Abstract

This forensic linguistics study aims to evaluate whether the prosecutors of the South Jakarta and Surabaya District Courts in the case of hate speech committed by Ahmad Dhani (AD) are in accordance with the Electronic Information and Transaction Law (ITE Law) Number 11 of 2018 and ITE Law Number 19 of 2016. In addition, this research also aims to determine the qualifications of hate speech in AD's case. Data was collected through the documentation method, which includes collecting data that has been circulating in the community online, following the legal process written in the South Jakarta and Surabaya Case Tracking Information System (SIPP), and looking at the results of the District Court decisions that have been legally binding (Inkracht) Number 370/Pid.Sus/2018/PN JKT.SEL and Number 275/Pid.Sus/2019/PN Sby. After the data was collected it was analyzed using a forensic linguistic approach. The language data of the legal case was analyzed through the approach of the internal structure of language, namely semantics, and the external structure of language which includes sociolinguistics and pragmatics. The results of this study show that the speech used by AD has negative diction and can demean his speech partners, then the prosecutor's charges against AD were not found to abuse the 2016 ITE Law and there were no rubber articles that caused multiple interpretations. AbstrakKajian linguistik forensik ini bertujuan mengevaluasi apakah tuntutan jaksa Pengadilan Negeri Jakarta Selatan dan Surabaya dalam kasus ujaran kebencian yang dilakukan oleh Ahmad Dhani (AD) sesuai dengan Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) Nomer 11 Tahun 2018 dan UU ITE Nomor 19 Tahun 2016. Selain itu, penelitian ini juga bertujuan menentukan kualifikasi ujaran kebencian dalam kasus AD. Data dikumpulkan melalui metode dokumentasi, yang meliputi pengumpulan data yang telah beredar di masyarakat secara daring, mengikuti proses hukum yang tertulis di Sistem Informasi Penelusuran Perkara (SIPP) Jakarta Selatan dan Surabaya, dan melihat hasil putusan Pengadilan Negeri yang telah berkekuatan hukum tetap (Inkracht) Nomer.370/Pid.Sus/2018/PN JKT.SEL dan Nomer.275/Pid.Sus/2019/PN Sby. Setelah data terkumpul, analisis dilakukan menggunakan pendekatan  linguistik forensik. Data bahasa berkasus hukum tersebut dianalisis melalui pendekatan struktur internal bahasa, yaitu semantik, dan struktur eksternal bahasa yang mencakup sosiolinguistik dan pragmatik. Hasil penelitian ini menunjukkan bahwa tuturan yang digunakan AD memiliki diksi negatif dan dapat merendahkan mitra tuturnya. Dalam tuntutan jaksa kepada AD tidak ditemukan penyalahgunaan UU ITE 2016 dan tidak terdapat pasal karet yang menyebabkan multitafsir.

Abstract

Al-Mu'allaqāt is the most famous Arabic poem of the pre-Islamic period. Al-Mu'allaqat often uses flirting as one of its themes, and Umru’ul-Qays' al-Mu'allaqat is no exception. It is addressed to his lover, Unaizah. It is often regarded as an expression of the poet's love for his beloved, but like any other poem, the flirtation stanzas in Umru'ul-Qays' al-Mu'allaqat also expresses meaning in the indirect ways. The purpose of this study is to determine the meaning of Umru'ul-Qays' flirtation stanzas in Al-Mu'allaqat. This research applies Michael Riffaterre's semiotic theory and implements his methods, such as heuristic reading, hermeneutic reading, searching for matrix, model, variant, and hypogram. The data source is the flirtation stanzas to Unaizah in the poetry Al-Mu'allaqāt by Umru’ul-Qays. This research is to understand the meaning and social context of Arabic literary works, as well as to dissect the variations of the sayings used by Umru'ul-Qays for Unaizah, which reflect the unrequited love between the two.  The results of this research are that the flirtation stanzas in Al-Muallaqat by Umru’ul-Qays also expresses meaning in an indirect way. This poem also describes Umru'ul Qays' deep love even though he was rejected many times.

Abstract

Kasus Lina Mukherjee (LM) yang menggunggah video kontroversial di Tiktok pada tahun 2023 cukup menarik perhatian publik. LM dilaporkan ke Pengadilan Negeri Palembang dan dijatuhi hukuman penjara selama dua tahun. Tujuan penelitian ini adalah mengidentifikasi bentuk dan jenis tuturan LM, menganalisis makna leksikal dan gramatikal tuturan LM, dan mengetahui dampak tuturan LM. Pengumpulan data dilakukan dengan metode dokumentasi, yaitu mengumpulkan data yang tersebar di sosial media, mengikuti proses hukum dari web putusan.mahkamahagung.go.id yang telah berkekuatan hukum tetap (Inkracht). Setelah data dikumpulkan, peneliti menganalisis dengan pendekatan linguistik forensik. Data linguistik dari proses hukum dianalisis menggunakan pendekatan sosiolinguistik dan pragmatik. Hasil dari penelitian ini adalah terdakwa LM adalah wanita dewasa yang memiliki jutàan pengikut di media sosialnya dan tuturan yang digunakan LM terbukti memiliki diksi yang negatif. Terdapat empat jenis tindak tutur non-literal, yaitu Ironi, Hiperbola, Humor, dan Sarkasme. Dampak dari tuturan LM adalah menyinggung pengikutnya, terutama mereka yang memegang teguh nilai-nilai agama dan norma sosial, tuturan LM sesuai yang dituduhkan oleh jaksa bahwa prilaku dan perbuatan LM melanggar UU ITE.

Abstract

This research aims to examine typology of personal pronouns in Austronesian language families in Indonesia with a particular focus on phoneme variation and syntactic patterns. This research takes examples from five regional languages: Bengkulu Malay, Belitung Malay, Pontianak Malay, Rejang, and Lembak. Data collection involved classifying personal pronouns according to the '1/2/3' person system as proposed in Dixon’s theory of personal pronouns. These pronouns were then analyzed within sentence structures to observe their syntactic behavior and then the researcher looked for similarities that characterize the language as an Austronesian family, as well as identifying its distinctiveness. The results of this study show that the five languages studied have similarities that characterize the language as part of the Austronesian family. In addition, there are differences in phonemes that characterize each language. For example, the use of the word “aku” to refer to the first person singular pronoun known in all the languages. However, phonological variations occur, in Rejang, the word “aku” undergoes a phoneme change to “uku”. In syntactic system all the languages studied have a system of Subject, predicate, then object. The findings in this study show phonological and syntactic dynamics that enrich the diversity of the syntax that enriches the linguistic diversity in the Austronesian family in Indonesia. These dynamics are influenced by various factors, such as social, history, and geography.
