Abstract

The state's unequivocal responsibility to safeguard children as victims of violence, particularly sexual abuse, is imperative due to their pivotal role in future development. The study method used the normative way. The research findings aim to serve as a guide for crafting policies aligning with national law, contributing positively to legal science by addressing material and formal legal aspects, as well as enhancing victim protection and recovery. The prevalence of unsettling acts of sexual harassment underscores a pressing need for vigilant attention. Child victims of sexual violence endure profound psychological impacts, ranging from mild to severe trauma, leading to a loss of self-confidence, shame, and, tragically, suicide in some cases. This study delves into child protection policies in Makassar, Indonesia, scrutinizing shortcomings in addressing sexual crimes against minors. Therefore, legal innovations for enhanced handling of such cases, ensuring justice for the victims and fostering societal balance are needed.

Abstract

Tujuan penelitian menganalisis pemberlakuan Peraturan Pemerintah Nomor 34 Tahun 2021 Tentang Penggunaan Tenaga Kerja Asing Tidak Mengandung Catat Formal Pasca Putusan Mahkamah Konstitusi Nomor 91/PUU-XVII/2020. Tipe penelitian ini dikualifikasikan kedalam tipe penelitian normatif atau penelitian hukum doktrinal yang berorientasi pada pendekatan terhadap berbagai norma-norma peraturan perundangan-undangan termasuk Putusan Mahkamah Konstitusi. Hasil penelitian bahwa Pemberlakuan Peraturan Pemerintah Nomor 34 Tahun 2021 tentang Penggunaan Tenaga Kerja Asing tetap diberlakukan meskipun dalam putusan Putusan Mahkamah Konstitusi Nomor 91/PUU-XVIII/2020 secara tegas mengatakan dalam pembentukan Undang-Undang Cipta Kerja memiliki cacat formil. Implikasi hukum pemanfaatan tenaga kerja asing Peraturan Pemerintah Nomor 34 Tahun 2021, memiliki dampak signifikan terhadap hak konstitusional tenaga kerja lokal. Dalam aspek perizinan, perubahan dari Undang-Undang Ketenagakerjaan ke Undang-Undang Cipta Kerja menggeser sanksi pidana bagi pelanggaran izin tenaga kerja asing menjadi hanya sanksi administratif, yang menunjukkan perubahan fokus dari perlindungan tenaga kerja lokal ke peningkatan investasi. The research objective is to analyze the implementation of Government Regulation Number 34 of 2021 concerning the Use of Foreign Workers Not Containing Formal Notes After the Constitutional Court Decision Number 91/PUU-XVII/2020. This type of research is qualified as normative or doctrinal legal research oriented towards approaches to various statutory and regulatory norms including Constitutional Court Decisions. The research results show that the implementation of Government Regulation Number 34 of 2021 concerning the Use of Foreign Workers remains in effect even though the Constitutional Court Decision Number 91/PUU-XVIII/2020 explicitly states that the formation of the Job Creation Law has formal defects. The legal implications of using foreign workers, Government Regulation Number 34 of 2021, has a significant impact on the constitutional rights of local workers. In the licensing aspect, the change from the Employment Law to the Job Creation Law shifts criminal sanctions for violations of foreign worker permits to only administrative sanctions, which shows a change in focus from protecting local workers to increasing investment.

Abstract

Deklarasi Universal Hak Asasi Manusia (HAM) dan Kovenan-Kovenan Internasional mengenai HAM, telah memproklamasikan dan menyetujui bahwa setiap orang berhak atas seluruh hak dan kebebasan sebagaimana yang telah diatur di dalamnya, tanpa perbedaan dalam bentuk apa pun. Keterlibatan internasional tentang perlindungan anak penyandang disabilitas diatur dalam Convention on The Right of Persons with Disabilities dengan maksud melindungi hak dan martabat penyandang disabilitas. Tujuan penelitian ini adalah untuk mengetahui kondisi perlindungan HAM terhadap anak penyandang disabilitas di Indonesia dari tindakan pelecehan seksual dan Untuk mengetahui faktor yang menyebabkan anak penyandang disabilitas menjadi kelompok yang rentan terhadap pelecehan seksual. Metode penelitian adalah penelitian hukum normatif dengan bahan hukum primer, sekunder dan tersier. Pendekatan yang digunakan peraturan perundang-undangan (statute approach). Hasil dan Kesimpulan adalah Kondisi perlindungan HAM terhadap anak penyandang disabilitas di Indonesia, dari tindakan pelecehan seksual adalah masih menghadapi keterbatasan perlindungan hukum. Meskipun Indonesia telah memiliki berbagai peraturan perundang-undangan terkait perlindungan anak, seperti Undang-Undang Perlindungan Anak (UUPA) dan undang-undang tentang Penyandang Disabilitas, implementasi perlindungan terhadap anak penyandang disabilitas masih kurang optimal. Faktor yang menyebabkan anak penyandang disabilitas menjadi kelompok yang rentan terhadap pelecehan seksual adalah internal dan eksternal. Kata Kunci: Hak Asasi Manusia, Anak, Penyandang Disabilitas, Pelecehan Seksual

