Abstract

This research aims to compare the regulations regarding experts in advanced countries such as the United States, the United Kingdom, and Australia, to then be used as examples for reformulating expert standardization in Indonesia. This study employs a normative juridical method using secondary data consisting of primary legal materials related to experts and secondary legal materials, such as international journals and books. The approach used in this research includes conceptual, legislative, and comparative approaches with other countries. The results of the study show that the United Kingdom has Civil Procedure Rules that extensively regulate the rights and obligations of experts, while the United States has the Federal Rules of Evidence, which also specifically regulate the qualification standards for experts. In Australia, regulations related to experts have been established in the Evidence Act 1995 and Federal Court Rules 2011, which often discuss the code of conduct for experts in court. This research concludes that Indonesia needs to adopt more detailed regulations regarding experts in the criminal justice system, starting with the creation of a code of conduct containing requirements to become an expert, the rights and obligations of experts, and the mechanism for the process of providing expert witness testimony. However, it is not sufficient to stop there; there must be encouragement from the authorities to ensure that this code of conduct is read and understood by prospective experts. Additionally, there should be standards for qualifications, experience, and the mechanism for providing testimony due to the lack of credibility and reliability of an expert presented in court.

Abstract

The advancement of information and communication technology had caused an increase in data breaches and data misuse. The state is encouraged to have strong law regulations concerning the protection of personal data of its society. This research then aims to explain the lack of legal regulation in Indonesia regarding the protection of personal data. In analyzing the problem, this research used the juridical-normative method (legal research) by oriented on the law principles, law norms, and positive law in Indonesia which is relevant to the research’s topic. The conceptual approach was also used in this research because the researcher is more focused on the law regulation that had been issuance. Legal sources were then much used as research data, starting from the Indonesian Constitution to the draft regulation. This research shows that different from Malaysia and Singapore that are already have the Personal Data Protection Act, Indonesia does not yet have a comprehensive personal data protection law. This is because the protection and misuse of personal data in Indonesia are still regulated as sectoral or scattered in several regulations and acts. As a consequence, Indonesia does not have a clear reference for handling the data misuse cases that are happening. This research then gives some advice and recommendations to the government to pass the Draft Regulation on Personal Data Protection which has been discussed since 2016.

Abstract

Class action lawsuits have become an important instrument in fighting for justice for victims of natural disasters in Indonesia, as seen in the 2021 South Kalimantan flash flood case. This study analyzes the effectiveness of class action lawsuits as a corrective justice mechanism under Law No. 24 of 2007 on Disaster Management by examining the Banjarmasin State Administrative Court Decision No. 6/PEN-HS/2021/1/PTUN.BJM and its relevance to the West Java 2025 flash flood. Through a juridical-normative approach with document analysis of court decisions, the research shows that although the lawsuit required significant resource mobilization and was unsuccessful in obtaining material compensation that should have been the right of victims according to Article 26 letter (d) of Law No. 24 of 2007, it proved effective in forcing disaster management policy reform. The South Kalimantan case led to the procurement of an early warning system worth IDR771.5 million and supporting infrastructure worth IDR2.2 billion. Comparative analysis identified similar patterns of institutional negligence in both disasters: unpreparedness of early warning systems, slow emergency response, and neglect of the impact of environmental damage due to land conversion. This research confirms that despite evidentiary challenges and bureaucratic resistance, class action lawsuits remain a vital instrument in promoting government accountability and structural reform in disaster management as mandated by Law No. 24/2007.

Abstract

This study aims to analyze the legal and political efficiency of the 2024 Pertalite subsidy policy from a legal and economic perspective based on the Kaldor Hicks efficiency principle. The results show that the Pertalite subsidy policy has not fully achieved economic and legal efficiency, as reflected in the negative net social benefits ranging from IDR 8–18 trillion per year. This condition indicates that the resulting social benefits have not exceeded the social costs borne by the state and society. The observed inefficiency is mainly caused by inaccuracies in targeting subsidy recipients, limited data integration between institutions, and a suboptimal legal framework governing the protection and management of digital data in the subsidy distribution system. From a normative perspective, the Pertalite subsidy policy also requires further strengthening to be more aligned with the principles of efficient and fair economic resource management as mandated by Article 33 of the 1945 Constitution of the Republic of Indonesia.

Abstract

Abstract

The misuse of police patrol and escort (patwal) services has become a viral phenomenon on Indonesian social media, with cases such as the RI-36 official vehicle (January 2025), Celeste Anastasia's use for a "nail appointment" (December 2024), and police escort vehicles disrupting ASEAN Summit delegations (September 2023), generating public concern and giving rise to the "No Viral, No Justice" phenomenon as a reflection of declining public trust in police institutions. This study aims to analyze the juridical aspects of police escort misuse, examine its impact on Pancasila social justice principles, and formulate preventive policy recommendations using normative legal methods with descriptive-analytical approaches through literature studies of Law No. 2/2002 on the Police, Law No. 22/2009 on Traffic and Road Transport, and Police Regulation No. 14/2011 on Police Code of Ethics. The research findings indicate that escort misuse violates Traffic Law Articles 134-137 regarding priority vehicles, police code of ethics, and potentially constitutes abuse of authority, while contradicting the second and fifth principles of Pancasila, resulting in decreased public trust and perceptions of unfair law enforcement. The study concludes that escort misuse constitutes a serious legal violation contrary to Pancasila values, necessitating regulatory reform through revision of Police Regulations with clear criteria, strengthened internal oversight, firm sanctions without favoritism, and reform commitment from police leadership to restore public trust.
