pengawasan implementasi produk hukum daerah pada pandemi Covid-19 telah berjalan dengan baik namun belum efektif karena adanya pandemi Covid-19. Faktor yang mempengaruhi yaitu minimnya pemahaman anggota DPRD Provinsi Bali terhadap fungsi pengawasan, banyaknya produk peraturan Daerah yang dikeluarkan setiap tahun yang tidak segera diikuti dengan peraturan Gubernursebagai peraturan pelaksanaan, kurangnya komunikasi antara DPRD dengan masyarakat yang menyebabkan aspirasi yang berasal dari masyarakat kurang tertampung.

Abstract

A cooperative is a legal entity established by individuals or other cooperatives that provides savings and loan services to the public. Currently, credit unions for savings and loans are becoming increasingly popular among credit seekers. In the case of the Catur Mega Sedang Cooperative, a breach of contract occurred when a debtor defaulted on their obligations, failing to fulfill their promised repayment duties. The issue faced by the Catur Mega Sedana Cooperative stemmed from the debtor’ s negligence in fulfilling their loan repayment obligations. The research employed an empirical legal research method, utilizing theories of Legal Systems, Contract, and the Functions of Law. The study demonstrates that although credit provision and regulation are effectively implemented in accordance with relevant laws and regulations, insufficient diligence in financial analysis or the application of the 5C principles in credit provision by the LPD led to non-performing loans. The Catur Mega Sedana Cooperative resolves these non-performing loan disputes through non- litigious means.

Abstract

Lembongan Village, located in the coastal area of Nusa Penida District, Klungkung Regency, faces significant challenges in maintaining coastal environmental sustainability amid rapid tourism growth. This study focuses on the effectiveness of Lembongan Village's role in addressing coastal boundary violations that lead to environmental pollution. Using an empirical legal approach and analysis of local policies, this research evaluates the village's role in supervision, mediation, education, and law enforcement. The study's findings indicate that uncontrolled development, including the construction of villas, homestays, and restaurants, has significantly impacted marine ecosystem degradation and beach erosion. Despite efforts in law enforcement, the main challenges faced include a lack of community awareness, inconsistencies in law enforcement, and limited resources. This research recommends enhancing more comprehensive local regulations, sustainable environmental education, and collaboration between the village government and the community to create a more sustainable coastal environment. Thus, it is hoped that Lembongan Village can maintain environmental sustainability while supporting the welfare of the local community, which depends on coastal resources.

Abstract

Ecological justice is essential for maintaining environmental sustainability and ensuring fair access to natural resources. However, its implementation is often hindered by economic and political interests, weak institutional capacity, and inadequate legal frameworks. This research evaluates the Indonesian government's commitment to ecological justice by analyzing the effectiveness of its environmental policies. Using a normative legal research method with a conceptual approach, legislative analysis, and comparative study, this study examines Indonesia’s policy framework and governance challenges. The findings show that despite various policy commitments, regulatory weaknesses, insufficient protection of indigenous rights, and limited public participation hinder progress. Indonesia prioritizes economic growth over environmental sustainability, leading to ecological degradation. Industrial dominance, legal loopholes, weak law enforcement, and corruption further exacerbate these issues. Meanwhile, Saudi Arabia has demonstrated a strong commitment through initiatives like the Saudi Green Initiative and major investments in renewable energy. To achieve ecological justice, Indonesia must strengthen environmental policies, improve law enforcement, and enhance cross-sector collaboration. By adopting Saudi Arabia’s targeted strategies, increasing transparency, and integrating green technologies, Indonesia can accelerate its transition toward sustainable and inclusive development.