Abstract

Tujuan penelitian menganalisis implementasi UU No.12/2022 tentang Tindak Pidana Kekerasan Seksual di Polres Maros. Penelitian ini merupakan penelitian dengan pendekatan yuridis-empiris. Hasil penelitian menunjukkan bahwa: 1) Unit PPA Satreskrim Polres Maros sudah menerapkan UU No. 12/2022 tentang Tindak Pidana Kekerasan Seksual dari akhir tahun 2023 hingga saat ini, namun UU TPKS ini hanya diterapkan pada Korban Perempuan Dewasa saja, untuk Korban Anak masih menggunakan Undang-Undang Perlindungan Anak, dan 2) Pembuktian hukum kepada perempuan dewasa yang menjadi korban tindak pidana kekerasan seksual di Kepolisian Resor Maros, masih ada yang kurang berjalan optimal. Hal ini dikarenakan kurangnya bukti yang didapatkan serta pihak korban yang tidak kooperatif saat dimintai keterangan oleh Penyidik Kepolisian, sehingga penyidik mengalami kesulitan dalam membuktikan perkara tersebut. The research objective is to analyse the implementation of Law No. 12/2022 concerning Criminal Acts of Sexual Violence in the Maros Police Resort. This study is a study with a juridical-empirical approach. The results of the study indicate that: 1) The PPA Unit of the Maros Police Criminal Investigation Unit has implemented Law No. 12/2022 concerning Criminal Acts of Sexual Violence from the end of 2023 until now, but this TPKS Law is only applied to Adult Female Victims, for Child Victims still using the Child Protection Law, and 2) Legal evidence for adult women who are victims of criminal acts of sexual violence in the Maros Police Resort, there are still some that are not running optimally. This is due to the lack of evidence obtained and the victims who are not cooperative when questioned by Police Investigators, so investigators have difficulty in proving the case.

Abstract

This research aims to know and understand the regulation of customary criminal law of the Bugis community against samen leven acts that violate customary norms and to know and understand the social impact on samen leven offenders in society. This research uses normative research methods, namely the type of research conducted by analyzing legal rules. This type of research is conducted by means of a literature study, namely by reading and analyzing written materials. The results show that customary criminal law still plays a role in upholding the norms of decency in society, especially in dealing with the phenomenon of samen leven . In Bugis society, the value of Siri'na Pacce reinforces the view that this behavior tarnishes honor and social balance, so customary sanctions are still applied even though national law has regulated it in the Criminal Law Code. In addition to being socially stigmatized, samen leven perpetrators also face impacts such as family disharmony and unclear child status. Therefore, customary law is still considered relevant in resolving cases culturally and maintaining social harmony in society. The recommendations of this research are 1. Socialization of the negative impact of samen leven and the importance of customary norms and laws need to be improved through education, media and communities so that the younger generation understands the consequences. 2. A policy that harmonizes customs and national laws is needed, so that the settlement of samen leven cases still consider cultural aspects, justice and protection for all parties.

Abstract

This study aims to determine and analyze the role of the BPOM (Indonesian National Agency of Drug and Food Control) in protecting consumers from skincare products containing mercury. It also aims to identify and analyze the legal actions taken by BPOM Makassar City against skincare products that do not meet quality standards. This research uses an empirical legal research method, which involves field data as the primary source, such as interviews and observations. The results of the study indicate: (1) The role of BPOM in providing consumer protection against the circulation of skincare products containing mercury by monitoring and supervising the circulation of skincare products in the market to ensure they do not contain harmful substances, implementing pre-market surveillance, conducting post-market surveillance, and inspecting skincare products circulating in the market. (2) The legal actions taken by BPOM against skincare products that do not meet quality standards include administrative sanctions and criminal sanctions. As recommendations: (1) The government needs to implement stricter supervision to better protect consumers from the use of cosmetics that do not have BPOM circulation permits. (2) There must be good cooperation between the government, BPOM, and law enforcement authorities in efforts to protect consumers from the circulation of cosmetics that do not meet the standards, through regular supervision of producers and business actors, as well as providing outreach to the public to raise awareness.
